Based on Item e) article 7 of the Law No. 136 of July 7, 2017 on the Government (The official monitor of the Republic of Moldova, 2017, No. 252, the Art. 412) and parts (7) article 14 of the Law No. 98 of May 4, 2012 on the central branch public management (The official monitor of the Republic of Moldova, 2012, Art. No. 160-164, 537), with subsequent changes and amendments, DECIDES: the Government

1. The public archive agency will be reorganized by conversion from the central administrative authority subordinated to the Government into the National archive agency - the administrative authority subordinated to the Ministry of Justice with form of business - the agency.

The national archive agency is successor of the rights and obligations of the Public archive agency.

2. The personnel of the Public archive agency will perform the activities before approval of structure, the extreme number of staff and the staff list of the National archive agency.

Change or the termination of office/employment relationships of personnel of the National archive agency is performed after approval and registration of its staff list by the State office.

Release of personnel in connection with reorganization, in case of impossibility of its transfer, will be performed according to the Law No. 158-XVI of July 4, 2008 on the state position and the status of the government employee and the legislation on work.

3. Before position assignment of the director of the National archive agency of power of management of the Agency the CEO of the Public archive agency will continue to carry out.

4. To the Ministry of Justice:

1) in 5-day time from the date of entry into force of this resolution to initiate the necessary legal procedures necessary for substitution of position of the director of the National archive agency;

2) within 30 days from the moment of assignment of the director of the National archive agency to submit to the Government for review in accordance with the established procedure structure, the extreme number of staff and regulations on the organization and functioning of the National archive agency;

To provide 3) within 6 months from the date of entry into force of this resolution to the Government of the offer on approval of regulations of Parliament and the Government in the field of archives.

5. In the Order of the Government No. 698 of August 30, 2017. "About the organization and functioning of the Ministry of Justice" (Official monitor of the Republic of Moldova, 2017, Art. No. 335-339, 824), with subsequent changes and amendments, to make the following changes and additions:

To replace 1) in Item 2 of the resolution of digit "92" with digits "94";

Item 6 of appendix No. 1 to add 2) with the subitem 16) of the following content:

"16) archive and record keeping".

6. To the Ministry of Finance according to offers of the Ministry of Justice as a result of reorganization of the Public archive agency to provide to the Government the draft of the Order of the Government about redistribution of the assignments approved by the Law on the government budget for 2018 No. 289 of December 15, 2017 between the ministries, other central administrative authorities and organizational structures in the field of their competence.
