About features of carrying out sanitation of the companies of agro-industrial complex

In pursuance of the Presidential decree of Ukraine of March 23, 1998 of N215 "About Measures of Rather State Support of Agricultural Production", for the purpose of overcoming crisis of agro-industrial production and creation of conditions for its development the Cabinet of Ministers of Ukraine decides:

1. During 1998 - 2000 to perform sanitation of the companies of agro-industrial complex according to Regulations on procedure for the carrying out sanitation of the state companies approved by the resolution of the Cabinet of Ministers of Ukraine of February 8, 1994 N 6, taking into account the features determined by this resolution with simultaneous implementation of their restructuring.

2. Form the Interdepartmental commission on questions of carrying out sanitation with simultaneous implementation of restructuring of the companies of agro-industrial complex. Approve staff of the Commission and Regulations on it (are applied).

To Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations to create regional commissions concerning carrying out sanitation with simultaneous implementation of restructuring of the companies of agro-industrial complex.

3. Determine that:

coordination of carrying out sanitation of the state companies of agro-industrial complex and the companies with the mixed pattern of ownership which share of state-owned property in property exceeds 50 percent is performed by regional commissions concerning carrying out sanitation with simultaneous implementation of restructuring of the companies of agro-industrial complex;

To the ministry of agro-industrial complex, Fund of state-owned property, the State committee of fishery, the State committee of forestry, the State committee on water economy, Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations together with the Ukrainian academy of agrarian sciences till August 1, 1998 to determine lists of the state companies of agro-industrial complex and the companies with the mixed pattern of ownership which share of state-owned property in property exceeds 50 percent which are subject to sanitation and to create on each of them working groups for carrying out the economic analysis and preparation of the project of carrying out sanitation with simultaneous implementation of their restructuring.

4. The financial support of sanitation of the companies of agro-industrial complex can be performed within budgetary appropriations on returnable or irretrievable basis.

On irretrievable basis the financial support can be provided:

for cost recovery of the works connected with mitigation of consequences of natural disaster according to the legislation;

for financing of expenses on recovery of solvency of the separate companies which activities are connected with accomplishment of nation-wide programs;

for expense recovery for construction and content of objects of the social sphere of the village according to the legislation.

In all other cases the financial support is provided only on returnable basis.

5. The companies which need financial support for prevention of bankruptcy recoveries of solvency, financial improvement prepare business plans and determine the need for means for projects of sanitation by form according to appendices 1 and 2.

6. The financial support can be provided to the companies within the means provided by the government budget and from other sources according to the legislation.

7. To regional commissions concerning carrying out sanitation with simultaneous implementation of restructuring of the companies of agro-industrial complex to initiate carrying out sanitation of the companies of non-state pattern of ownership which have debt on obligations to the state.

8. Determine that domestic and foreign investors can participate in carrying out sanitation of the companies of agro-industrial complex.

9. Interdepartmental and to regional commissions concerning carrying out sanitation with simultaneous implementation of restructuring of the companies of agro-industrial complex during 1998 to create the working groups of comprehensive examination of certain companies, to develop schedules of carrying out their sanitation and restructuring.

10. To impose control of execution of this resolution on the Vice-Prime Minister of Ukraine Tigipko S. L.
