About the National registry of emissions and transfer of pollutants

Based on article 16 of the Law No. 71-XVI of March 22, 2007 on registers (The official monitor of the Republic of Moldova, 2007, Art. No. 70-73, 314), with subsequent changes, and article 2 of the Law No. 99 of April 26, 2013 on ratification of the Protocol on registers of emissions and transfer of pollutants to the Convention on information access, participation of the public in decision making process and access to justice on the questions concerning the environment (The official monitor of the Republic of Moldova, 2013, Art. No. 125-129, 400), the Government DECIDES:

1. Create the National registry of emissions and transfer of pollutants for the purpose of information collection about emissions of pollutants and their transfer.

2. Approve:

1) the Technical concept of the Automated information system "National Registry of Emissions and Transfer of Pollutants" according to appendix No. 1;

2) Regulations on the National registry of emissions and transfer of pollutants according to appendix No. 2.

3. To the Ministry of Agriculture, regional development and environmental protection to provide by means of Office on prevention of environmental pollution creation and monitoring of the Automated information system "National Registry of Emissions and Transfer of Pollutants" at the expense of the means provided by donors and within the annual assignments approved for the ministry in the law on the government budget for the corresponding year.

4. To the state company "Center of Special Telecommunications" to exercise on contractual basis control also servicing of the Automated information system "National Registry of Emissions and Transfer of Pollutants".

5. The reporting on emissions and transfer of pollutants within the National registry of emissions and transfer of pollutants is kept as follows:

1) on the date of entry into force of this resolution the pollutants listed in appendix No. 2, with the following sequence numbers are obligatory for the reporting: 1-14, 17-29, 34, 35, 37-39, 42-52, 54, 57, 61-65, 68, 70-72, 74, 76, 79, 82, 83, 88, 90-98;

2) since January 1, 2023 all pollutants listed in appendix No. 2, taking into account development of methods of calculation at the international level, except for the substances specified in Item 6 are obligatory for the reporting.

6. No. forbidden to use, import and production according to the national legal system and listed in appendix 2, with the following sequence numbers are excluded from the list of reports of substance: 15, 16, 26, 33, 41, 53, 58, 59.

7. To impose control over the implementation of this resolution on the Ministry of Agriculture, regional development and the environment.

8. This resolution becomes effective in one month after its publication in the Official monitor of the Republic of Moldova.

Technical concept of the Automated information system "National Registry of Emissions and Transfer of Pollutants"

Chapter I General provisions

1. The automated information system "National Registry of Emissions and Transfer of Pollutants" (further - AIS RVPZ") represents the systematized data on emissions of pollutants in air, water, the soil and diffusion sources, and also on transfer of waste and pollutants from sewage out of site limits which shall be represented by the operators performing one or more types of activity specified in appendix No. 1 to the Regulations on the National registry of emissions and transfer of pollutants.

2. The concepts used in this Concept mean the following:

1) the site - geographical arrangement of industrial complex;

2) accounting year - the first calendar year for which data on emissions of pollutants and transfers out of site limits are collected;

3) sewage - city, household, industrial sewage and any other sewage to which provisions of the national legal system, because of the substances containing in them or objects extend;

4) the database - set of the integrated data organized according to conceptual structure, establishing the general principles of the description, storage and data processing;

5) industrial complex - one or several installations on the same site which are in operation of one physical person or legal entity or different persons;

6) data - the elementary information units about persons, objects, the facts, events, the phenomena, processes, objects, situations, etc. provided in shape which allows to report them, to comment and process;

7) the approved data - data which underwent control procedures of quality and are considered suitable for use;

8) waste - any substance or object as it is determined in the Law on waste No. 209 of July 29, 2016;

9) dangerous wastes - any substance or subject determined according to the Law on waste No. 209 of July 29, 2016;

10) removal - any transaction provided in appendix 1 to the Law on waste No. 209 of July 29, 2016;

11) emission - any introduction of pollutants to the environment as a result of any human activities performed intentionally or accidentally, regular method or on an emergency basis including flood, issue, release, downloading, removal or dumping into dump or through systems of the sewerage without final sewage treatment;

12) installation - the stationary technical block which performs one or several types of activity provided in appendix No. 1 to the Regulations on the National registry of emissions and transfer of pollutants and also any other activities which are directly connected with the technical work which is carried out on the site which can cause emissions and environmental pollution;

13) operator - the physical person or legal entity which manages or controls industrial complex as it is provided in the national legal system, or given authority to make economic decisions of rather technical functioning of industrial complex;
