1. Approve the enclosed Rules of approval of temporary decreasing coefficients to rates (the prices, rates of charges) for regulated transportation services of natural gas on the bulk and (or) distribution pipelines.

2. On regulation and control in the field of pipeline and water sewer systems of the Agency on regulation of natural monopolies and protection of the competition (Duplyakov O. P.) to provide to department in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan.

3. To department of administrative and territorial work of the Agency of the Republic of Kazakhstan on regulation of natural monopolies and protection of the competition (Tokareva M. A.) after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan:

To provide 1) in accordance with the established procedure its publication in official mass media;

2) to bring it to the attention of structural divisions and territorial authorities of the Agency of the Republic of Kazakhstan on regulation of natural monopolies and protection of the competition.

4. I reserve control of execution of this order.

5. This order becomes effective from the date of its publication.

1. General provisions

1. Rules of approval of temporary decreasing coefficients to rates (the prices, rates of charges) for regulated transportation services of natural gas on the bulk and (or) distribution pipelines (further - Rules) are developed according to the Law of the Republic of Kazakhstan "About natural monopolies and the controlled markets" and other regulatory legal acts of the Republic of Kazakhstan.

2. Rules determine approval procedure of temporary decreasing coefficient to rates (the prices, rates of charges) for regulated transportation services of natural gas by the bulk and (or) distribution pipelines.

3. In Rules the following concepts are applied:

temporary decreasing coefficient - the size established by authorized body and applied to rate (the price, rate of charge) for the purpose of protection of consumer interests and the subject of natural monopoly;

the repayment schedule - the repayment schedule of overdue accounts payable of the consumer before the pipeline organization certified by signatures of the consumer and head of the pipeline organization;

competent authority - the ministry or department, local executive bodies - in case the subject of natural monopoly is in utility property;

the consumer - the physical person or legal entity using or intending to use regulated services (goods, works) of subjects of natural monopoly and the controlled market;

overdue accounts payable - the amount of financial liabilities, unexecuted at the scheduled time according to the agreement, money debts of the consumer before the pipeline organization;

the pipeline organization - the subject of natural monopoly rendering regulated transportation services of natural gas on the bulk and (or) distribution pipelines;

authorized body - the state body performing management in spheres of natural monopolies and in the controlled markets.

Other concepts and terms used in these rules are applied according to the current legislation of the Republic of Kazakhstan about natural monopolies and the controlled markets.

2. The principles of approval of temporary decreasing coefficients to rates (the prices, rates of charges) for regulated transportation services of natural gas on the bulk and (or) distribution pipelines

4. Temporary decreasing coefficients are established on the basis of calculation of cost efficiency and feasibility of this measure for the state, the pipeline organization and the consumer.

Cost efficiency of approval of temporary decreasing coefficient is determined by increase in amount of the rendered regulated services, the gained income of the pipeline organization and the consumer, growth of employment of the population and receipts in the government budget.

5. Income gained by the pipeline organization when rendering regulated services using temporary decreasing coefficients shall cover the cost necessary for rendering regulated transportation services of natural gas on the bulk and (or) distribution pipelines.

6. Temporary decreasing coefficients become effective from the first for certain period, but no more than for one calendar year.

7. Approval of temporary decreasing coefficient is made by authorized body according to the request of the consumer, initiative of competent authority and pipeline organization.

8. Approval of temporary decreasing coefficient is made on condition of 100 percentage payment by the consumer of the current obligations, lack of accounts payable before the pipeline organization or in case of accounts payable repayment provision according to the repayment schedule.

9. Feasibility of approval of temporary decreasing coefficients on regulated transportation services of natural gas is determined by the bulk and (or) distribution pipelines in case of compliance to one of the following criteria:

1) the planned amount of consumption of regulated transportation services of natural gas on the bulk and (or) distribution pipelines specified in the request for certain period exceeds the actual amount of consumption of regulated services for the same period of previous year;

2) possibility of using of the uninvolved and poorly involved sites of the bulk and (or) distribution pipelines.
