2. To provide to department of technology and innovative development of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this joint order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this joint order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

4) within ten working days after state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2) and 3) this Item.

3. To impose control of execution of this joint order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This joint order becomes effective since June 29, 2018 and is subject to official publication.

Chapter 1. General provisions

1. These rules of financing of research, scientific and technical and (or) developmental works in the amount of one percent from the expenses on production incurred by the subsoil user in previous year (further - Rules) are developed according to the subitem 2) of Item 1 of article 212 of the Code of the Republic of Kazakhstan "About subsoil and subsurface use" (further - the Code), the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" and determine procedure for financing of research, scientific and technical and (or) developmental works in the amount of one percent from the expenses on production incurred by the subsoil user in previous year.

2. These rules it is not applied to procedure for reference on deductions of expenses on research, scientific and technical and developmental works according to the tax legislation of the Republic of Kazakhstan.

3. In these rules the following concepts are used:

3) research work - the work connected with scientific search, carrying out researches, experiments for the purpose of expansion available and receipts of new knowledge, checks of scientific hypotheses, establishments of patterns of development of the nature and society, scientific generalization, scientific reasons for projects;

4) scientific research - the applied, basic, strategic scientific research performed by subjects of scientific and (or) scientific and technical activities within research, developmental and technological works, proper scientific methods and means for the purpose of achievement of results of scientific and (or) scientific and technical activities;

5) scientific activities - the activities directed to studying of surrounding reality for the purpose of detection of the properties, features and patterns inherent in the studied objects, the phenomena (processes) and use of the gained knowledge in practice;

6) scientific and technical activities - the activities directed to obtaining and use of new knowledge in all fields of science, the equipment and production for the solution of technological, design, economic and socio-political and other tasks, ensuring functioning of science, technology and production as single system, including development of the specifications and technical documentation necessary for carrying out these researches;

7) innovative cluster "The park of innovative technologies" - consolidation of the participants of innovative cluster designed to stimulate industrial and innovative activities by interaction and joint use of the available opportunities, knowledge sharing and experience, carrying out researches, effective technology transfer, establishing stable partner relations and distribution of information;

8) the project of the participant of innovative cluster "The park of innovative technologies" - complex of the actions directed to creation of the new or advanced productions, technologies, goods, works and services realized during certain term of time;
