About approval of Rules of arrangement of places (platforms) of accumulating of solid utility waste and maintaining their register

According to article 13.4 of the Federal law "About Production Wastes and Consumption" Government of the Russian Federation decides:

1. Approve the enclosed Rules of arrangement of places (platforms) of accumulating of solid utility waste and maintaining their register.

2. This resolution becomes effective since January 1, 2019.

3. Recommend to public authorities of subjects of the Russian Federation to bring into accord with this resolution the regulatory legal acts of subjects of the Russian Federation regulating questions of arrangement of places (platforms) of accumulating of solid utility waste till January 1, 2020.

Rules of arrangement of places (platforms) of accumulating of solid utility waste and maintaining their register

I. General provisions

1. These rules determine procedure for creation of places (platforms) for accumulating of solid utility waste, rules of forming and maintaining the register of places (platforms) accumulating of solid utility waste, requirements to contents of the specified register.

2. Places (platform) of accumulating of solid utility waste shall conform to requirements of the legislation of the Russian Federation in the field of sanitary and epidemiologic wellbeing of the population and other legislation of the Russian Federation, and also to rules of improvement of municipalities.

II. Procedure for creation of places (platforms) for accumulating of solid utility waste

3. Places (platform) of accumulating of solid utility waste are created by local government bodies, the cases except for established by the legislation of the Russian Federation when such obligation lies on other faces. Local government bodies create places (platform) of accumulating of solid utility waste by decision path according to requirements of rules of improvement of such municipality, requirements of the legislation of the Russian Federation in the field of sanitary and epidemiologic wellbeing of the population and other legislation of the Russian Federation establishing requirements to places (platforms) of accumulating of solid utility waste.

4. If in accordance with the legislation of the Russian Federation the obligation on creation of the place (platform) of accumulating of solid utility waste lies on other faces, such persons approve creation of the place (platform) of accumulating of solid utility waste with local government body (further respectively - the applicant, authorized body) based on the written request which form is established by authorized body (further - the request).

5. The authorized body considers the request no later than 10 calendar days from the date of its receipt in time.

6. For the purpose of request assessment regarding observance of requirements of the legislation of the Russian Federation in the field of sanitary and epidemiologic wellbeing of the population to places (platforms) of accumulating of solid utility waste the authorized body requests line item of the relevant territorial authority of federal executive body, authorized to exercise federal state sanitary and epidemiological surveillance (further - request).

At the request of authorized body territorial authority of federal executive body, authorized to exercise federal state sanitary and epidemiological surveillance, prepares the conclusion and sends it to authorized body no later than 5 calendar days from the date of receipt of request in time.

In case of sending an inquiry the term of consideration of the request can be increased according to the decision of authorized body up to 20 calendar days, at the same time to the applicant no later than 3 calendar days from the date of adoption of such decision by authorized body the adequate notice goes.

7. By results of consideration of the request the authorized body makes the decision on approval or refusal in approval of creation of the place (platform) of accumulating of solid utility waste.

8. The bases of refusal of authorized body in approval of creation of the place (platform) of accumulating of solid utility waste are:

a) discrepancy of the request to the established form;

b) discrepancy of the place (platform) of accumulating of solid utility waste to requirements of rules of improvement of the respective municipality, to requirements of the legislation of the Russian Federation in the field of sanitary and epidemiologic wellbeing of the population, other legislation of the Russian Federation establishing requirements to places (platforms) of accumulating of solid utility waste.

9. The authorized body notifies the applicant on the made decision in time, established by Items 5 and 6 of these rules. In the decision on refusal in approval of creation of the place (platform) of accumulating of solid utility waste the basis of such refusal without fail is specified.

10. After elimination of the basis of refusal in approval of creation of the place (platform) of accumulating of solid utility waste the applicant has the right to address repeatedly to authorized body behind approval of creation of the place (platform) of accumulating of solid utility waste according to the procedure, established by this Section of Rules.

III. Rules of forming and maintaining register of places (platforms) accumulating of solid utility waste, requirements to its content

11. The register of places (platforms) of accumulating of solid utility waste (further - the register) represents the database about places (platforms) of accumulating of solid utility waste.

12. The register is kept on paper and in electronic form by authorized body. Data are entered by authorized body within 5 working days from the date of decision making about introduction in it of data on creation of the place (platform) of accumulating of solid utility waste in the register.

13. Within 10 working days from the date of entering into the register of data on creation of the place (platform) of accumulating of solid utility waste such data are posted by authorized body on its official site on the Internet, and in case of its absence - on the official site of executive body of the subject of the Russian Federation which is the agreement party about the organization of activities for the treatment with solid utility waste of the regional operator according to the address with solid utility waste on the Internet with observance of requirements of the legislation of the Russian Federation on personal data. The specified data shall be available to acquaintance to the unrestricted group of people without collection of payment.

14. The register is kept in state language of the Russian Federation.
