1. Approve Conditions and safety requirements (licensed conditions) of implementation of activities in the field of the treatment of radioactive waste which is applied.

2. In five-day time after signing of the order to provide to the head of department of regulation of the treatment of radioactive waste Bykov V. O. its provision on state registration in the Ministry of Justice of Ukraine.

3. In a month after state registration of the order to provide to the director of the State scientific and technological center of nuclear and radiation safety Vasilchenko V. M. replication of this regulatory legal act.

4. In ten-day time after replication of this regulatory legal act to provide to the head of department of regulation of the treatment of radioactive waste Bykov V. O. its mailing according to mailing calculation.

5. Abolish the order of 26.11.2001 No. 102 "About approval of Conditions and safety requirements of implementation of activities for conversion, storage and burial of radioactive waste".

Conditions and safety requirements (licensed conditions) of implementation of activities in the field of the treatment of radioactive waste

I. General provisions

1.1. These conditions and requirements establish safety requirements to implementation of activities in the field of the treatment of radioactive waste (further - Russian joint stock company), namely implementation by subjects of activities in the field of the address with Russian joint stock company: activities for conversion of Russian joint stock company, activities for storage of Russian joint stock company and activities of the operating organization (operator) at separate stage of lifecycle of storage for burial of Russian joint stock company.

1.2. In these Conditions and requirements terms and determinations are used in the following values:

the operating organization (operator) of storage for burial of Russian joint stock company - the legal entity intended by the state performing the activities connected with the choice of the platform, designing, construction, operation, closing of storage for burial of Russian joint stock company ensures nuclear and radiation safety, physical protection of storage for burial of Russian joint stock company at all stages of its lifecycle and bears responsibility for nuclear damage;

object for conversion of Russian joint stock company - the construction equipped with processing equipment or the installation (mobile, stationary, collapsible) intended for conversion of Russian joint stock company by implementation of consecutive technology transactions on transfer of Russian joint stock company in the condition acceptable for their safe storage and/or burial in storages of Russian joint stock company, further conversion, release from the regulating control by the termination;

The subject of activities in the field of the address with Russian joint stock company - the subject of activities in the field of use of nuclear energy, including the operating organization (operator) of storage for burial of Russian joint stock company, or declared specialized enterprise according to the address from Russian joint stock company which performs intention to perform activities in the field of the address with Russian joint stock companies which are transferred from producers of Russian joint stock company to the possession of the state, and/or with the Russian joint stock companies formed owing to the Chernobyl catastrophic crash and accomplishment of military programs of the USSR in the territory of Ukraine.

Other terms and determinations are used in the values given in the Laws of Ukraine "About use of nuclear energy and radiation safety", "About the treatment of radioactive waste", "About allowing activities in the field of use of nuclear energy", "About the Nation-wide target ecological program of the treatment of radioactive waste", the Technical regulation of rather packaging sets for storage and burial of radioactive waste approved by the resolution of the Cabinet of Ministers of Ukraine of July 18, 2007 No. 939 (in edition of the resolution of the Cabinet of Ministers of Ukraine of October 24, 2012 No. 1099), the Basic health regulations of ensuring radiation safety of Ukraine approved by the order of the Ministry of Health of Ukraine of February 2, 2005 No. 54, registered in the Ministry of Justice of Ukraine on May 20, 2005 at No. 552/10832.

1.3. Activities in the field of the address with Russian joint stock company include:

activities for conversion of Russian joint stock company - the activities connected with the choice of the platform, designing, construction and commissioning, operation, removal from operation of object for conversion of the Russian joint stock company and all objects located on the platform of object and technology connected with it, and also with development, production, operation (application), removal from operation of installation for conversion of Russian joint stock company;

activities for storage of Russian joint stock company - the activities connected with the choice of the platform, designing, construction, operation, removal from operation of storage for storage of the Russian joint stock company and all objects located on the platform of storage and technology are connected with it;

activities for burial of Russian joint stock company - the activities of the operating organization (operator) of storage for burial of Russian joint stock company connected with the choice of the platform, designing, construction, operation, closing of storage for burial of the Russian joint stock company and all objects located on the platform of storage and technology with it connected.

1.4. The subject of activities in the field of use of nuclear energy, including the subject of activities in the field of the address with Russian joint stock company, plans and performs activities in the field of the address with Russian joint stock company for the purpose of realization of the tasks and actions provided by the Law of Ukraine "About the Nation-wide target ecological program of the treatment of radioactive waste", the Strategy of the treatment of radioactive waste in Ukraine approved by the order of the Cabinet of Ministers of Ukraine of August 19, 2009 No. 990-r, other acts in the field of the address from Russian joint stock company and use of nuclear energy.

1.5. According to articles 6-8 of the Law of Ukraine "About allowing activities in the field of use of nuclear energy" licenses in the field of the address with Russian joint stock company are issued:

the operating organization (operator) of storage for burial of Russian joint stock company on: construction of storage for burial of Russian joint stock company, operation of storage for burial of Russian joint stock company, closing of storage for burial of Russian joint stock company;

to the subject of activities in the field of the address from Russian joint stock company on implementation of certain type of activity - conversion of Russian joint stock company;

to the subject of activities in the field of the address from Russian joint stock company on implementation of certain type of activity - storage of Russian joint stock company.

1.6. Activities for conversion of Russian joint stock company which are subject to licensing, including activities for conversion of Russian joint stock company which are transferred from producers of Russian joint stock company to the possession of the state, and/or Russian joint stock companies which were formed owing to the Chernobyl catastrophic crash and accomplishment of military programs of the USSR in the territory of Ukraine, namely work on:

to construction and commissioning, operation, removal from operation of object for conversion of Russian joint stock company;

to operation (application), removal from operation of installation for conversion of Russian joint stock company.

Operation (application) of object for conversion of Russian joint stock company includes implementation on this object of technology transactions as a result of which characteristics of Russian joint stock company change (radiation, physical, chemical), there is transfer of Russian joint stock company in safer and stable condition. Such technology transactions include: preliminary processing of Russian joint stock company (collection, removal, sorting, fragmentation, deactivation), processing of Russian joint stock company (technology transactions on reduction of amount of Russian joint stock company, change of radio nuclide structure), conditioning of Russian joint stock company (placement of Russian joint stock company in packaging set (container), immobilization).

1.7. Activities for storage of Russian joint stock company which are subject to licensing include works on construction and commissioning, operation, removal from operation of storage for storage of Russian joint stock company which are transferred from producers of Russian joint stock company to the possession of the state, and/or Russian joint stock companies which were formed owing to the Chernobyl catastrophic crash.

1.8. Conditions and safety requirements in case of production of conversion and storage of Russian joint stock company by producers of Russian joint stock company before date of transmission of Russian joint stock company to specialized enterprises according to the address from Russian joint stock company are established by regulations and rules on nuclear and radiation safety, and also licensed conditions on implementation of activities in the field of use of nuclear energy as a result of which the Russian joint stock company (operation and removal from operation of nuclear installations, use and production of sources of ionizing radiation) are formed.
