According to the Law of the Republic of Uzbekistan "About public procurements" and the resolution of the President of the Republic of Uzbekistan of March 24, 2018 "About measures for further liberalization of foreign trade and increase in efficiency of trading activities" I order to No. PP-3624:

1. Approve Regulations on the specialized organizations having the right to render services in carrying out public procurements, according to appendix.

2. This order becomes effective from the date of its official publication.

Regulations on the specialized organizations having the right to render services in carrying out public procurements

This Provision according to the Law of the Republic of Uzbekistan "About public procurements" and the resolution of the President of the Republic of Uzbekistan of March 24, 2018 No. PP-3624 "About measures for further liberalization of foreign trade and increase in efficiency of trading activities" determines requirements to the specialized organizations having the right to render services in the organization of carrying out public procurements of goods of works and services.

Chapter 1. General provisions

1. In this Provision the following basic concepts are used:

the specialized organization - the legal entity who is meeting the requirements of this provision, having the right to render services in the organization of carrying out public procurements of goods, works, services in the order of the state customer, based on the agreement, on paid basis;

the state customer - the legal entity conducting public procurements;

public procurement - acquisition on paid basis the state customers of goods (works, services);

subjects of public procurements - the state customer, the participant of procurement procedures, the contractor of public procurements, procurement commission, the operator of special information portal and the expert;

procurement procedure - set of actions for public procurement;

the announcement - the information message about the forthcoming public procurements with indication of method of implementation of requirements and conditions of public procurements, terms and procedure for submission of offers placed by the state customer on special information portal.

2. Authorized body in the field of public procurements based on the Law "About Public Procurements" is the National agency of project management in case of the President of the Republic of Uzbekistan.

3. The specialized organizations can render services in public procurements:

performed in case of implementation of state programs of development, the projects provided by decrees, resolutions and orders of the President of the Republic of Uzbekistan, decisions of the Government of the Republic of Uzbekistan and also in case of realization of economic activity of the state customers;

financed by means of budgets of the budget system and other state trust funds of the Republic of Uzbekistan, foreign grants provided within prisoners by the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan of contracts with the donor countries, the international, foreign government and non-governmental organizations and the foreign loans attracted under guarantee of the Republic of Uzbekistan.

4. The choice of the specialized organization by the state customers is made on competitive basis from among the specialized organizations which list at least once a month is published updated) on the website of authorized body on the Internet.

Chapter 2. Requirements to the specialized organizations

5. The specialized organizations for rendering services in the organization of carrying out public procurements shall conform to the following requirements:

the legal entity registered in accordance with the established procedure in the Republic of Uzbekistan;

the subject of public procurements cannot be the founder of the specialized organization;

absence of the founders of the specialized organization registered in the states and the territories which are providing preferential tax regime and (or) not providing complete disclosure and submission of information to banking supervisor authorities (offshore zones);

have at least one worker having practical experience on rendering services in the state;

have available the program technical means providing access to special information portal.

6. The legal entity meeting the requirements established in Item 5 of the this provision having the right to address to authorized body in the field of public procurements with the statement for inclusion in the list of the specialized organizations published on the website of authorized body in the field of public procurements in the Internet in form according to appendix to this Provision. At the same time, addresses are considered by authorized body in the field of public procurements within 5 calendar days.

7. Specialized organization:

has the right to obtain from the state customer necessary information for rendering services in the organization of carrying out public procurements of services;

shall provide the report on the done work at any stage upon the demand of the state customer;

render services with respect for the basic principles of public procurements;

at the request of authorized body in the field of public procurements, in the sphere of public procurements to provide to the Commission on consideration of claims information on observance of this provision;

not allow violation of the principles of public procurements;

take measures for prevention to participation in public procurements of unfair participants;

shall organize procurement procedures on the basis of requirements of the Law of the Republic of Uzbekistan "About public procurements".

8. The specialized organization renders the following services:

determines the starting price of goods (works, services), except as specified, established by the legislation;

conducts marketing and other researches;

organizes advertizing work;
