About approval of the Regulations on certified activities on rail transport of Ukraine

For the purpose of ensuring fulfillment of requirements of the Law of Ukraine "About transport", the Law of Ukraine "About rail transport" and the Decree of the Cabinet of Ministers of Ukraine "About standardization and certification" rather obligatory and voluntary certification on rail transport of PRIKAZYVAYU:

1. Approve Regulations on certified activities on rail transport of Ukraine it (is applied).

2. To head department of scientific and technical policy, industry and certification (Petrashevsky O. L.) and to Main department for legal services of activities of transport (Loginova L. M.) in accordance with the established procedure tax on registration in the Ministry of Justice of Ukraine Regulations on certified activities on rail transport of Ukraine.

3. Public administration of rail transport of Ukraine to bring to permission of all interested organizations Regulations on certified activities on rail transport of Ukraine.

4. To impose control over the implementation of this order on the First Deputy CEO of Ukrzheldortrans Fedyushin Yu. M.

Regulations on certified activities on rail transport of Ukraine

1. Field of use

1.1. This Provision establishes the basic principles, structure and rules of certified activities on rail transport of Ukraine.

1.2. Certified activities on rail transport of Ukraine are obligatory part of the procedure of reasons for possibility of implementation by subjects of business activity: transportations of passengers and freights by rail, servicing and repair of vehicles on rail transport.

1.3. Action of this Provision extends to bodies from certification of products, processes and services in industry of rail transport, (further - certification bodies), on domestic and foreign subjects of business activity who deliver products, provide services and perform other activities on rail transport of Ukraine.

3. Concepts, terms and their determinations

4. General provisions

4.1. Certified activities on rail transport of Ukraine provide examination and confirmation by the third party (certification body) of characteristics and properties of products, services and processes on rail transport of Ukraine and comprise such interconnected types of activity:

- certification of products, processes and services on rail transport of Ukraine;

- certification of productions at the companies which turn out products provide services or perform engineering procedures on rail transport of Ukraine.

4.2. The purpose of carrying out certified activities on rail transport of Ukraine is:

- providing conditions for protection of life and health of the person under time of implementation of transportations by railway transport;

- increase in potential safety of products, services and processes on rail transport;

- providing conditions of protection of the surrounding environment against adverse effects owing to use of products that is delivered to rail transport, provision of services when implementing processes on rail transport of Ukraine;

- confirmation of the guaranteed quality level and product competitiveness, services and processes both on internal, and on external the markets;

- requirements satisfaction of clients of rail transport, protection of their rights and interests during receipt of certain type of service by them;

- confirmation of opportunity to carry out business activity by subjects of business activity who turn out products provide services or perform the processes connected with transportation of passengers and freights by rail, servicing and repair of vehicles on rail transport.

4.3. The common directorship certified activities on rail transport of Ukraine, the organization and coordination of works from certification are performed by Gosstandart and the Ministry of transport of Ukraine.

4.4. Certification of products, services and processes on rail transport of Ukraine is carried out only by certification bodies of products which are created by the joint order of the Ministry of transport and Gosstandart of Ukraine and accredited in Sisteme UKRSEPRO, namely:

- Dnipropetrovsk certification body of rail transport (DOSZT);

- Kharkiv certification body of rail transport (HAROSZT);

- The Kharkiv certification body of the automated and automatic management systems and conditions of process of transportations on rail transport (UPP ZT ACS).

4.5. The list of products, services and processes which are subject to obligatory certification on rail transport of Ukraine is approved with the Ministry of transport of Ukraine and affirms Gosstandart of Ukraine.

5. Structure of activities

5.1. The organizational structure of certified activities on rail transport is formed:

- Gosstandart of Ukraine;

- Ministry of transport of Ukraine;

- certification bodies;

- test laboratories (centers);

- scientific and methodical and information center;
