RESOLUTION OF THE PRESIDENT OF THE REPUBLIC OF UZBEKISTAN

of June 29, 2018 No. PP-3818

About measures for further streamlining of foreign economic activity and enhancement of system of customs and tariff regulation of the Republic of Uzbekistan

(as amended on 28-01-2025)

For last period in the country consecutive work on integration into the international economic community and creating favorable conditions for implementation by subjects of entrepreneurship of foreign economic activity is carried out.

At the same time, the operating system of customs and tariff regulation does not stimulate development of the market principles of the competition. In particular, provision of excessively wide privileges on customs payment for imported goods does not promote effective tariff regulation whereas individual preferences create unequal competitive conditions for development of business activity.

For the purpose of forming of the effective system of customs and tariff regulation directed to stimulation of competitive production, support of healthy competitive environment, encouragement of export of products with high value added, ensuring domestic market with high-quality consumer goods:

1. Determine the basic principles of further enhancement of system of customs and tariff regulation:

strengthening of the regulating function of customs tariffs, proceeding from priorities of development of the industries of economy directed to harmonious integration into global chains of value added;

enhancement of system of tariff regulation of foreign economic activity taking into account the best foreign practices, the international principles and regulations;

creation of conditions for providing local producers with raw materials and the materials which are not made in the republic or made in insufficient amount and used in release of export-oriented products;

preserving provision of favorable conditions for import of modern processing equipment and the equipment for creation of new productions, and also for the purpose of further intensification of processes of upgrade and rearmament of national production, the accelerated implementation of infrastructure projects;

unification of rates of customs payments on similar by the form, to appointment, property and structure, relatives by code of the commodity nomenclature of foreign economic activity goods for the purpose of exception of cases of their classification in the line items assessed by lower rates of customs payments in case of customs clearance;

unification of rates of the excise tax on excise goods, its application concerning goods, unhealthy people and the environment;

2. Approve:

rates of import customs duties according to appendix No. 1;

Determine that the rates approved by this Item become effective since January 1, 2019.

3. Establish since September 1, 2018 procedure according to which:

on border customs posts customs authorities when carrying out customs control also perform veterinary, phytosanitary, environmental and sanitary and epidemiologic control;

the customs clearance of goods in the "release for free circulation (import)" mode does not require obligatory marking of goods in state language. At the same time execution of the certificate of conformity and sanitary and epidemiologic conclusion on separate types of the imported consumer goods (except for the goods which do not have consumer packaging, and the goods imported for own needs) according to the list approved by the Cabinet of Ministers is forbidden, in case of not drawing by the producer, authorized representative of the producer and the importer of marking on these goods in state language of the Republic of Uzbekistan (the Uzbek alphabet based on Latin graphics), except as specified, provided by acts of the legislation.

4. To provide to the Cabinet of Ministers of the Republic of Uzbekistan together with the interested ministries and departments:

a) till September 1, 2018:

introduction of offers on cancellation of privileges on customs payments in case of commodity importation to the republic;

acceptance of necessary measures for creation in the border territories of malls for convenience of sales of goods;

implementation on the website of the State Customs Committee of the Republic of Uzbekistan of the interactive service "The Integrated Rate" allowing to receive in real time on free basis the detailed information about all regulating documents regulating the mode of movement of goods through customs border, the documents necessary for customs clearance of goods, rates of customs duties in relation to each goods, the bodies issuing the specified documents, and also other data for implementation of foreign economic activity;

b) in two-month time development and approval:

the exhaustive list of information provided by means of the interactive service "The Integrated Rate", including the requirement for sanitary quarantine, phytosanitary control and veterinary supervision, about execution of other documents of allowing nature;

the technological instruction for timely updating of information provided by means of the interactive service "The Integrated Rate", having provided responsibility of the relevant ministries and departments for untimely and low-quality updating of this information;

c) smooth functioning and information security of the interactive service "The Integrated Rate".

5. Determine that when implementing by subjects of entrepreneurship of foreign economic activity reclamation of the data and documents which are not provided in the interactive service "The Integrated Rate" is forbidden to state bodies.

6. To committee on development of the competition and consumer protection together with the Prosecutor General's Office of the Republic of Uzbekistan to take measures for increase in efficiency of mechanisms of identification and the prevention of price collusions and coordinated actions of the business entities limiting healthy competition.

7. Recognize invalid since January 1, 2019:

the resolution of the President of the Republic of Uzbekistan of September 29, 2017 No. PP-3303 "About measures for further streamlining of foreign economic activity of the Republic of Uzbekistan";

appendix No. 12-2 to the resolution of the President of the Republic of Uzbekistan of December 29, 2017 No. PP-3454 "About the forecast of the main macroeconomic indicators and parameters of the Government budget of the Republic of Uzbekistan for 2018".

8. To the State Customs Committee together with the interested ministries and departments in two-month time to make in the Cabinet of Ministers of the Republic of Uzbekistan offers on the changes and amendments in the legislation following from this resolution.

9. To impose control of execution of this resolution on the Prime Minister of the Republic of Uzbekistan A. N. Aripov, the Attorney-General of the Republic of Uzbekistan O. B. Murodov, the first deputy of the Counselor of state of the President of the Republic of Uzbekistan B. M. Mavlonov and the chairman of the State Customs Committee of the Republic of Uzbekistan M. B. Azimov.
