About approval of Rules of realization of general process "Ensuring exchange of the data in the field of ensuring unity of measurements containing in information funds of state members of the Eurasian Economic Union"

For the purpose of realization of Items 9 and 11 and according to Item 30 of the Protocol on information and communication technologies and information exchange within the Eurasian Economic Union (appendix No. 3 to the Agreement on the Eurasian Economic Union of May 29, 2014), being guided by the Decision of Board of the Eurasian economic commission of December 19, 2016 No. 169, the Board of the Eurasian economic commission solved:

1. Approve the enclosed Rules of realization of general process "Ensuring exchange of the data in the field of ensuring unity of measurements containing in information funds of state members of the Eurasian Economic Union".

2. This Decision becomes effective after 30 calendar days from the date of its official publication.

Rules of Realization of general process "Ensuring exchange of the data in the field of ensuring unity of measurements containing in information funds of state members of the Eurasian Economic Union"

I. General provisions

1. These rules determine requirements to realization of general process "Ensuring exchange of the data in the field of ensuring unity of measurements containing in information funds of state members of the Eurasian Economic Union" within the Eurasian Economic Union (further respectively – general process, the Union), and also the functions performed in case of realization of general process by authorized bodies in the field of ensuring unity of measurements of state members of the Union (further respectively – authorized bodies, state members) and the Eurasian economic commission (further – the Commission), procedure for exchange of data between participants of general process and the scope of information, given by participants of general process and subjects to placement on information portal of the Union in case of realization of general process.

2. Realization of general process is stipulated in Item the 38th list of general processes within the Eurasian Economic Union approved by the Decision of Board of the Eurasian economic commission of April 14, 2015 No. 29.

3. The concepts used in these rules are applied in the values defined by the Agreement on the Eurasian Economic Union of May 29, 2014, acts of bodies of the Union concerning creation and development of the integrated information system of the Union (further – the integrated system) and in the field of ensuring unity of measurements.

II. Scope

4. These rules extend to data on the works aimed at providing comparability of results of measurements and results of assessment (confirmation) of compliance of products to requirements of technical regulations of the Union and measurements of quantitative indices of products in case of information exchange of state members in the field of ensuring unity of measurements.

III. Purposes and tasks

5. The purpose of realization of general process is optimization of information exchange of state members in the field of ensuring unity of measurements when carrying out coordinated policy by them in the field of ensuring unity of measurements.

6. Goal achievement is provided for the account:

a) increases in efficiency of information exchange of authorized bodies when carrying out coordinated policy in the field of ensuring unity of measurements with authorized bodies, citizens of state members, business entities and public authorities of state members in case of performance of works in the field of ensuring unity of measurements within the Union (further – works);

b) increases in availability to citizens, business entities, public authorities of state members and authorized bodies of urgent and authentic data in the field of ensuring unity of measurements taking into account requirements of the legislation of state members in the field of ensuring unity of measurements.

7. Monitoring and efficiency evaluation of realization of general process are performed by the Commission based on the analysis of the following integral indicators:

a) amount of requests to the data published on information portal of the Union for the period, specified by the user (with indication of types of data);

b) amount of the inquiries for operational provision of data sent by means of information portal of the Union from information funds in the field of ensuring unity of measurements of state members (further – information funds of state members) for the period, specified by the user (with indication of type of request and state member to which the request is addressed);

c) the average time of provision of additional data according to Item 25 of these rules within implementation of mutual recognition of results of works for the period, specified by the user (with indication of work type and the member states, being the initiator and (or) the addressee of such request).

IV. Participants of general process

8. Participants of general process are:

a) authorized bodies;

b) Commission;

c) the legal entities and physical persons registered as individual entrepreneurs who are contractors;

d) the public authorities of state members interested in receipt of data from information funds of state members, legal entities, including the legal entities who are contractors, the physical persons registered as individual entrepreneurs and the physical persons interested in receipt of data from information funds of state members (further – interested persons).

9. Within realization of general process authorized bodies perform the following functions:

a) forming and maintaining information funds of state members according to the legislation of state members;

b) provision in the Commission of data from information fund of state member for publication on information portal of the Union;

c) provision in the Commission on request of data from information fund of the state member for their subsequent provision to interested persons with use of information portal of the Union;

d) implementation of the procedures provided by the Rules of mutual recognition of results of works on ensuring unity of measurements approved by the Decision of Council of the Eurasian economic commission of October 18, 2016 No. 145 (further – Rules of mutual recognition of results of works), with use of the integrated system regarding the direction in bodies of the state members performing mutual recognition of results of works, and representation of the materials specified in Item 7 of Rules of mutual recognition of results of works;

e) obtaining at the request of the data published on information portal of the Union (if necessary);

e) provision to the authorized body or the legal entity of state member performing works, data on results of recognition of works.
