Chapter 1. General provisions

Article 1. Subject of regulation of the Law

This Law establishes legal, economic, social basis of ensuring technical safety in the Republic of Armenia, system of ensuring technical safety and governs the relations connected with ensuring technical safety.

Article 2. Law purpose

The purpose of this Law - establishment of the principles of the state strategy to the sphere of technical safety and mechanisms of their realization directed to prevention of technogenic accidents, elimination of their effects, decrease in risks of damage caused to society and economy owing to such accidents and also protection of the population and the environment.

Article 3. Law coverage

This Law extends to the hazardous production facilities operated in the territory of the Republic of Armenia, prepared, preserved, dismantled for the purpose of operation, except for nuclear and power stations, conversion of radioactive materials, water systems, aircraft, road and rail transport, and also military objects.

Article 4. Basic concepts of the Law

In this Law the following basic concepts are used:

technical safety - condition of the maximum vital security of society and the individual from technogenic accidents, production incidents and their effects in objects of the sphere of production and servicing;

technogenic accident - destructions of the processing equipment used in production, buildings, structures, uncontrollable explosion and the fire, emissions of dangerous, hazardous substances owing to which the damage to health of people was caused to the environment are damaged or destroyed appliances;

technical means - machines, tools, protective equipment, instrumentations, the automation equipment, technical equipment, watercrafts used for implementation of engineering procedure;

production incident - failure or damages of the technical means used on hazardous production facilities, variation from the mode of engineering procedure, violation of requirements of the legislation in the field of technical safety which can create threat of technogenic accident;

accident risk assessment - process which purpose is identification, the analysis and assessment of conditions of probability of emergence of technogenic accident on hazardous production facility, the description of the factors influencing their process, accident scales, severity of their impact on human health and the environment;

security of the circle - protection of life and human health, the environment against accident effects, and also implementation of legal organizational and technical actions for the purpose of protection of property of the state, other the owner and citizens;

the certificate on technical safety - the document approved by person operating hazardous production facility in which data on probability of technogenic accidents on hazardous production facility, their nature and scales, possible impact of dangerous factors on workers, the population and the environment, the provided actions for their prevention and elimination, and also about the territories surrounding hazardous production facility for the purpose of ensuring security of the circle are reflected and generalized;

examination of technical safety - activities, which purpose - to study and draw the conclusion about compliance of project documents on construction, expansion, reconstruction, technical retrofitting, preservation, dismantle of hazardous production facility, the certificate on technical safety, buildings, structures, processing equipment and technical means of the hazardous production facilities operated or which are subject to commissioning, requirements of the legislation in the field of technical safety;
