About approval of the Regulations on licensing of separate types of activity in the field of road and water transport of the Kyrgyz Republic

For the purpose of settlement of activities in the field of road and water transport, according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve Regulations on licensing of separate types of activity in the field of road and water transport of the Kyrgyz Republic according to appendix.

2. Bring in the Order of the Government of the Kyrgyz Republic "About licensing of separate types of activity" of May 31, 2001 No. 260 the following change:

in Regulations on the licensing of separate types of activity approved by the above-stated Resolution:

- recognize Chapter 41 invalid.

3. To the Ministry of Transport and Roads of the Kyrgyz Republic in two-month time to bring the decisions into accord with this Resolution.

4. This Resolution becomes effective after fifteen days from the date of official publication.

5. To impose control of execution of this Resolution on department of construction, transport and communications of Government office of the Kyrgyz Republic.

Regulations on licensing of separate types of activity in the field of road and water transport of the Kyrgyz Republic

Chapter 1. General provisions

1. This Regulations on licensing of separate types of activity in the field of road and water transport of the Kyrgyz Republic (further - the Provision) are developed for the purpose of realization of the provisions of the law of the Kyrgyz Republic "About licensed authorization system in the Kyrgyz Republic" and regulate procedure for issue, prolongation, renewal, suspension, renewal and cancellation of licenses in the field of road and water transport of the Kyrgyz Republic (further - the license) authorized state bodies:

- in the field of transport - the state body designed to exercise regulation and control of activities of subjects in the field of passenger traffic on road transport and also the state control and licensing of activities in the field of freight transportation by road transport in the international directions;

- in the field of safety of traffic by the state body designed to exercise the state control and licensing of activities in the field of transportations of passengers by road transport.

2. The physical persons and legal entities irrespective of legal forms and patterns of ownership which showed willingness to be engaged in the licensed type of activity in the field of road and water transport shall obtain the corresponding license according to the procedure, established by the Law of the Kyrgyz Republic "About licensed authorization system in the Kyrgyz Republic" and this Provision.

3. The authorized state body in the field of regulation and control of activities on road transport and regulations of activities on water transport and its relevant territorial subdivisions (further - the licensor) grants licenses for the following types of activity:

1) international freight and passenger traffic by road transport;

2) passenger and (or) freight transportation by water transport.

The authorized state body in the field of safety of traffic and its relevant territorial subdivisions (further - the licensor) grants licenses for activities for passenger traffic by road transport (except for automobile taxi).

4. Licensed territory: in all territory of the Kyrgyz Republic, and also beyond its limits based on international treaties.

Chapter 2. Subjects of licensing of activities in the field of road and water transport

5. Subjects of licensing are:

1) licensors:

- authorized state body in the field of regulation and control of activities on road transport and regulations of activities on water transport and its relevant territorial subdivisions;

- authorized state body in the field of safety of traffic and its relevant territorial subdivisions;

2) the licensee - the physical person or legal entity which obtained the license;

3) the applicant - legal entity or physical person, licenses which filed to the licensor petition for provision.

Chapter 3. Documents necessary for receipt of the license

6. For receipt of the license the applicant submits to the licensor the application containing the following data:

- the complete and (or) reduced trade name and form of business of the legal entity, certificate number about state registration - for the legal entity;

- surname, name and middle name - for physical person;

- contact telephone number and the e-mail address to which the licensor performs correspondence for the direction of decisions, notifications, notifications;

- the list of services which the applicant intends to perform on the licensed type of activity.

The following documents are enclosed to the application:

- the copy of the identity document, and the copy of the certificate on state registration - for physical person;

- copies of the certificate on state registration and the charter - for the legal entity;
