About approval of the Regulations on procedure for forming, storage and destruction of the isolated electronic data obtained by results of work of information systems in the National Bank of Ukraine and banks of Ukraine

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", article 66 of the Law of Ukraine "About banks and banking activity", for the purpose of enhancement of regulatory legal acts in the sphere of ensuring continued, reliable operation of payment and accounting systems, systems of automation of banking activity the Board of the National Bank of Ukraine decides:

1. Approve Regulations on procedure for forming, storage and destruction of the isolated electronic data obtained by results of work of information systems in the National Bank of Ukraine and banks of Ukraine which is applied.

2. Recognize invalid:

1) the resolution of Board of the National Bank of Ukraine of September 12, 2006 No. 357 "About approval of the Regulations on procedure for forming, storage and destruction of electronic archives in the National Bank of Ukraine and banks of Ukraine", registered in the Ministry of Justice of Ukraine on October 03, 2006 for No. 1089/12963;

2) subitem 1.25 of Item 1 of the resolution of Board of the National Bank of Ukraine of October 08, 2010 No. 457 "About modification of some regulatory legal acts of the National Bank of Ukraine", No. 1249/18544 registered in the Ministry of Justice of Ukraine on December 13, 2010.

3. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine of Cold S. V.

4. The resolution becomes effective from the date of, its official publication following behind day.

Regulations on procedure for forming, storage and destruction of the isolated electronic data obtained by results of work of information systems in the National Bank of Ukraine and banks of Ukraine

I. General provisions

1. This Provision is developed according to the Law of Ukraine "About the National Bank of Ukraine" and establishes general procedure for forming, accounting, use, storage and destruction of the isolated electronic data obtained by results of work of information system in the National Bank of Ukraine (further - National Bank) and banks (further - bank).

Requirements of this provision do not extend much forming, storages and destructions of the electronic documents created by National Bank and banks. The procedure for forming, storage and destruction of the electronic documents created by National Bank and banks is determined by the laws of Ukraine, regulatory legal acts of National Bank in the sphere of clerical work and archiving.

2. In this Provision terms are used in such value:

1) bank - bank, its branch, representation, department;

2) the isolated electronic data obtained by results of work of information system (further - OED) - separated computing process in which they are created electronic data in invariable type. The purpose of preserving OED is further receipt of information from them in case of need;

3) electronic data - any information electronically;

4) information system (further - IS) - complex of software and hardware which is used for automation of activities of National Bank and/or banks;

5) invariable type of data - data presentation form which allows to check their identity through integrity checking.

3. Other terms in this Provision are used in the values established by the laws and regulatory legal acts of Ukraine.

4. National bank / banks draft own administrative acts / internal documents concerning storage precautions of OED taking into account intra banking technology of processing of electronic data based on this provision, specifics of activities, the technical characteristics and software functioning in it.

II. General rules of forming of OED

5. The structure and content of OED are determined by technology of work of IS and:

1) internal documents of banks - for banks;

2) administrative acts of National Bank - for National Bank.

6. Methodical maintenance concerning forming of OED is performed by IS developers or divisions of National bank / banks which accompany work of IS. The procedure of integrity checking of OED is determined by the owner of information and is implemented by IS developers or divisions of National bank / banks which accompany work of the specified IS by provision to the divisions performing operation of the specified IS and provide storage of OED of appropriate means of check of identity of data.

7. Forming of OED in invariable type for further storage is carried out by the divisions of National bank / banks performing operation of the specified IS.

8. Documentation, technical maintenance of process of record/recovery of OED on electronic media, storages and issues of OED in National Bank are assigned to the relevant department as a part of division of information technologies, and in banks - to structural division (department, management, department, the sector), information support (information technologies) or the information technology specialist to whom accomplishment of functions of structural division of information support is assigned (further - Service of information support).

9. OED are stored on electronic media.

10. National bank / banks shall provide information security with limited access at all stages of forming, processing, storage and destruction of OED.

III. Operating procedure with OED

11. Divisions of National bank / banks performing operation of IS create OED for the subsequent transfer of information support to Service.

12. The service of information support performs the following operations on obtaining, storage, issue and destruction of OED:

1) is received by OED after their forming in invariable type for the subsequent record on electronic media. OED are considered received for the subsequent record on electronic media after successful integrity checking;

2) records OED received according to the subitem 1 of Item 12 of the Section III of this provision with electronic media for further storage. OED are considered recorded with electronic media for further storage after accomplishment of the procedure of recovery from electronic media and successful integrity checking of the recovered data;
