About approval of Rules of preservation and liquidation when carrying out exploration and production of hydrocarbons

1. Approve the enclosed Rules of preservation and liquidation when carrying out exploration and production of hydrocarbons.

2. To provide to department of the state inspection in oil and gas complex of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan after its official publication;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective since June 29, 2018 and is subject to official publication.

Rules of preservation and liquidation when carrying out exploration and production of hydrocarbons

Chapter 1. General provisions

1. These rules of preservation and liquidation when carrying out exploration and production of hydrocarbons (further – Rules) are developed according to Item 1 of article 126 of the Code of the Republic of Kazakhstan "About subsoil and subsurface use" (further – the Code) and determine procedure for preservation of the subsoil plot and mitigation of consequences of subsurface use when carrying out exploration and production of hydrocarbons, and also procedure for preservation and liquidation of technological objects.

2. In Rules the following concepts are used:

1) mitigation of consequences of subsurface use – complex of the events held for the purpose of reduction of production facilities and parcels of land in the condition ensuring safety of life and health of the population, environmental protection according to the procedure, stipulated by the legislation the Republic of Kazakhstan;

2) preservation of the subsoil plot – complex of actions, the operations performed in case of the temporary termination on subsurface use on the subsoil plot on which works on carrying out investigation and (or) hydrocarbon production, including technological complexes (blocks) and units of objects of subsurface use (oil and gas wells of different function, reservoirs, pipelines, reservoirs, separators and others), and also auxiliary constructions (oil storage pits, sludge collectors and others were carried out), for the purpose of reduction of the subsoil plot in the condition suitable for its operation in the future in case of renewal of transactions on subsurface use, and also reducings harmful effects of dangerous production factors and the prevention of emergency situations.

Other concepts and determinations used in these rules are applied according to the legislation of the Republic of Kazakhstan on subsoil and subsurface use.
