About measures for further enhancement of economic mechanisms of ensuring conservation

According to the laws of the Republic of Uzbekistan "About conservation", "About protection of atmospheric air", "About waste", and also for the purpose of further enhancement of economic mechanisms of ensuring conservation in the Republic of Uzbekistan the Cabinet of Ministers decides:

1. Approve Regulations on procedure for application of compensation payments for pollution of the surrounding environment and placement of waste in the territory of the Republic of Uzbekistan according to appendix No. 1.

2. Determine that:

a) base rates of compensation payments for pollution of the surrounding environment and placement of waste are accepted in coefficients from the established size of basic settlement size;

b) compensation payments for pollution of the surrounding environment and placement of waste in the territory of the Republic of Uzbekistan are levied by bodies of the State committee of the Republic of Uzbekistan for ecology and environmental protection except for of compensation payments for above-standard dumpings of pollutants into utility sewer networks and distributed as follows:

74 percent - in Fund of ecology, environmental protection and address with waste under the State committee of the Republic of Uzbekistan on ecology and environmental protection;

26 percent - in the republican budget of the Republic of Uzbekistan.

c) compensation payments for environmental pollution and placement of waste in the territory of the Republic of Uzbekistan in the part concerning sewer dumpings are levied by the Ministry of housing-and-municipal servicing of the Republic of Uzbekistan and distributed as follows:

74 percent - in Fund of development of housing and communal services of the Ministry of housing-and-municipal servicing of the Republic of Uzbekistan;

26 percent - in the republican budget of the Republic of Uzbekistan.

3. Make changes and additions to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 2.

4. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 3.

5. This resolution becomes effective since January 1, 2019.

6. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan - the chairman of the board of JSC Uzbekiston temir yullari A. Zh. Ramatov and the chairman of the State committee of the Republic of Uzbekistan on ecology and environmental protection B. T. Kuchkarov.

Changes and additions made to some decisions of the Government of the Republic of Uzbekistan

1. In the resolution of the Cabinet of Ministers of February 3, 2010 No. 11 "About additional measures for improvement of nature protection activities in system of municipal services" (the joint venture of the Republic of Uzbekistan, 2010, No. 2, the Art. 4):

a) in Items 1 and 6 of the word of "legal entities and physical persons" shall be replaced with words "legal entities, and also physical persons";

b) in paragraph four of Item 3 of the word "from which 60 percent 40 percent are transferred into the republican budget," shall be replaced with words "from which 26 percent are transferred into the republican budget, 74 percent".

c) in appendix No. 1:

in paragraph five of Item 3 of the word of "legal entities and physical persons" shall be replaced with words "legal entities, and also physical persons";

The procedure for charge of compensation payments for above-standard dumpings of pollutants is determined by the Regulations on procedure for application of compensation payments for pollution of the surrounding environment and placement of waste in the territory of the Republic of Uzbekistan approved by the Cabinet of Ministers of the Republic of Uzbekistan taking into account the features provided by this Section";

in Item 30 to replace the word "Quarterly" with the word "Monthly";

state Item 34 in the following edition:

"34. In cases of emergence of disagreements between the water and sewer companies and their subscribers, the decision is relative on reliability of results of the made laboratory analyses determining high-quality composition of production sewage accepts Department of monitoring of environmental pollution of the territorial authorities of Goskomecology, except as specified, provided by the paragraph the second Item 27 of these rules where the final decision is made by the Center of specialized analytical control in the field of environmental protection under Goskomecology.

At the same time results of the monitoring tests which are carried out according to this Item of Rules are valid for calculations of compensation payments only for the period (month) during which samplings were made, and do not extend to previous period (month)";
