About approval of criteria by which the risk degree from implementation of economic activity is estimated and frequency of implementation of planned actions of the state supervision (control) in the field of technogenic and fire safety by Public service is determined by emergency situations

According to part two of article 5 of the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve criteria by which the risk degree from implementation of economic activity is estimated and frequency of implementation of planned actions of the state supervision (control) in the field of technogenic and fire safety by Public service is determined by emergency situations which are applied.

2. Declare invalid the resolution of the Cabinet of Ministers of Ukraine of December 27, 2017 No. 1043 "About approval of criteria by which the risk degree from implementation of economic activity is estimated and frequency of implementation of planned actions of the state supervision (control) in the field of technogenic and fire safety is determined by Public service of emergency situations" (The Official Bulletin of Ukraine, 2018, No. 3, the Art. 128).

Criteria by which the risk degree from implementation of economic activity is estimated and frequency of implementation of planned actions of the state supervision (control) in the field of technogenic and fire safety by Public service is determined by emergency situations

1. Treat criteria by which the risk degree from implementation of economic activity in the field of technogenic and fire safety is estimated:

object type (the room, the building, construction, the house, the territory) which belongs to the subject of managing on the property rights, ownerships, uses (further - object);

area of the object;

the maximum settlement (project) number of people who constantly or periodically are on object;

conditional height of object (height which is determined by difference of marks of the lowest level of journey (installation) of fire autoladders (car lifts) and floor of upper floor without the upper technical floors if on technical floors are placed only engineering the equipment and communication of the house);

availability and scale of dangerous events, the emergency situations which happened on object within the last five years preceding planning period;

class of effects (responsibility) during asset construction;

the number of the violations of the requirements of the legislation in the field of technogenic and fire safety connected with operation or during asset construction and found within the last five years preceding planning period.

2. Risks of approach of negative effects from implementation of economic activity in the field of technogenic and fire safety are determined in appendix 1.

3. The exhaustive list of criteria by which the risk degree from implementation of economic activity in the field of technogenic and fire safety is estimated, their indicators and the number of points is determined by each indicator in appendix 2.

4. Reference of the subject of managing to high, average or insignificant risk degree is performed taking into account score, added by all criteria determined in appendix 2, by the following scale:

from 41 to 100 points - high;

from 21 to 40 points - average;

from 0 to 20 points - insignificant.

If the subject of managing possesses on the property right, ownerships or uses more than one object, the number of points is charged by all criteria determined in appendix 2, separately by each object.

Concerning objects under construction, score is charged only by criteria 5 - 7, determined in appendix 2.

The subject of managing to which belongs on the property right of ownership or uses more than one object, belongs to risk degree on those from its objects in which the greatest number of points is added.

5. Planned actions of the state supervision (control) in the field of technogenic and fire safety are performed behind activities of subjects of managing with such frequency:

with high risk - is not more often than once in two years;

with average risk degree - is not more often than once in three years;

with insignificant risk degree - is not more often than once in five years.

If the subject of managing possesses on the property right, ownerships or uses more than one object, check of the subject of managing is performed with frequency which depends on score, added separately on each object.

6. If by results of the last planned action of the state supervision (control) of the subject of managing fundamental breaches of requirements of the legislation in the field of technogenic and fire safety are not revealed, the following scheduled inspection of such subject of managing is carried out not earlier than through the period established for the corresponding risk degree doubled. This provision is not applied to the subjects of managing carried to high risk.
