Recognize invalid the orders of the Government of the Republic of Tajikistan of October 14, 2014, No. 641 "About the Procedure for maintaining the State catalog of objects of historical and cultural heritage of the Republic of Tajikistan" and Council of Ministers of the Tajik SSR of December 31, 1971, No. 480 "About approval of the list of cultural monuments of republican value".

Procedure for maintaining the state register of objects of historical and cultural heritage of the Republic of Tajikistan

1. General provisions

1. The procedure for maintaining the State register of objects of historical and cultural heritage of the Republic of Tajikistan (further - the Procedure) determines procedure for entering into the register and exceptions of objects of historical and cultural heritage of it.

2. The state register of objects of historical and cultural heritage of the Republic of Tajikistan (further - the Register) is the main source of information on the list of objects of historical and cultural heritage.

3. The register is kept by the Ministry of Culture of the Republic of Tajikistan (further - authority).

4. For movable and immovable objects of historical and cultural heritage the State register of movable and immovable objects of historical and cultural heritage is created (appendices 1 and 2).

8. Objects of historical and cultural heritage are entered in the Register by authority according to article 13 of the Law of the Republic of Tajikistan "About protection and use of objects of historical and cultural heritage of the Republic of Tajikistan".

9. For conducting verification of documentation and preparation of recommendations about determination of need of entering into the Register or exceptions of objects of historical and cultural heritage of it the permanent competent commission is created (further - the commission). Representatives of local executive bodies of the government and other relevant departments, legal entities and physical persons are part of the commission.

10. Entering of objects of historical and cultural heritage into the Register is performed on representation of public authorities, legal entities and physical persons.

11. Idea of introduction of movable objects of historical and cultural left marks in the Register it is made with appendix of the following documents:

- the statement for introduction revealed movable objects of historical and cultural heritage in the Register;

- conclusion of historical and cultural examination;

- the description of the distinctive features of object proving its entering into the Register and need of its obligatory storage (protection) (further - protective material);

- photo of object;

- information about the owner and user of object of historical and cultural heritage.

12. Idea of entering of immovable objects of historical and cultural heritage into the Register is made with appendix of the following documents:

- statement for entering of object of historical and cultural heritage into the Register;

- data on the name of object of historical and cultural heritage;

- the certificate of the industry specialist of time of emergence or date of asset construction, date of the main changes (reconstruction) of this object, or date of the historical events connected with this object;

- data on degree of historical and cultural value of this object;

- data on object location;

- data on object type;

- description of borders of arrangement of object;

- the information about the user the parcel of land, and also about legal status of use of the earth which territories object of ancient heritage is located.
