Regulations on special documents of the persons without citizenship who are constantly living in the Azerbaijan Republic

1. Special documents which sample affirms relevant organ of the executive authority of the Azerbaijan Republic are issued to the persons without citizenship who are constantly living in the territory of the Azerbaijan Republic.

2. There are following types of special documents:

a) the identity certificate issued to the stateless person before achievement of 16 years by it for use within the Azerbaijan Republic;

b) the identity certificate issued to the stateless person on reaching it 16 years for use within the Azerbaijan Republic;

c) the identity certificate issued to the stateless person for departure out of limits of the Azerbaijan Republic;

d) the allowing certificate for permanent residence in the territory of the Azerbaijan Republic.

The documents specified in the Items "and" and "b" of this Article are issued only to the persons without citizenship who got permission to permanent residence in the Azerbaijan Republic till January 1, 1992 and their children born before entry into force of the Law of the Azerbaijan Republic "About citizenship of the Azerbaijan Republic";

The procedure for issue of the document specified in the Item "g" of this Article is established by the Migratory code of the Azerbaijan Republic.

3. Each stateless person or his legal representative shall store the identity certificate carefully.

4. In the identity certificate for use within the Azerbaijan Republic issued to the stateless person before achievement of 16 years by it series and number of the certificate, surname and name of the owner, surname and name of his parents, the place and date of its birth from what country arrived, floor, blood type, the residence, the name of the body which issued the certificate and date of issue of the certificate are specified.

In the identity certificate for use within the Azerbaijan Republic issued to the stateless person on reaching it 16 years except the data specified in Article 4 this provision data on its marital status, growth, color of eyes, the personal signature of the owner of the certificate and photograph are added. 6. In the identity certificate issued to the stateless person for departure out of limits of the Azerbaijan Republic the name of the Azerbaijani state, the State Emblem, country code, series and number of the identity certificate, surname, name, middle name from what country arrived, the place and birth date, floor, blood type, the name of the body which issued the identity certificate, date of issue the personal signature of the owner of the certificate, surname, name, floor and birth date of the children leaving together with it who did not reach 18-year age, the requirement to the identity certificate are specified and the photograph of the owner of the identity certificate is pasted.

7. The identity certificate for use within the Azerbaijan Republic is issued to each person without citizenship living constantly in the territory of the Azerbaijan Republic, before achievement of 16 years by it relevant organ of the executive authority (The Ministry of Internal Affairs of the Azerbaijan Republic) in the place of his residence according to the procedure, established by this Provision, within a month from the date of the address about it on the basis of the completed corresponding statement questionnaire completed in the form provided in Appendix No. 3 to the "Regulations on application of the Law of the Azerbaijan Republic "On registration approved by the Law of the Azerbaijan Republic of December 8, 1999 at the place of residence and the place of stay".

8. The identity certificate for use within the Azerbaijan Republic is issued to the stateless person on reaching it 16 years by relevant organ of the executive authority (The Ministry of Internal Affairs of the Azerbaijan Republic) in the place of his residence according to the procedure, established by this Provision, within a month from the date of the address of the stateless person or his legal representative about certification of the personality on the basis of the completed corresponding statement questionnaire completed in the form provided by Appendix No. 4 to the "Regulations on application of the Law of the Azerbaijan Republic "On registration approved by the Law of the Azerbaijan Republic of December 8, 1999 at the place of residence and the place of stay".

9. In case of the first certification of the personality to the stateless person on reaching it 16 years for use within the Azerbaijan Republic, the specified application is signed by him and one of parents or his legal representative.

10. The responsible of relevant organ of the executive authority (The Ministry of Internal Affairs of the Azerbaijan Republic) of the Azerbaijan Republic shall check correctness of filling of the statement of stateless persons for certification of the personality irrespective of its type for use within the Azerbaijan Republic and demand for this purpose from these persons the documents established by the legislation. At the same time he looks through:

- the certificate of birth and the medical certificate about blood type of the stateless person before achievement of 16 years by it;

- the medical certificate about blood type, color of eyes, growth of the stateless person on reaching it 16 years;

- if person receiving the identity certificate is married, then the marriage certficate, if necessary the document certifying the rights of his legal representatives.

11. For the identity certificate used within the Azerbaijan Republic the stateless person on reaching it 16 years shall provide to relevant organ of the executive authority (The Ministry of Internal Affairs of the Azerbaijan Republic) of the Azerbaijan Republic together with the statement and other documents, stipulated by the legislation, the photographs shown from one negative, the identical size representing person only in fullface without headdress with the appearance and signs (points, beard, moustaches, etc.) inherent in it in everyday life.
