About approval of the Regulations on the customer of national segment of the Kyrgyz Republic of the integrated information system of the Eurasian Economic Union

For the purpose of ensuring standardization of the applied organizational decisions during creation, ensuring functioning and development of national segments of state members of the integrated information system of the Eurasian Economic Union, according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve Regulations on the customer of national segment of the Kyrgyz Republic of the integrated information system of the Eurasian Economic Union according to appendix.

2. Determine the Ministry of digital development of the Kyrgyz Republic by the customer of national segment of the Kyrgyz Republic of the integrated information system of the Eurasian Economic Union.

3. Appoint the State company "Infokom" under the Ministry of digital development of the Kyrgyz Republic the operator of national segment of the Kyrgyz Republic of the integrated information system of the Eurasian Economic Union.

4. This resolution becomes effective after ten days from the date of official publication.

5. To impose control of execution of this resolution on department of construction, transport and communications of Government office of the Kyrgyz Republic.

Regulations on the customer of national segment of the Kyrgyz Republic of the integrated information system of the Eurasian Economic Union

I. General provisions

1. The customer of national segment of the Kyrgyz Republic of the integrated information system of the Eurasian Economic Union (further - national segment, the integrated system) is determined by the order of the Government of the Kyrgyz Republic according to Item 31 of the Protocol on information and communication technologies and information exchange within the Eurasian Economic Union (appendix No. 3 to the Agreement on the Eurasian Economic Union of May 29, 2014 (further - the Agreement on the Union).

2. The customer of national segment performs the rights and fulfills duties on creation, ensuring functioning and development of national segment.

3. The customer of national segment in the activities is guided by the Agreement on the Union, other international treaties and acts constituting the right of the Eurasian Economic Union (further - the Union), the legislation of the Kyrgyz Republic, and also this Provision.

4. The concepts used in this Provision are applied in the values defined by the Agreement on the Union including the Protocol on information and communication technologies and information exchange within the Eurasian Economic Union (appendix No. 3 to the Agreement on the Union), and the acts of bodies of the Union regulating questions of creation and development of the integrated system.

5. The customer of national segment performs the activities in interaction with authorized bodies of the Kyrgyz Republic, and also within the competence - with the Eurasian economic commission (further - the Commission) coordinating creation, ensuring functioning and development of the integrated system and with customers of national segments of other state members of the Union.

II. Tasks of the customer of national segment

6. The main objectives of the customer of national segment are:

a) creation, ensuring functioning and development of national segment, ensuring the information security processed in national segment, according to the specification on creation of the integrated system, the plans of creation, ensuring functioning and development of the integrated system approved by the Commission, and also taking into account the strategy of development for the integrated system approved by the Commission;

b) development of cross-border space of trust according to the Strategy of development for cross-border space of trust approved by the Decision of Board of the Eurasian economic commission of September 27, 2016 No. 105, and the Concept of use in case of interstate information exchange of services and effectual in law electronic documents approved by the Decision of Council of the Eurasian economic commission of September 18, 2014 No. 73;

c) coordination of works on realization in national segment of general processes according to the list of general processes within the Union approved by the Commission.

III. Functions of the customer of national segment

7. For realization of the tasks assigned to it the customer of national segment performs the following functions:

a) develops based on plans of creation, ensuring functioning and development of the integrated system and approves plans of creation, ensuring functioning and development of national segment with the Commission, and also coordinates their realization;

b) develops the private specification on creation of national segment based on the specification on creation of the integrated system;

c) adopts regulatory legal acts:

regulating information exchange in national segment (taking into account the requirements to the organization of interstate information exchange determined by the Commission);

necessary for accomplishment in national segment of requirements of the technology documents regulating information exchange in case of realization of general processes within the Union;

d) participates in approval of offers of authorized bodies of the Kyrgyz Republic on modification of the list of general processes within the Union approved by the Commission;

e) coordinates consideration in the Kyrgyz Republic of drafts of the acts drafted by the Commission at stages of determination of requirements to realization of general process within the Union and process design of general process within the Union;

e) will organize connection of information systems of the authorized bodies of the Kyrgyz Republic participating in realization of general processes within the Union to national segment;

g) provides connection of national segment to integration platform of the integrated system;

h) provides information security, processed in national segment;

i) will organize testing in national segment of information exchange in case of realization of general processes within the Union and participates in the organization of interstate testing of information exchange in case of realization of general processes within the Union;
