About approval of Rules of forming, monitoring of realization and assessment of results of the state social order

According to the subitem 3) article 4-1 of the Law of the Republic of Kazakhstan "About the state social order, the state order on realization of strategic partnership, grants and awards for non-governmental organizations in the Republic of Kazakhstan" and the subitem 2) Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" PRIKAZYVAYU:

1. Approve the enclosed Rules of forming, monitoring of realization and assessment of results of the state social order.

2. To provide to committee on cases of civil society of the Ministry of social development of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in the state and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry of social development of the Republic of Kazakhstan after its official publication;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of social development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of forming, monitoring of realization and assessment of results of the state social order

Chapter 1. General provisions

1. These rules of forming, monitoring of realization and assessment of results of the state social order (further – Rules) are developed according to the subitem 3) of article 4-1 of the Law of the Republic of Kazakhstan "About the state social order, the state order on realization of strategic partnership, grants and awards for non-governmental organizations in the Republic of Kazakhstan" (further – the Law) and determine procedure for forming, monitoring of realization and assessment of results of the state social order of state body in the sphere of the state social order.

2. In these rules the following basic concepts are used:

1) forming of the state social order – planning process of subjects of the state social order according to competence of state body;

2) monitoring of implementation of the state social order – collection, processing and information analysis about implementation of the state social order;

3) assessment of results of the state social order – efficiency analysis of implementation of the state social order;

4) state body in the sphere of the state social order and grants for non-governmental organizations (further – state body) – state body, including the central state and local executive body performing activities for forming, monitoring of realization and assessment of results of the state social order, forming and efficiency evaluation of state grants for non-governmental organizations;

5) conflict of interest – situation in case of which personal interest of independent experts or members of advisory council, can influence objective decision making;

6) authorized body in the sphere of interaction with non-governmental organizations (further – authorized body) – the state body performing management and cross-industry coordination in the sphere of interaction with non-governmental organizations;

7) the web portal of public procurements – the information system of state body providing single point of access to electronic services of public procurements.

Chapter 2. Procedure for forming of the state social order

3. Forming of the state social order consists of information collection, the analysis of situation in certain field of activity according to competence of state body, planning of subjects of the state social order, inclusion in the budget request and its consideration according to the procedure, established by the budget legislation of the Republic of Kazakhstan.

4. Forming of the state social order is based on the principles:

1) legality;

2) increases in efficiency of implementation of social projects and (or) social programs in the Republic of Kazakhstan;

3) participations of citizens of the Republic of Kazakhstan in the solution of social tasks;
