1. Approve the Provision of republican public institution "Committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan" according to appendix to this order.

2. To provide to committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation:

1) within ten calendar days from the date of approval of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

3) within ten working days after approval of this order submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective from the date of its first official publication.

Provision of public institution "Committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan"

Chapter 1. General provisions

1. Public institution "Committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan" (further - Committee) is the department of the Ministry for Investments and Development of the Republic of Kazakhstan (further - the Ministry) performing regulating, realizable and control functions, and also participating in accomplishment of strategic functions of the Ministry in the field of civil aviation. The committee has territorial authority in the city of Almaty.

2. The committee in the activities is guided by the Constitution of the Republic of Kazakhstan, the laws, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

3. The committee is legal entity in form of business of public institution, has seals and stamps with the name in state language, forms of the established sample, and also according to the legislation of the account in bodies of treasury.

4. The committee enters the civil relations from own name.

5. The committee on questions of the competence of the procedure established by the legislation makes the decisions which are drawn up by orders of the Chairman.

Chapter 2. Main objectives, functions, rights and obligations

12. The main objectives of Committee are:

1) realization of the main directions of state policy in the field of use of airspace and activities of civil and experimental aviation;

2) state regulation and state control and supervision of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation;

3) ensuring safe use of airspace of the Republic of Kazakhstan with its users, accomplishment of flights without threat of life or to human health, the environment, interests of the state;

4) establishment of the general principles of implementation of the activities connected with use of airspace and accomplishment of flights;

5) requirements satisfaction of economy of the Republic of Kazakhstan and citizens in aviation services.

13. The committee according to the legislation of the Republic of Kazakhstan performs the following functions assigned to it by the Ministry:

1) implementation of regulating, realizable and control and supervising functions and participation in accomplishment of strategic functions of the Ministry within competence of department;

2) approval of regulatory legal acts on the questions entering competence of department and with direct competence on their approval of orders of the Minister, except for the regulatory legal acts affecting rights and freedoms of man and citizen;

3) implementation of international cooperation within the competence;

4) implementation of international cooperation with the aviation authorities of foreign states and the specialized international organizations, including by the conclusion of bilateral agreements about cooperation, experience exchange and information relating to civil aviation and also representation of the Republic of Kazakhstan in International Civil Aviation Organizations;

5) ensuring compliance with the laws and other regulatory legal acts of the Republic of Kazakhstan in the field of mobilization preparation and mobilization;

6) management of activities of the subordinated organizations for planning and holding actions for ensuring national security within the competence;
