About approval of the Procedure for storage of documentary information and its transfer to the central zaveritelny body in case of the termination of activities of the skilled supplier of electronic confidential services

According to part twelve of article 31 of the Law of Ukraine "About electronic confidential services" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for storage of documentary information and its transfer to the central zaveritelny body in case of the termination of activities of the skilled supplier of electronic confidential services who is applied.

2. Recognize invalid:

the resolution of the Cabinet of Ministers of Ukraine of October 28, 2004 No. 1454 "About approval of the Procedure for obligatory transfer of documentary information" (The Official Bulletin of Ukraine, 2004, No. 44, the Art. 2896);

the resolution of the Cabinet of Ministers of Ukraine of November 2, 2011 No. 1122 "About modification of the Procedure for obligatory transfer of documentary information" (The Official Bulletin of Ukraine, 2011, No. 85, the Art. 3109).

3. This resolution becomes effective along with the Law of Ukraine "About electronic confidential services".

Procedure for storage of documentary information and its transfer to the central zaveritelny body in case of the termination of activities of the skilled supplier of electronic confidential services

1. This Procedure determines the transfer mechanism on storage to the central zaveritelny body of qualified digital signature certificates, electronic seal and check of authenticity of the website (further - certificates), documentary information the skilled supplier of electronic confidential services (further - the skilled supplier) in case of the termination of its activities for provision of qualified electronic confidential services, and also ensuring its transfer on archive storage.

2. In this Procedure terms are used in the value given in the Law of Ukraine "About electronic confidential services".

3. The skilled supplier who certified the public key in the central certifying body in case of the termination of provision of qualified electronic confidential services performs transfer of documentary information to the central zaveritelny body.

Documentary information - documents based on which qualified electronic confidential services were provided to users and were created, blocked, recovered the cancelled qualified certificates of public keys all the created qualified certificates of public keys, and also registers of the created qualified certificates of public keys.

Documentary information which is transferred to the central zaveritelny body consists of documents electronically and documents on paper:

documents electronically - agreements based on which the qualified electronic confidential services all the created qualified certificates of public keys, registers of the created qualified certificates of public keys, documents based on which the cancelled qualified certificates of public keys (if such method is provided by regulations of work of the skilled supplier of electronic confidential services), the certificate revocation list were created, blocked, recovered were provided to users;

documents on paper - agreements based on which qualified electronic confidential services, documents based on which the cancelled qualified certificates of public keys all the created qualified certificates of public keys, registers of the created qualified certificates of public keys, and also the copies of decisions (determinations) of the courts on indemnification caused owing to improper execution by the skilled supplier of the obligations certified in accordance with the established procedure were created, blocked, recovered were provided to users.

Documents are electronically transferred on two information mediums, at the same time agreements based on which the qualified electronic confidential services concluded electronically were provided to users register in the information medium separately from other documents electronically.

Documents on paper shall be stitched, on the back the last leaf the number of pages is specified and the signature of the head of the skilled supplier is appended.

Acceptance of documentary information and its storage is performed taking into account provisions of regulations of work of the central certifying body approved by Mintsifra's order of August 27, 2021 No. 115.

4. Registers of the created qualified certificates of public keys shall contain the following data:

mark that the certificate of public key is issued as the qualified certificate of public key;

identification data which unambiguously determine the skilled supplier who issued the qualified certificate of public key;

identification data which unambiguously determine the user of electronic confidential services;

data on the beginning and termination of effective period of the qualified certificate of public key;

serial number of the qualified certificate of public key, unique for subject which issued the certificate;

data that the personal key is stored in means of the qualified digital signature or seal (except personal keys for advanced digital signatures or seals which are based on qualified certificates of public keys);

date and start and end time of effective period of the qualified certificate of public key;

date, time and reason of canceling, blocking and recovery of the qualified certificate of public key.

5. Requirements to format of the created registers of qualified certificates of public keys, and also information mediums and procedure for record of documents on them are electronically established by the central zaveritelny body and published on own website.

6. Documentary information is transferred to the central zaveritelny body personally by the representative of the skilled supplier or the registered mail.

The representative of the skilled supplier during the appeal to the central zaveritelny body shall show the document proving his identity, and the power of attorney confirming its powers to act on behalf the skilled supplier under the organization and transfer of documentary information in the central zaveritelny body assured by the signature of the head/deputy manager of the skilled supplier.

7. The skilled supplier having intention to stop activities sends to the central zaveritelny body the termination letter of provision of qualified electronic confidential services.
