About approval of Rules of forming of the delivery schedule of oil

According to Item 1 of article 130 of the Code of the Republic of Kazakhstan "About subsoil and subsurface use" PRIKAZYVAYU:

1. Approve the enclosed Rules of forming of the delivery schedule of oil.

2. To provide to development department of the oil industry of the Department of Energy of the Republic of Kazakhstan in the procedure for the Republic of Kazakhstan established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan after its official publication;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2), 3) and 4) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

5. This order becomes effective since June 29, 2018 and is subject to official publication.

Rules of forming of the delivery schedule of oil

Chapter 1. General provisions

1. These rules of forming of the delivery schedule of oil (further – Rules) are developed according to Item 1 of article 130 of the Code of the Republic of Kazakhstan "About subsoil and subsurface use" and determine procedure for forming of the delivery schedule of oil.

2. In Rules the following concepts are applied:

1) statements from the schedule – the detailed information on paper and (or) electronic carriers which monthly goes authorized body in the field of hydrocarbons to petrotransport organizations, to oil refineries and in Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (further – Committee);

2) the integrated information system "Single State Management System Subsurface Use of the Republic of Kazakhstan" – the single state management system subsurface use of authorized body in the field of hydrocarbons intended for collection, storage, the analysis and information processing in the field of subsurface use;

3) oil supply – process of acceptance, delivery, transfer of oil on the bulk distribution line from Item of its acceptance from the sender to delivery Item to the receiver, discharge, filling, transfer of oil to other bulk distribution lines, transfers on other mode of transport, storage, mixing;

4) producer of oil products – the legal entity having oil refinery on the property right and (or) other legal causes and performing production of oil products according to the passport of production, and also realization of the made own oil products and (or) transfer of the oil products which are raw materials supplied by the customer conversion product;

5) petrotransport organization – the owner of the bulk distribution line and (or) other mode of transport rendering oil delivery services.

Chapter 2. Rules of forming of the delivery schedule of oil

The delivery schedule of oil (further – the schedule) is developed based on requests of subsoil users (in case of their availability), plans of oil refining and products of conversion and technical capabilities of petrotransport organizations, amounts of oil extraction provided by project documents of subsoil users.

4. In case of schedule development the following factors are considered:

internal needs of the Republic of Kazakhstan for the amounts determined by authorized body;

the operating technical handling capacity of trunk oil pipelines;

unusual situations (exceeding of admissible values on content of organochlorine connections, emergencies at domestic oil refineries, stop of oil refineries on unplanned repair, landings of tension of the electric power, non-staff situations on export routes, including oil transportation restrictions);

total amount of oil extraction of the subsoil user;

force majeure circumstances.

5. For the purpose of maintenance of uniform load of subsoil users for ensuring domestic market with oil products, in case of distribution of the amounts determined by item 4 of these rules percentage loading on regions is considered.

Changes of percentage loading on regions no more than ten percent (accumulative loading) towards increase are entered by authorized body depending on level of production of oil of subsoil users in the region, but.

6. The authorized body passes to operational manual distribution of amounts of resource base in case of schedule development, including in case of modification and amendments into the approved schedule, in the cases specified in item 4 of these rules.

7. For forming of schedules subsoil users monthly to the fifth preceding month under report represent to authorized body in the field of hydrocarbons (further – authorized body) the supply requisition of oil in form, according to appendix to these rules (further – the Request) in electronic form by means of the integrated information system "Single state management system subsurface use of the Republic of Kazakhstan".

In case of non-presentation by the subsoil user of the Request the authorized body determines the oil amount which is subject to inclusion in the Schedule taking into account the requirements established by Items 3, of 4, of 5, of 6 and 13 these rules.

8. Subsoil users in case of submission to authorized body of the request distribute the resource base within the group of legal entities taking into account percentage loading.
