About customs declaration of goods, delivered by carrier as express load, with use of the declaration on goods

According to the subitem 6 of item 4 of Article 104, Item 5 of Article 105, Item 2 of Article 106, Item 5 of Article 109 and Items 1 - 4 Articles 112 of the Customs code of the Eurasian Economic Union the Board of the Eurasian economic commission solved:

1. Approve enclosed:

declaration form on goods for express loads;

Procedure for filling of the declaration on goods for express loads;

form of adjustment of the declaration on goods for express loads;

Procedure for filling of adjustment of the declaration on goods for express loads;

Procedure for making of the customs transactions connected with change (amendment) of the data declared in the declaration on goods for express loads.

2. Determine that:

a) in case of customs declaration of goods, delivered by carrier as express load (further – express carrier), except for the goods specified in the subitem "b" of this Item the declaration on goods for express loads in the form approved by this Decision (further – DTEG) is used if the following conditions are at the same time complied:

customs declaration of goods is performed by the customs representative;

total customs value of the goods moved on one individual delivery note and placed under customs procedure of release for internal consumption or customs procedure of export or under customs procedure of re-export or customs procedure of reimport (if earlier goods were located under customs procedures with representation of DTEG), does not exceed the amount equivalent of 1000 euros;

goods are located under customs procedure of release for internal consumption or customs procedure of export, or under customs procedure of re-export or customs procedure of reimport (if earlier goods were located under customs procedures with representation of DTEG), or under customs procedure of re-export (if earlier goods were not located under customs procedure, except for customs procedure of customs transit);

b) DTEG is not used in case of customs declaring of the following types of goods brought by express carrier:

currency of state member of the Eurasian Economic Union, securities and (or) currency values, travel checks, precious metals and gemstones;

the goods moved with features, the stipulated in Clause 301 Customs code of the Eurasian Economic Union;

goods to which automatic licensing (observation) of export and (or) commodity import are applied quantitative restrictions of import and (or) commodity exportation, and also goods to which the allowing procedure for import and (or) export is applied (it is except for model biological materials of the person (further - biological samples), the goods included in the unified register of the radio-electronic means and high-frequency devices of civil appointment including which are built in or being part of other goods when which importing to customs area of the Eurasian Economic Union submission of the license or conclusion (allowing document), the goods included in the unified register of notifications about characteristics of the cryptography (cryptographic) tools and goods, them containing is not required);

explosive objects, the explosive, poisoning, dangerous chemical, biological substances (except for biological samples), drugs, psychotropic, strong, toxic, toxic, radioactive materials, nuclear materials, dangerous wastes;

the goods moved with pipeline transport and on power lines;

the imported excise goods (except for the goods imported as tests and samples for carrying out researches and testing on condition of availability of the copy of the contract with accredited body on certification (accredited test laboratory (center)) or the letter of such accredited body on certification (accredited test laboratory (center)), confirming quantity, necessary for these purposes (weight and amount) the imported (imported) goods;

the exported excise goods (for the Republic of Belarus);

goods to which privileges on payment of customs duties, taxes, the tariff quotas, tariff preferences, and goods concerning which special protective, anti-dumping, countervailing measures and (or) other measures of protection of the domestic market are established are applied;

goods concerning which the payment deferral of import customs duties or payment by installments of their payment is granted;

the goods similar to goods to which the measures of protection of the domestic market caused by goods origin provided by the Agreement on the Eurasian Economic Union of May 29, 2014 are applied (for the Republic of Belarus);

c) if the conditions provided by the subitem "a" of this Item are not complied, in case of customs declaration of goods, delivered by express carrier, and also the goods specified in the subitem "b" of this Item the declaration on goods in the form approved by the Decision of the Commission of the Customs union of May 20, 2010 № 257 is used.

d) till May 1, 2022:

customs declaring in writing concerning the goods delivered by express carrier which customs declaring is performed with use of DTEG is allowed (for the Republic of Armenia, the Republic of Kazakhstan and the Kyrgyz Republic);

giving of DTEG in document type on paper is not followed by representation of its electronic type to customs authority (for the Republic of Armenia, the Republic of Kazakhstan and the Kyrgyz Republic);

e) till April 1, 2023 DTEG is not used when placing goods under customs procedure of release for internal consumption if total customs value of the goods moved on one individual delivery note exceeds the amount equivalent of 200 euros (customs value is determined taking into account provisions of Item 2 of Article 136 of the Customs code of the Eurasian Economic Union).

3. This Decision becomes effective since July 1, 2019.

Procedure for filling of the declaration on goods for express loads

I. General provisions

1. This Procedure determines rules of filling of the declaration on goods for express loads (further – DTEG) in the form of the electronic document and in document type on paper.

2. Joint specifying in one DTEG of data is not allowed:

about imported goods which total customs value on one individual delivery note does not exceed the amount equivalent of 200 euros and about imported goods which total customs value on one individual delivery note exceeds the amount equivalent of 200 euros, but does not exceed the amount equivalent of 1000 euros;

about documents (documents are understood as the express loads representing the documents and correspondence which do not have commercial cost which transportation is not followed by creation of business documents) and on other types of goods;

about biological samples and about other types of goods.

3. In one DTEG data on the goods moved no more than on 500 individual delivery notes are specified.

4. DTEG in the form of the electronic document is filled according to the structure determined by the Eurasian economic commission.

5. When filling DTEG the reference books and qualifiers which are part of resources of single system of normative reference information of the Eurasian Economic Union (further – the Union), and also the reference books and qualifiers used for the customs purposes, created and which are subject to application according to the legislation of state members of the Union are applied (further – state members).

6. For the purposes of this Procedure the column is understood as detail (details) of structure of DTEG in the form of the electronic document or structural unit of the DTEG form in document type on paper which can include subsections, columns (columns), elements. According to this Procedure in one column the data combined on one sign are specified.

7. DTEG in the form of the electronic document may contain the data of technical nature necessary for the automated processing of DTEG. Such data are created by information system. The structure of the specified data is determined in structure of DTEG in the form of the electronic document.

Data of technical nature are not displayed when printing the paper copy DTEG in the form of the electronic document.

8. DTEG in document type is on paper constituted on sheets of paper of the A4 format in 2 copies, one of which is intended for customs authority to which DTEG moves, and another – for the customs representative. In case of customs declaration of goods for the purpose of their export from customs area of the Union of DTEG in document type it is on paper constituted on sheets of paper of the A4 format in 3 copies, one of which is represented in the customs authority located in the place of departure of goods from customs area of the Union.

9. Columns DTEG in document type are on paper filled in consistently.

The columns "The Sender (on General Delivery Note)", "Receiver (on General Delivery Note)", "A", "DTEG", "Feature", "Prior Document", "Number of Sheets" and "Procedure" are located on the first sheet DTEG in document type on paper.
