About approval of standards of the state services in questions of civil registration of citizens of the Republic of Kazakhstan abroad

1. Approve:

5) the standard of the state service "State Registration of Adoption (Adoption) of the Child Abroad" according to appendix 5 to this order;
6) the standard of the state service "State Registration of Change of Name, Middle Name, Surname Abroad" according to appendix 6 to this order;
7) the standard of the state service "State Registration of Death Abroad" according to appendix 7 to this order.
2. To provide to department of consular service of the Ministry of Foreign Affairs of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:
1) in the procedure established by the legislation of the Republic of Kazakhstan state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days from the date of state registration in the Ministry of Justice of the Republic of Kazakhstan of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;
3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;
4) placement of this order on official Internet resource of the Ministry of Foreign Affairs of the Republic of Kazakhstan;
5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Management of legal examination of the Ministry of Foreign Affairs of the Republic of Kazakhstan of data on accomplishment of the actions provided in subitems 1), 2), 3), 4) of this Item.
3. To impose control of execution of this order on the supervising deputy minister of foreign affairs of the Republic of Kazakhstan.
4. This order becomes effective after ten calendar days after day of its first official publication.

Appendix 1
to the Order of the Minister of Foreign Affairs of the Republic of Kazakhstan of May 16, 2018 No. 11-1-4/183
1. The state service "State Registration of the Birth of the Child Abroad" (further - the state service).
2. The standard of the state service is developed by the Ministry of Foreign Affairs of the Republic of Kazakhstan (further - the Ministry).
3. The state service appears foreign institutions of the Republic of Kazakhstan (further - the service provider).
Documents acceptance and issue of result of rendering the state service are performed through the service provider.
4. Term of rendering the state service:
1) from the date of delivery of document package by physical person (further - uslugopoluchatel) - 5 (five) working days;
2) the most allowed time of expectation for delivery of document package uslugopoluchatel - 60 (sixty) minutes;
3) the most allowed time of servicing of uslugopoluchatel - 20 (twenty) minutes.
5. Form of rendering the state service - paper.
6. Result of rendering the state service - the certificate of birth or the motivated answer about refusal in rendering the state service according to Item 10 of this standard of the state service.

7. The state service is rendered to uslugopoluchatel on paid basis at the rates of the consular fee according to the Code of the Republic of Kazakhstan of December 25, 2017 "About taxes and other obligatory payments in the budget (Tax code)".
Payment of the consular fee is performed in cash or non-cash form through the banks of the second level and the organization performing separate types of banking activities.
The state service is rendered free of charge:
1) to participants and disabled people of the Great Patriotic War and persons, equated to them on the privileges and guarantees, persons awarded with awards and medals of the former USSR for dedicated work and faultless military service in the back in days of the Great Patriotic War, to the persons who worked (served) at least six months from June 22, 1941 to May 9, 1945 and are not awarded with awards and medals of the former USSR for dedicated work and faultless military service in the back in days of the Great Patriotic War to disabled people, and also one of the disabled person's parents since the childhood, the handicapped child, to guardians (custodians), the state organizations;
2) to physical persons - for issue of certificates to them in case of change, amendment, recovery and correction of records of acts of the birth, in connection with the mistakes made in case of registration of the act of civil status.
8. Working schedule of the service provider:
Monday through Friday inclusive, from 9:00 till 18:30 o'clock with lunch break from 13:00 till 14:30 o'clock, except days off and holidays, according to the labor law of the Republic of Kazakhstan.
Documents acceptance is performed by the service provider from 09:30 till 12:30 o'clock, and issue of results of rendering the state service from 16:00 till 17:00 o'clock. Environment - not visiting day.

9. The list of the documents necessary for rendering the state service in case of the personal address of uslugopoluchatel or his legal representative with provision of the documents confirming powers on representation to the service provider:
for registration of the birth of the child within two months, and in case of the birth of the dead child - no later than five days from the moment of childbirth:
the statement for state registration of the birth of the child in form according to appendix 1 to this standard of the state service;
copies of identity documents of parents (the original for reconciliation);
the copy of the certificate on marriage (matrimony) of parents (the original for reconciliation);
health certificate on the birth or copy of the judgment on factual determination of the birth of the child;
the original document, the consular fee confirming payment.
In case of violation of term of registration of the birth of the child, except as specified, of stipulated in Item 9 these standards of the state service, are in addition represented:
written explanatory parents, constituted in any form;
certificate of lack of the birth record of registering body of the corresponding administrative and territorial unit;
health declaration of the child.
Documents which are issued or attested competent organization of foreign state or specially on that the authorized person, within its competence and in the established form sealed official foreign state are adopted only after passing procedures of the special certificate (legalization or apostilization).

10. The service provider refuses rendering the state service in the following bases:
1) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them;
2) discrepancy of uslugopoluchatel and (or) provided supplied and the information necessary for rendering the state service, to the requirements established by the Code of the Republic of Kazakhstan "About scrap (matrimony) and family", the Rules of the organization of state registration of acts of civil status, modification, recovery, cancellation of civil registrations approved by the order of the Minister of Justice of the Republic of Kazakhstan of February 25, 2015 No. 112 (it is registered in the Register of state registration of regulatory legal acts No. 10764).
In case of provision by uslugopoluchatel of incomplete document package according to the list, stipulated in Item 9 these standards of the state service, and (or) documents with the expired effective period, the service provider refuses reception of an application and issues the corresponding receipt on refusal in documents acceptance in form according to appendix 2 to this standard of the state service.
11. Appeal of decisions, actions (failure to act) of the service provider and (or) his officials concerning rendering the state service: the claim is submitted addressed to the head of the service provider to the address specified in Item 13 of this standard of the state service.
The claim is submitted in writing by mail, by means of the web portal of "the electronic government", or purposely through office of the service provider.
Confirmation of adoption of the claim is its registration (stamp, the entering number and date) in office of the service provider with indication of surname and initials of person which accepted the claim, term and the place of receipt of the answer to the made complaint.
