About the rights of persons with disability

This Law according to Item 1 of part 1 of article 94 of the Constitution of the Azerbaijan Republic determines bases of state policy concerning persons with disability and determines tasks of the state in the field of protection of their rights, regulates elimination of the risks promoting disability, liquidation of all forms of discrimination on the basis of disability, rehabilitation of persons with disability, their full participation in life of society and creation of conditions for their social integration, active participation in decision making on the strategy and programs concerning them, complete and equal enjoyment of the rights and freedoms of persons with disability and also the relations arising in the sphere of protection of their honor and advantage.

Chapter 1. General provisions

Article 1. Basic concepts

1.0. The determinations used in this Law have the following values:

1.0.1. disability - availability of the steady physical, mental, intellectual or touch violations which are not allowing person completely and effectively to participate in life of society on an equal basis with others in case of collision with various obstacles;

1.0.2. person with disability - person with the steady physical, mental, intellectual or touch violations which are not allowing to participate completely and effectively in life of society on an equal basis with others in case of collision with various obstacles;

1.0.3. discrimination on disability - any distinction, exception or restriction on the disability reason, including refusal in reasonable adaptation according to this Law;

1.0.4. "reasonable adaptation" - introduction in each case of necessary and suitable modifications and amendments for the purpose of ensuring realization or implementation by persons with disability on an equal basis with others of basic rights and human freedoms;

1.0.5. the prevention of disability - implementation of system of the measures providing early diagnostics of disability, and also measure for health protection, improvement of ecological state of environment, providing healthy lifestyle and safe working conditions, to prevention of industrial injuries, spread of occupational diseases;

1.0.6. rehabilitation of persons with disability - complete or partial recovery of independence, physical, intellectual, household, social and professional and labor capability of persons with disability by means of system of the medical, psychological, pedagogical, sports, social and economic and other measures directed to liquidation or compensation of disability;

1.0.7. medical rehabilitation - system of the medical measures directed to recovery and compensation congenital or resulted after disease or injury of violations of functions of organism;

1.0.8. employment rehabilitation - system of the measures directed to recovery of the weakened or lost function of person with disability or its adaptation to new profession for the purpose of the professional choice or return of working capacity in new profession;

1.0.9. development of social skills - system of the measures providing to persons with disability assimilation of social skills, creation of opportunities for them to participate in life of society on an equal basis with others;

1.0.10. psychology and pedagogical rehabilitation - system of the measures directed to obtaining by person with disability of the inclusive or integrated education with use of various training methods according to feature of disability, recovery of capability to communication, self-service and control over the behavior;

1.0.11. the abilitation - as much as possible to use the available potential of the person with disabilities, and also to increase opportunities for free accommodation by training in skills which the person with disabilities does not have;

1.0.12. availability to persons with disability - compliance of work, education, health care and other social environment, public, transport and commercial infrastructure to features of persons with disability;
