According to the Presidential decree of the Republic of Uzbekistan of April 11, 2018 the No. UP-5409 "About Measures for Further Reducing and Simplification of Licensed and Allowing Procedures in the field of Business Activity, and also to Improvement of Conditions of Business" Cabinet of Ministers decides:

1. Approve:

Regulations on licensing of activities for development, production, transportation, storage and realization of explosive and toxic agents, materials and products with their application, and also blasting agents according to appendix No. 1;

Regulations on licensing of activities in the field of turnover of sources of ionizing radiation according to appendix No. 2.

2. Determine that earlier granted licenses for the right of implementation of activities for development, production, transportation, storage and realization of explosive and toxic agents, materials and products with their application, and also blasting agents, activities in the field of turnover of sources of ionizing radiation and activities for production of precious and rare-earth metals, gemstones are effective before the expiration of their action.

3. Make changes and additions to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 4.

4. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 5.

5. To the state committee of industrial safety of the Republic of Uzbekistan together with other interested ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

6. To impose control over the implementation of this resolution on the deputy prime minister of the Republic of Uzbekistan A. S. Sultanov and the chief of GI "Sanoatgeokontekhnazorat" B. V. Gulyamov.

Regulations on procedure for licensing of activities for development, production, transportation, storage and realization of explosive and toxic agents, materials and products with their application, and also blasting agents

Chapter 1. General provisions

1. This Provision determines procedure for licensing of activities for development, production, transportation, storage and realization of explosive and toxic agents, materials and products with their application, and also blasting agents.

2. Action of this provision does not extend to activities for development, the arms production and ammunition, and also to use of toxic agents in the medical purposes.

3. Issue of licenses, suspension or cancellation of the license, and also cancellation and renewal of the license for the right of implementation of activities for development, production, transportation, storage and realization of explosive and toxic agents, materials and products with their application, and also blasting agents is performed by the State committee of industrial safety of the Republic of Uzbekistan (further - the licensing body).

4. The licensing body for consideration of questions of issue or refusal in licensing, cancellation or cancellations of the license forms interdepartmental expert group of number of specialists of the State committee of the Republic of Uzbekistan on ecology and environmental protection, the Ministries of Internal Affairs and the Ministries of Health of the Republic of Uzbekistan. The members of interdepartmental expert group affirm the licensing body.

For consideration of questions of issue or refusal in licensing, cancellation or cancellations of the license the licensing body has the right to involve also other experts for the purpose of preparation of the corresponding conclusions.

5. Activities for development, production, transportation, storage and realization of explosive and toxic agents, materials and products with their application, and also blasting agents according to the list according to appendix No. 1 to this Provision are subject to licensing.

6. The license is granted only to legal entities without restriction of effective period.

7. According to the statement of the license applicant the license can be issued in general by sight to activities or on its part.

Chapter 2. Licensed requirements and conditions

8. Licensed requirements and conditions when implementing activities for development, production, transportation, storage and realization of explosive and toxic agents, materials and products with their application, and also blasting agents are:

obligatory respect by the licensee of the legislation, state standards, rules of industrial safety, labor protection, nature protection and sanitary standards and requirements in the field of production, transportations, storages and realization of explosive and toxic agents, materials and products with their application;

ensuring reliable protection of objects on which explosive and toxic agents, materials and products with their application, and also blasting agents, maintenances of their transportation, acceptance of the regime and other measures directed to non-admission of unauthorized access to explosive and toxic agents are developed, made and stored;

accounting of availability and consumption of explosive and toxic agents, materials and products with their application, and also blasting agents in the part concerning the licensed type of activity;

availability of the necessary specifications and technical documentation regulating implementation by the license applicant of development, production, transportation, storage and realization of explosive and toxic agents, materials and products with their application and also blasting agents;

availability at the license applicant, belonging to it on the property right or on other corporeal right of material and technical resources (buildings, rooms, the territories, the equipment, the equipment, transport, control facilities and measurements, computing and office equipment), necessary for accomplishment of the licensed type of activity in full according to requirements of existing rules and rules;

availability in staff of the technicians of the corresponding qualification allowed to work with explosive and toxic agents according to requirements of regulations and rules, including the heads and engineering employees having the corresponding education and length of service at least one year on the types of activity specified in the license;

absence of the workers who are staying on the registry concerning chronic mental diseases, drug addiction, toxicomania, alcoholism, and also having the outstanding or not removed criminal record for the intentional crime connected using explosive and toxic agents;

performing regular medical examination of the workers who are directly performing the works connected with the licensed type of activity;

availability and content in operating state of the special means necessary for liquidation of the fire and leakage of toxic agents.

9. The specific licensed requirements and conditions specified in Item 8 of this provision can be provided in the license agreement.
