About approval of the Payment procedure of cash cover by the serviceman of the Armed Forces of Ukraine and to some other persons

According to article 9 of the Law of Ukraine "About social and legal protection of the military personnel and members of their families", to the resolution of the Cabinet of Ministers of Ukraine of August 30, 2017 No. 704 "About cash cover of the military personnel, faces of the private and the commanding structure and some other persons" PRIKAZYVAYU:

1. Approve the Payment procedure of cash cover by the serviceman of the Armed Forces of Ukraine and to some other persons which is applied.

2. Recognize invalid orders of the Ministry of Defence of Ukraine:

of June 25, 2001 No. 219 "About approval of the Instruction about payment procedure of the monthly allowance for special conditions of service to observers of the Armed Forces of Ukraine on control of razukomplektovaniye and destruction of nuclear ammunition", registered in the Ministry of Justice of Ukraine on July 10, 2001 for No. 577/5768;

of June 11, 2008 No. 260 "About approval of the Instruction about payment procedure of cash cover by the serviceman of the Armed Forces of Ukraine and to some other persons", registered in the Ministry of Justice of Ukraine on July 14, 2008 for No. 638/15329 (with changes);

of July 27, 2010 No. 394 "About approval of the Instruction about the sizes and payment procedure the serviceman of remuneration for diving works", registered in the Ministry of Justice of Ukraine on August 06, 2010 for No. 618/17913;

of May 22, 2014 No. 328 "About approval of the Instruction about procedure and conditions of payment to the military personnel of the Armed Forces of Ukraine of remuneration for search, raising, mine clearing and neutralization of explosive objects", registered in the Ministry of Justice of Ukraine on June 5, 2014 for No. 584/25361;

of October 24, 2016 No. 550 "About approval of the Instruction about the sizes and payment procedure of the monthly additional monetary reward the serviceman of the Armed Forces of Ukraine", registered in the Ministry of Justice of Ukraine on November 11, 2016 for No. 1470/29600;

of December 15, 2016 No. 692 "About approval of Criteria of use of foreign language in office activities by the military personnel of the Armed Forces of Ukraine", registered in the Ministry of Justice of Ukraine on January 10, 2017 for No. 19/29887;

of March 9, 2017 No. 135/DSP "About approval of the Instruction about the organization of payment of remuneration for alert by the serviceman (special purpose) of military units and divisions", registered in the Ministry of Justice of Ukraine on April 03, 2017 for No. 439/30307;

of March 14, 2017 No. 139 "About payment of the special allowance to the military personnel by Sil of special transactions of the Armed Forces of Ukraine", registered in the Ministry of Justice of Ukraine on March 29, 2017 for No. 428/30296.

3. This order becomes effective from the date of its official publication and  No. 704 "About cash cover of the military personnel, faces of the private and the commanding structure and some other persons" is applied from the date of entry into force of the resolution of the Cabinet of Ministers of Ukraine of August 30, 2017.

Payment procedure of cash cover by the serviceman of the Armed Forces of Ukraine and to some other persons

I. General provisions

1. This Procedure determines the mechanism and conditions of payment of cash cover by the serviceman of the Armed Forces of Ukraine, the Public special service of transport of Ukraine and to some other persons.

This Procedure   No. 393 "About procedure for calculation of length of service, appointment and pension payment and the monetary assistance to faces of officers, to ensigns, warrant officers, the military personnel of extra urgent service and military service under the contract, faces of the commanding and ordinary structure of law-enforcement bodies, police officers and members of their families", of December 22, 1995 No. 1037 "About allowances to official pay rates of the workers occupied at the cryptographic work" of June 15, 1994 No. 414 "About types, the sizes and procedure for provision of compensation to citizens in connection with work which provides access to the state secret", of August 11, 1995 No. 648 "About payment terms of work of persons working in mountainous areas" of August 30, 2017 No. 704 "About cash cover of the military personnel is developed according to the Law of Ukraine "About social and legal protection of the military personnel and members of their families", to resolutions of the Cabinet of Ministers of Ukraine of July 17, 1992, faces of the private and the commanding structure and some other persons".

Action of this Procedure (except Sections II, V - _kh, H ІІ - XX) extends to the military personnel, conditions of payment of cash cover for whom are established by other regulatory legal acts.

2. Cash cover includes:

monthly main types of cash cover;

monthly additional types of cash cover;

disposable additional types of cash cover.

Treat monthly main types of cash cover:

official pay rate;

salary for military rank;

length-of-service allowance.

Treat monthly additional types of cash cover:

increase in official pay rate;

allowances;

surcharges;

award.

Treat disposable additional types of cash cover:

remunerations;

help.

3. The bases for calculation and payment of the main and additional types of cash cover are:

staff of military unit (organization, the organization) (further - military unit);

orders on position assignment and transfer in lists of staff of military unit, about the introduction in fulfillment of duties on position, including it is temporary, about transfer in the order;

orders on establishment and payment of the main and additional types of cash cover;

orders on assignment of military ranks;

the cash certificate or the certificate of money payments (except for persons which are called up (accepted) for military service under the contract including during passing of conscription military service).

4. Cash cover of the military personnel from among faces of officers, including listeners (graduateds in a military academy, doctoral candidates), ordinary, sergeant and foreman structure (except the military personnel of conscription service), includes:

official pay rate;

salary for military rank;

length-of-service allowance;

increase in official pay rate during passing of military service in the territory of settlements to which the status mountain, and on the island Snake is provided;

allowances for features of service, for service in Forces of special transactions of Armed Forces, qualification, qualification category, accomplishment of functions of the state expert in secrets, work in the conditions of regime restrictions, uninterrupted length of service at the cryptographic work, honorary and sports titles;

surcharges for scientific degree and academic status;

award;

sea remuneration, remunerations for parachute jumps, for search, raising, mine clearing and neutralization of explosive objects, sweeping and destruction of mines, for diving works and for alert;

one-time money allowances after the conclusion of the first contract, for improvement, for the solution of social questions, in case of dismissal from military service;

other payments which are performed according to the current legislation of Ukraine.

5. Cash cover of the military personnel of compulsory military service includes:

official pay rate;

increase in official pay rate during passing of military service in the territory of settlements to which the status mountain, and on the island Snake is provided;

qualification allowances, work in the conditions of regime restrictions, uninterrupted length of service at the cryptographic work;

sea remuneration, remunerations for parachute jumps, for search, raising, mine clearing and neutralization of explosive objects, sweeping and destruction of mines, for diving works and for alert;

the help to the military personnel of compulsory military service discharged from military service;

other payments which are performed according to the current legislation of Ukraine.

6. The cash allowance of cadets (except the military personnel from among faces of ordinary, sergeant and foreman structure of military service under the contract) includes:

official pay rate;

cadet official allowance;

increase in official pay rate by results of another examinations;

the help to the military personnel of compulsory military service discharged from military service;

other payments which are performed according to the current legislation of Ukraine.

Cash cover of lyceum students from among the orphan children and children deprived of parent guardianship in the presence of the bases according to the current legislation of Ukraine includes official pay rate.

7. Over established working hours, in days of rest, festive, output and non-working days cash cover by the serviceman in addition is not paid for service.

The amount of the cash cover relying the serviceman not for complete calendar month is determined by multiplication of the daily average amount of cash cover on the number of the calendar days served by the serviceman this month. At the same time daily average the amount of cash cover is determined by division of the amount of the cash allowance which is due to the serviceman for complete calendar month on the number of calendar days of month for which payment is performed.

The cash allowance is paid to the military personnel who is excluded from lists of staff of military unit about day of exception inclusive. In orders on exception of lists of staff surely it is specified about payment of one-time additional types of cash cover.

Payment of the cash allowance in case of departure of the military personnel to the new duty station for term from the date of following behind day of exception of lists of staff of military unit and about day of acceptance of position is performed on the new duty station in the amount of, established on the previous duty station, after their transfer on cash cover of this military unit.

During acceptance of cases and position by the serviceman, except the military personnel of compulsory military service, within the terms determined by the current legislation for acceptance and delivery of cases and position cash cover which the serviceman received on the last post, proceeding from salary for military rank, official pay rate, length-of-service allowance, monthly additional types of cash cover and award is paid.

In case of matters of argument on charge of cash allowance payment is performed in indisputable size to the solution of questions in the procedure established by the current legislation.

8. Cash cover is paid within the assignments provided in the estimate of military unit on cash cover of the military personnel.

Cash cover is paid:

monthly main and additional types - in current month for last;

disposable additional types - in month of the publication of the order on payment or in the following ambassador of month in which it is announced by the order on payment (taking into account requirements of the Budget code of Ukraine).

The cash allowance is paid on residence of the military personnel on cash cover based on the order of the commander (the chief, the head) (further - the commander).

Cash cover is paid to the commander of military unit on residence on cash cover based on the order of the higher commander on subordination.

9. Payment of cash allowance remains during the business trips, and also provision of the leaves paid according to the current legislation of Ukraine.

Cash cover on the last posts is paid for the period releases from execution of service duties in connection with disease and stay on treatment in medical institutions and on leave for treatment in connection with disease (leave for health reasons) (further - leave for treatment in connection with disease), but no more than four months from the date of departure from military unit (except the cases provided by the current legislation of Ukraine, longer terms of stay on treatment).

Cash cover after four months of continuous stay on treatment in medical institutions is paid based on the conclusion of medical institution (the military-medical commission), the decision of the commander of military unit on prolongation of stay in medical institutions and according to requirements of the current legislation.

The serviceman of compulsory military service who is in business trips, leaves and on treatment in medical institutions, the cash allowance is paid for the entire period of stay in business trips, leaves and on treatment.

The maternity leave is paid according to requirements of the current legislation of Ukraine. To the female military personnel who according to the medical certificate before their disposal in maternity leave is appointed on equivalent (including with smaller amount of work) and the lowest positions for health reasons, payment of cash allowance for the previous position, but no more than about day of arrival from maternity leave remains.

10. The cash allowance for the period from the date of their transfer in the order about day of the introduction in fulfillment of duties on new positions or about day of dismissal from military service is inclusive paid to the military personnel who arrived for further passing of military service in the Armed Forces of Ukraine and state bodies, organizations, the organizations proceeding from official pay rate on positions which they held in these bodies, organizations, the organizations, salary for military rank and length-of-service allowances.

11. In case of changes of the sizes (regulations) of monthly main or additional types of cash cover during passing of military service (including during the business trips, leaves, training, release from execution of service duties in connection with disease, stay on treatment in medical institutions and the order, etc.) recalculation of cash cover from the date of is performed from which there were corresponding changes.

12. Monthly additional types of cash cover which have permanent nature are paid to the military personnel who temporarily is disposed from military unit with preserving cash allowance on the duty station for the entire period of such disposal.

13. The cash allowance paid in the sizes established by the Cabinet of Ministers of Ukraine which affected payment date to return is not subject, except cases of return of the amounts of benefit (in case of dismissal from military service) in case of cancellation of the order of the corresponding commander on dismissal of the serviceman from military service according to the current legislation of Ukraine.

14. The cash allowance which is not paid timely or paid in smaller than followed, the size, is paid for the entire period during which the serviceman had the right to it.

15. The cash allowance is not paid:

during provision by the serviceman of leaves according to the current legislation of Ukraine by which preserving the salary is not provided;

if the academic grants are paid;

during absence on service without valid excuse one days and more;

during stay on treatment in medical institutions over established by the current legislation terms;

during temporary accomplishment of obligations more than two months on new positions in connection with transfer of military unit on other state (modification of the state);

during content of the military personnel under guards or stay under the round-the-clock house arrest;

for term of imprisonment on guardroom the military personnel of compulsory military service.
