1. Approve the enclosed Rules of realization of general process "Forming, maintaining and use of the general register of Authorized Economic Operators".

2. This Decision becomes effective after 30 calendar days from the date of its official publication.

Rules of realization of general process "Forming, maintaining and use of the general register of Authorized Economic Operators"

I. General provisions

1. These rules are developed according to the following international treaties and acts entering the right of the Eurasian Economic Union (further – the Union):

The agreement on the Eurasian Economic Union of May 29, 2014;

The agreement on the Customs code of the Eurasian Economic Union of April 11, 2017;

The decision of Board of the Euroasian economic commission of November 6, 2014 №200 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general processes";

The decision of Board of the Euroasian economic commission of April 14, 2015 № 29 "About the list of general processes within the Eurasian Economic Union and modification of the Decision of Board of the Euroasian economic commission of August 19, 2014 № 132";

The decision of Board of the Euroasian economic commission of June 9, 2015 №63 "About the Analysis technique, optimization, harmonizations and descriptions of general processes within the Eurasian Economic Union";

The decision of Board of the Euroasian economic commission of December 19, 2016 №. 169 "About approval of the Procedure for realization of general processes within the Eurasian Economic Union";

The decision of Board of the Euroasian economic commission of December 19, 2017 №. 186 "About form of the register of Authorized Economic Operators of state member of the Eurasian Economic Union";

The decision of Board of the Euroasian economic commission of December 19, 2017 №187 "About the general register of Authorized Economic Operators of state members of the Eurasian Economic Union".

2. These rules are the basis for accomplishment of process design and work planning on organizational technical supply of realization of general process "Forming, maintaining and use of the general register of Authorized Economic Operators" (further – general process).

3. The concepts used in these rules are applied in the values defined by the international treaties and acts constituting the right of the Union.

II. Purposes and tasks

The purposes of realization of general process are ensuring forming and maintaining the general register of Authorized Economic Operators of state members of the Union (further respectively – the general register, state members), and also submission of data from it to authorized bodies of state members, legal entities and physical persons, the individual entrepreneurs using in the activities data from the general register (further – interested persons).

5. Within realization of general process it is necessary to solve the following problems:

a) submission to the Eurasian economic commission (further – the Commission) the authorized bodies of state members performing maintaining registers of Authorized Economic Operators of state members (further respectively – authorized bodies, registers of state members), the data necessary for forming of the general register (including data on inclusion of legal entities in registers of state members, on their exception of registers of state members, on suspension (renewal) of activities as Authorized Economic Operator and about change of information about legal entities in registers of state members);

b) automatic creation of the general register on the basis of the data which arrived in the Commission;

c) submission of data from the general register to authorized bodies on requests of their information systems;

d) publication of the general register on information portal of the Union and provision of access to data from the general register to interested persons.

III. Participants of information exchange

6. Participants of information exchange when forming, maintaining and use of the general register (further – information exchange) are:

a) authorized bodies;

b) structural divisions of the Commission responsible for ensuring forming, maintaining and use of the general register;

c) interested persons.

7. Within realization of information exchange the authorized body performs the following functions:

submission to the Commission of data on inclusion of legal entities in the register of state member, exception of it, suspension (renewal) of activities as Authorized Economic Operator and (or) about change of information about legal entities in the register of state member;

request of date and time of updating of the general register;

request of data from the general register;

request of data on the changes entered in the general register;

receipt of data from the general register (including data on the changes entered in the general register).

In case of submission of data for inclusion in the general register or exceptions of it forming and transfer by authorized body to the Commission of the corresponding data are performed.

The request of date and time of updating of the general register is carried out for the purpose of assessment of need of synchronization of the available data with data from the general register (by date and time of their updating).

The request of data from the general register is performed for the purpose of receipt by authorized body of data on the subjects of the general register which are stored in the Commission, or in full taking into account historical data or as of certain date.
