1. Approve Rules of the organization and financing of outsourcing of services in the sphere of employment of the population according to appendix to this order.

2. To provide to department of employment of the population and market development of work of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan;

5) within ten working days from the date of state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan Altayev N. B.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of the organization and financing of outsourcing of services in the sphere of employment of the population

Chapter 1. General provisions

1. These rules of the organization and financing of outsourcing of services in the sphere of employment of the population (further - Rules) are developed according to subitem 12-1) of article 7 of the Law of the Republic of Kazakhstan of April 6, 2016 "About employment of the population" (further - the Law) and determine procedure for the organization and financing of outsourcing of services in the sphere of employment of the population.

2. The basic concepts used in these rules:

1) the state Internet resource "Employment exchange" (further - Employment exchange) - the electronic information resource containing single information base of the labor market, functioning on the Internet which is followed by the center of development of manpower for the purpose of rendering the state measures of assistance of employment of the population;

2) the unemployed - the persons who are not belonging to occupied population, looking for work and ready to work;

3) private employment agency - the physical person or legal entity rendering the labor mediation registered according to the procedure, established by the legislation of the Republic of Kazakhstan;

4) jobcenter of the population (further - jobcenter) - the legal entity created by local executive body of the area, the cities of regional and republican value, the capital for the purpose of realization of active measures of assistance of employment, the organization of social protection from unemployment and other measures of assistance of employment;

5) outsourcing of services in the sphere of employment of the population (further - outsourcing of services) - complex of the actions directed to transfer of services by jobcenters of the population to private employment agencies based on the agreement on outsourcing of services in the sphere of employment of the population.

Chapter 2. Procedure for the organization of outsourcing of services in the sphere of employment of the population

3. The jobcenter places on Employment exchange the announcement of carrying out outsourcing of services in the sphere of employment of the population.

4. The announcement of carrying out outsourcing of services is published by jobcenter on Employment exchange weekly on environments.

Announcements of carrying out outsourcing of services contains the following information:

1) name of jobcenter, legal address, contact information, surname, name, middle name (in the presence) responsible person;

2) the list of the services offered within outsourcing of services (further - services);

3) quantity of lots and the unemployed in them on categories grouped in professions;

4) the draft agreement about outsourcing of services;

5) terms of carrying out outsourcing of services.
