About approval of the Order of interaction of the subjects performing actions in the sphere of prevention and counteraction to domestic violence and violence on the basis of sex

According to Article part three 8, "About prevention and counteraction to domestic violence" and parts two of article 21-7 of the Law of Ukraine "About providing the equal rights and opportunities of women and men" the Cabinet of Ministers of Ukraine decides parts three of article 15 of the Law of Ukraine:

1. Approve the Order of interaction of the subjects performing actions in the sphere of prevention and counteraction to domestic violence and violence on the basis of sex which is applied.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

3. To the ministries, another central and to local executive bodies to bring in three-months time own regulatory legal acts into accord with this resolution.

Order of interaction of the subjects performing actions in the sphere of prevention and counteraction to domestic violence and violence on the basis of sex

General part

1. This Procedure determines the mechanism of interaction of the subjects performing actions in the sphere of the prevention and counteraction to domestic violence and violence on the basis of sex (further - subjects) aimed at providing integrated integrated approach to overcoming violence and assistance of realization of the rights of persons which were affected by violence (further - injured persons), by prevention of violence, effective response to the facts of violence, assistance and protection to injured persons, ensuring compensation of the caused damage, proper investigation of the facts of violence and involvement of offenders to the responsibility provided by the law.

2. In this Procedure terms are used in the value given in the Laws of Ukraine "About prevention and counteraction to domestic violence", "About providing the equal rights and opportunities of women and men" and "About social services".

3. Activities of subjects are directed to prevention and counteraction to violence and are based on the following principles:

guaranteeing to injured persons of safety and fundamental rights and freedoms of man and citizen, in particular the rights to life, freedom and security of person, to respect of private and family life, to fair trial, to legal assistance, taking into account practice of the European Court of Human Rights;

due attention to the violence fact during implementation of actions in the sphere of prevention and counteraction to domestic violence and violence on the basis of sex;

accounting of disproportionate influence of violence on women and men, children and adults, respect for the principle of providing the equal rights and opportunities of women and men during implementation of actions in the sphere of prevention and counteraction to domestic violence and violence on the basis of sex;

recognitions of public danger of violence and providing the intolerant relation to any its manifestations;

respect and the impartial, attentive attitude towards injured persons from subjects, ensuring priority of the rights, legitimate interests and safety of the injured persons when implementing actions in the sphere of prevention and counteraction to domestic violence and violence on the basis of sex;

confidentiality of information on victims and persons who reported about violence making;

voluntariness of receipt of the help by injured persons, except children and incapacitated persons;

accounting of special needs and interests of injured persons, in particular persons with disability, expectant mothers, children, incapacitated persons, elderly people;

effective interaction of subjects with public associations, the international organizations, mass media, other interested legal entities and physical persons;

non-admissions of discrimination on any sign in case of implementation of actions in the sphere of prevention and counteraction to domestic violence and violence on the basis of sex.

4. The mechanism of interaction of subjects is aimed at providing effective and practical realization of the rights of the injured persons determined by the Laws of Ukraine "About prevention and counteraction to domestic violence", "About providing the equal rights and opportunities of women and men".

5. Injured person has the right on:

efficient, effective and urgent protection in all cases of violence, non-admission of repeated cases of violence;

the address personally or through the representative to subjects;

obtaining from subjects of complete and exhaustive information about their rights, social services, medical, public, psychological assistance which it can use;

free obtaining according to the legislation of social services, medical, public and psychological assistance according to his requirements;

free legal assistance according to the procedure, established by the Law of Ukraine "About free legal assistance";

respect for honor and advantage, the attentive and humane relation from subjects;

maintaining confidentiality of information of personal nature which became known to subjects in operating time with injured person, and personal data protection;

the choice of the specialist depending on floor (whenever possible);

compensation by offenders of the caused loss of property and the harm done to physical and mental health, according to the procedure, determined by the legislation;

the appeal to law enforcement agencies and court for the purpose of involvement of offenders to responsibility, application to them special measures concerning counteraction to violence;

timely receipt of information of rather final decisions of court and proceeding decisions of the law enforcement agencies connected with consideration of the fact of making of violence against it, including connected with isolation of the offender or his dismissal;

other rights, stipulated by the legislation in the sphere of prevention and counteraction to domestic violence and violence on the basis of sex, and also international treaties which consent to be bound is provided by the Verkhovna Rada of Ukraine.

6. Action of this Procedure extends to the subjects determined by article 6 of the Law of Ukraine "About prevention and counteraction to domestic violence" and article 7-1 of the Law of Ukraine "About providing the equal rights and opportunities of women and men" (except citizens of Ukraine, foreigners and the stateless persons which are in Ukraine on legal causes).

7. Interaction of subjects is coordinated:

at the nation-wide level - Minsotspolitiki;

at the regional level - Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city state administrations;
