According to article 14 of the Law of Ukraine "About access to public information", to the Presidential decree of Ukraine of May 5, 2011 No. 547 "Questions of ensuring with executive bodies of access to public information", to the resolution of the Cabinet of Ministers of Ukraine of January 17, 2018 No. 55 "Some questions of documentation of management activity", for the purpose of enhancement of the organization of access to public information the National commission performing state regulation in the sphere of the markets of financial services, POSTANOVILA:

1. Approve Regulations on providing the right of persons to access to public information in the National commission performing state regulation in the sphere of the markets of financial services which is applied.

2. Declare invalid the order of the National commission performing state regulation in the sphere of the markets of financial services of July 17, 2012 No. 594 "About approval of the Regulations on providing the right of persons to access to public information in the National commission performing the state regulation in the sphere of the markets of financial services" registered in the Ministry of Justice of Ukraine on August 8, 2012 for No. 1349/21661.

3. To provide to department of documentary providing and control together with Department of legal providing submission of this order to the Ministry of Justice of Ukraine for state registration.

4. And members of the commission to provide to management of ensuring activities of the Chairman publication of this order after its state registration.

5. This order becomes effective from the date of its official publication.

6. Control over the implementation of this order to leave for the Chairman Natskomfinuslug.

Regulations on providing the right of persons to access to public information in the National commission performing state regulation in the sphere of the markets of financial services

I. General provisions

1. This Provision determines procedure for access to public information which manager is Natskomfinuslug.

2. In this Provision terms are used in the values given in the Law of Ukraine "About access to public information".

3. Legal regulation of the relations connected with ensuring access to public information is performed according to the Laws of Ukraine "About access to public information" (further - the Law), "About information", "About personal data protection", "About the state secret", this Provision and other regulatory legal acts regulating the specified questions.

4. Action of this Provision does not extend to the relations on receipt of information by subjects of powers of authority when implementing of the functions by them, and also to the relations in the sphere of addresses of citizens.

5. Directs, the chief of staff Natskomfinuslug coordinates and controls work of structural divisions on provision of access to public information.

6. Observance of established procedure of provision of public information (processing, systematization, the analysis and control concerning satisfaction of request for information) about activities of Natskomfinuslug will be will organized and provided by heads of independent structural divisions.

7. The organization of work with passing of request in the automated system of electronic clerical work (further - EDMS of Natskomfinuslug), including obtaining, preliminary processing, registration, sending, systematization, transfer to archive of Natskomfinuslug (storage of temporary document storage) and consultation concerning procedure for creation and representation of requests for information, and also preparation and representation on promulgation of the report by satisfaction or refusal in satisfaction of requests for information, kinds of required information and other qualitative indexes concerning satisfaction of requests for information performs the structural division of Natskomfinuslug responsible for ensuring access to public information.

II. Ensuring access to public information in Natskomfinuslug

1. Access to public information to Natskomfinuslug is provided in the way:

1) systematic and operational promulgation of information:

on the official website of Natskomfinuslug;

on the single state web portal of open data;

at information stands;

by any other method;

2) provisions of information on requests for information.

2. Restriction of information access is performed according to part two of article 6 of the Law.

3. Promulgation and placement on the official website of Natskomfinuslug of the public information prepared and provided by structural divisions of Natskomfinuslug taking into account requirements of the Law and the Law of Ukraine "About personal data protection" are provided with the structural division responsible for promulgation of information on activities of Natskomfinuslug.

4. Are subject to promulgation on the official website of Natskomfinuslug (with indication of date of promulgation of the document and date of updating of information):

information of rather organizational structure, mission, functions, powers, main objectives, activities and financial resources (structure and amount of budgetary funds, procedure and mechanism of their expenditure, etc.);

regulatory legal acts, acts of individual action (except internally - organizational) adopted by Natskomfinuslug, drafts of the decisions which are subject to discussion, information concerning the normative legal basis of activities;
