Financial provision of payment commitments on provision of lump social sum payment for acquisition or construction of premises to the prosecutors and persons specified in Item 17 of article 44.1 of the Federal law "About Prosecutor's Office of the Russian Federation" is performed within the budgetary appropriations provided to the Prosecutor General's Office of the Russian Federation in the federal budget on the answering purpose.

These rules establish procedure of payments of the amount of lump social sum payment for acquisition or construction of premises (further - lump social sum payment) and its transfers to the prosecutors and persons specified in Item 17 of article 44.1 of the Federal law "About Prosecutor's Office of the Russian Federation" (further respectively - the Federal Law, citizens, prosecutors).

2. The amount of lump social sum payment (V) is calculated on the date of decision making about its provision on formula:

With - the indicator of average market value of 1 sq.m of total area of housing approved quarterly by the Ministry of Construction and Housing and Communal Services of the Russian Federation concerning the subject of the Russian Federation on the duty station (on the last duty station) the prosecutor;

KP - the correction coefficient of the extent of average market value of 1 sq.m of total area of housing approved annually by the Ministry of Labour and Social Protection of the Russian Federation according to the order of the Government of the Russian Federation of January 27, 2009 No. 63 "About provision by the federal government civil servant of one-time subsidy for acquisition of premises" concerning the subject of the Russian Federation on the duty station (on the last duty station) the prosecutor;

Ks - the correction coefficient of the amount of the provided lump social sum payment determined according to item 4 of these rules.

3. Total area of premises (O) is determined by formula:

N - the total area of premises determined proceeding from regulation of provision of the area of premises, stipulated in Item 7th article 44.1 of the Federal Law;

Д - the additional area of premises determined for the prosecutor based on Item 8 of article 44.1 of the Federal Law for the citizen - in accordance with the legislation of the Russian Federation. In the presence of the right to the additional area of premises on several bases the size of such area is not summed up;

L - total total area of the premises occupied by the prosecutor (citizen) and (or) members of his family under agreements of social hiring, employment contracts of premises of housing stock of social use and (or) belonging to them on the property right, except for total area of the premises specified in subitems "v", "g" and "e" of item 4 of article 44.1 of the Federal Law.

4. Correction coefficients of the amount of lump social sum payment are determined taking into account service length in bodies and the organizations of prosecutor's office of the Russian Federation on positions of prosecutors, employees of the scientific and educational organizations on which assignment of class ranks is provided (further - service length), and make:

a) in the presence of service length from 11 to 12 years - 1,05;

b) in the presence of service length from 12 to 13 years - 1,1;

c) in the presence of service length from 13 to 14 years - 1,15;

d) in the presence of service length from 14 to 15 years - 1,2;

e) in the presence of service length from 15 to 21 years - 1,25;

e) in the presence of service length from 21 to 22 years - 1,3;

g) in the presence of service length from 22 to 23 years - 1,35;

h) in the presence of service length from 23 to 24 years - 1,4;

i) in the presence of service length from 24 to 25 years - 1,45;

j) in the presence of service length of 25 years and more - 1,5.

5. When calculating lump social sum payment:

a) the correction coefficient 1, in other cases - correction coefficients, stipulated in Item 4 these rules is applied to persons specified in the subitem "b" of Item 17 of article 44.1 of the Federal Law if the service length of the died (died) prosecutor constitutes less than 11 years;

b) the correction coefficient 1, in other cases - correction coefficients, stipulated in Item 4 these rules is applied to the persons specified in the subitem "v" of Item 17 of article 44.1 of the Federal Law, having service length less than 11 years.
