ORDER OF THE MINISTER OF INVESTMENTS AND DEVELOPMENT OF THE REPUBLIC OF KAZAKHSTAN

About approval of Storage precautions and accounting by subsoil users of geological information and its carriers received as a result of carrying out transactions on subsurface use

According to part one of item 4 of article 75 of the Code of the Republic of Kazakhstan of December 27, 2017 "About subsoil and subsurface use" I ORDER:

1. Approve the enclosed Storage precautions and accounting by subsoil users of geological information and its carriers received as a result of carrying out transactions on subsurface use.

2. To provide to committee of geology and subsurface use of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan after its official publication;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

5. This order becomes effective since June 29, 2018 and is subject to official publication.

Storage precautions and accounting by subsoil users of geological information and its carriers received as a result of carrying out transaction on subsurface use

Chapter 1. General provisions

1. These rules of storage and accounting by subsoil users of geological information and its carriers received as a result of carrying out transaction on subsurface use (further - Rules) are developed according to part one of item 4 of article 75 of the Code of the Republic of Kazakhstan of December 27, 2017 "About subsoil and subsurface use" (further - the Code) and determine procedure for storage and accounting by subsoil users of geological information and its carriers received as a result of carrying out transaction on subsurface use.

Geological information includes two main types: primary and secondary.

Treat primary geological information:

information on natural carriers (cores of boreholes, tests of minerals, carbon dioxide, mercaptans, waters, examples of breeds and minerals, tests and collections of stone material, shlifa, anshlifa, mineral solutions and powders);

information on artificial (paper and electronic) carriers (magazines of field observations, approbations, analyses of tests, registration of geophysical observations, paper and electronic media primary field yielded and results of processing, interpretation, the analysis and generalization of geological information).

Geological reports, reports on results of exploration works, valuation reports of resources and inventories of minerals, and also information obtained as a result of processing, the analysis and generalization of primary information belong to secondary geological information.

2. The geological information obtained at the expense of means of the subsoil user is in private property (private geological information).

Private geological information according to Item 2 of article 91 of the Code is subject to voluntary conveyance in use to authorized body on studying of subsoil within a month from the date of the termination of term of the license.

Chapter 2. Procedure for storage by subsoil users of geological information and its carriers received as a result of carrying out transaction on subsurface use

3. The subsoil user according to part one of item 4 of article 75 of the Code ensures safety of the geological materials received by it as a result of the carried-out works and also easy access to them to representatives of authorized body on studying of subsoil for research or check. The subsoil user in case of delivery of geological reports on storage in geological funds, puts to the report the inventory of primary materials and actual documentary materials (shlif, pictures, maps, magazines and other materials).

According to part two of Item 5 of article 75 of the Code in three months prior to the expected termination of transactions on subsurface use on the respective subsoil plot the subsoil user in writing notifies authorized body on studying of subsoil on the magazines of field observations which are available for it, approbations, analyses of tests, registration of geophysical observations, paper and electronic media of primary field data of geological information or cores of boreholes.

Within a month after receipt of such notification the authorized body on studying of subsoil can request in writing from the subsoil user of voluntary conveyance to it in property of the specified carriers of geological information. This query is solved within a month from the date of its obtaining.

4. The storage unit of geological information represents the separate indivisible document, or set of the documents fastened or combined in sense or in separate unit of geological information / collection.

5. All geological materials on electronic media are stored in information system. Storage is one of the main transactions performed over geological information.

In case of lack of possibility of implementation of storage of private geological information on electronic media in information system, the subsoil user can use services of other organizations, including service of the National operator in collection, storage, processing and provision of geological information (further - the Operator).

The operator provides in use on paid basis disk space in the information system "National Bank of Data on Subsoil" (No. DH-14-0000067 and in the State register of information resources of July 8, 2014 No. KZ-P-14-0000029) for storage of private geological information of subsoil users on electronic media, and also technical infrastructure for support of needs of subsoil users is registered in Depositary of software products, program codes and the specifications and technical documentation of July 1, 2014.

The information system "National Bank of Data on Subsoil" is used before creation and implementation of the information system "National Bank of These Mineral Resources of the Republic of Kazakhstan" according to article 39 of the Law of the Republic of Kazakhstan of November 24, 2015 "About informatization".

6. Storage of magnetic carriers of geological information is performed at temperature from 8 °C to 20 °C over zero and in case of relative humidity from 20% to 65%. Non-compliance with the storage condition is led to losses of geological information.

7. The core which is washed out and cleared of the stuck breed and blocking (the core of friable or soluble breeds carefully without washing is cleared of pollution) develops in special core boxes.

8. Core boxes are produced taking into account reliable storage conditions and transportation of core. They are made of tree, or of other dense materials, the sizes of 1 meter on length and 0,5-0,6 of meters on width and shall have levels on the face parties of box for convenience and safety of transfer. Height of walls and the number of departments in boxes are made according to diameter of the stacked core.

9. Stacking of core is made from left to right in each department of core box. From above on edge of walls and longitudinal partitions the shooters specifying procedure for stacking of core are put from left to right.

10. It is necessary to stack core in boxes always densely without intervals separate pieces, in strict accordance with arrangement of pieces on well section. Pieces of the broken core are combined when stacking on the split planes. Small pieces of core which exact location in intervals is not established are wrapped in dense brown paper (or polyethylene film) and put in the upper part of interval. Samples of the destroyed or loose core are located in polyethylene (or dense made of cloth) sacks and in the same order keep within departments of core boxes. The core of quickly disappearing or decaying types of minerals is stored in special conditions (in special capsules or hermetic vessels).

In case of selection of small products of drilling (slime, dregs) the last are packed into the polyethylene sacks corresponding to the sizes of departments of core boxes and are laid at the end of the corresponding interval.

11. At the end of each interval corresponding to one boring flight on which the core is lifted the wooden label which is precisely answering to the size of departments of box and separating core of the next intervals is established. On label the simple pencil accurately writes out interval of depth and date of interval in meters to within meter 0,01.

12. The boxes filled and filled with core are closed by dense covers and stored in the dry and warm room. Covers of the boxes filled with core before transportation are hammered with nails. On cover and end face of each box indelible paint puts the following data: the name of the site, the organization making drilling; number of well, number of box, extraction depth; year of works.

The boxes filled with core are exported in kernokhranilishche for detailed geological processing of core and transferred to the worker responsible for kernokhranilishche, with registration of transfer in the register.

For the wells remote from bases of batches and sites, located in hardly accessible under the terms of communication, the core remains on boring before the end of drilling and is exported in case of communication establishment.

13. In case of lack of opportunity of ensuring storage of the geological information which is had as a result of the carried-out works, the subsoil user can use services of others of the organization.

Chapter 3. Accounting treatment subsoil users of geological information and its carriers received as a result of carrying out transaction on subsurface use

14. For accounting it is recorded the geological materials received as a result of field works in stock record books.

15. Accounting of primary geological information is performed in the stock record book of accounting of geological materials in form according to appendix to these rules.

16. Primary geological materials presented in the form of primary geological documentation on paper and electronic media geological collections, material carriers and the medicines made of them (all materials received during field and cameral works) are subject to accounting.

17. Material accounting of primary geological documentation and geological collections is conducted in separate stock record books.

According to entry in the stock record book of accounting of geological materials, separate accession number is assigned to each geological material.

18. For the purpose of timely release кернохранилищ from the core which lost the appointment inventory count of kernokhranilishch of the subsoil user, by results of which the subsoil user represents to territorial subdivision of authorized body on studying of subsoil (further - territorial subdivision), of the offer on liquidation of the core which lost the appointment is annually made.

19. The basis for liquidation of core is the corresponding reply of territorial subdivision to the offer on liquidation of the core which lost the appointment.

20. Proper accounting of geological information and liquidation of core is provided with the subsoil user.
