About approval of the Regulations on procedure for provision from the government budget of monetary compensations for the families with children participating in the State program "First house"

No. 18-26, 95) DECIDES: the Government

1. Approve Regulations on procedure for provision from the government budget of monetary compensations for the families with children participating in the State program "First house" it (is applied).

3. To perform accomplishment of provisions of this resolution within the financial resources provided annually on these purposes in the government budget for the corresponding year.

4. To impose control over the implementation of this resolution on the Ministry of Finance.

5. This resolution becomes effective from the date of publication.

Regulations on procedure for provision from the government budget of monetary compensations for the families with children participating in the State program "First house"

I. General provisions

1. This Provision is developed for the purpose of establishment of the mechanism of assignment, the monetary compensations provided in the government budget for provision to the physical person who is the parent and/or the guardian/custodian of child(children) and participating in the State program "First house".

2. For the purposes of this provision the following concepts are used:

the beneficiary - the physical person participating in the State program "First house" according to the Law No. 293/2017 on some measures for implementation of the State program "First house" who is parent and/or the guardian/custodian of child(children) and receives monetary compensation in accordance with the terms, established by this Provision;

the applicant - physical person which has the contract for the mortgage loan signed according to regulations of the Order of the Government No. 202/2018 on approval of the Provision on implementation of the state program "First house" is parent and/or the guardian/custodian of child(children) and submits the application for compensation provision;

monetary compensation - form of the monetary assistance provided to beneficiaries which correspond to selection criteria;

the operator - persons/persons who are appointed/appointed by the order of the Minister of Finance for ensuring maintaining the electronic register responsible/responsible for check and processing of the entered data, confirmation, monitoring and issue of notifications on obtaining;

the child - the person who did not reach 18 years and not having full legal capacity;

family - parents and their children;

the guardian/custodian - physical person which has the planned accommodation of child(children) with the status of child(children) who temporarily remained / without parental support, established according to the Law No. 140/2013 on special protection of children, being in risk situations, and the children separated from parents.

II. Procedure for determination of the size of monetary compensation

3. The monetary compensation is provided for partial covering of expenses which are incurred by the beneficiary for payment of mortgage loan within the State program "First house".

4. The cost of housing for which the monetary compensation from the government budget can be provided shall not exceed 2, 5 million Moldovan lei (the price specified in the purchase and sale agreement).

5. The monetary compensation is provided monthly, from the moment of approval of the statement for financing before the end of the period of return of mortgage loan. In case of early repayment of mortgage loan, provision of monetary compensation stops from the moment of repayment by the beneficiary of the last fee.

6. The size of monthly monetary compensation is calculated by the following formula:

                                             C1 = (Cr x N %) / L 1,

where:

C1 - monthly monetary compensation;

Cr - the size of mortgage loan (the main amount) which does not include the accompanying interest rate, commission on guarantee and other bank payments, but no more than 1 million Moldovan lei;

N - the percent appointed depending on number of minor children as follows:

for families/guardians/custodians with 1 child - 25%;

for families/guardians/custodians with 2 children - 50%;

for families/guardians/custodians with 3 children and more - 100%;

L1 - the number of months (216 months), to equal 18 calendar years.

7. If the beneficiary gets to categories of participants as the worker of the public sector or private sector, and as the beneficiary of monetary compensation according to this Provision, the size of cumulative monetary compensation cannot exceed the value calculated by formula:
