About the Security Council of the Republic of Kazakhstan

(as amended of the Law of the Republic of Kazakhstan of 07.02.2022 No. 106-VII ZRK)

This Law determines legal status, competence and the organization of activities of the Security Council of the Republic of Kazakhstan.

Chapter 1. General provisions

Article 1. Legal status and basis of activities of the Security Council

1. The Security Council of the Republic of Kazakhstan (further - the Security Council) is the constitutional body formed by the President of the Republic of Kazakhstan and coordinating carrying out single state policy in the field of ensuring national security and defense capability of the Republic of Kazakhstan for the purpose of preserving internal political stability, protection of the constitutional system, the state independence, territorial integrity and national interests of Kazakhstan on the international scene.

2. The president of the Republic of Kazakhstan is President of the Security Council.

3. The structure of the Security Council is created by the President of the Republic of Kazakhstan.

4. The legal basis of activities of the Security Council is constituted by the Constitution of the Republic of Kazakhstan, this Law, Regulations on the Security Council, other regulatory legal acts of the Republic of Kazakhstan and the international agreements of the Republic of Kazakhstan.

5. The questions of activities of the Security Council which are not settled by this Law are regulated by Regulations on the Security Council.

Article 2. Tasks of the Security Council

1. The main objectives of the Security Council are planning, consideration and assessment of realization of the main directions of state policy in the field of ensuring national security, strengthening of defense capability of the country, law enforcement and law and order.

The Security Council carries out other tasks according to the legislation of the Republic of Kazakhstan and decisions of the President of the Security Council.

2. For accomplishment of the tasks assigned to it the Security Council develops and makes relevant decisions and recommendations, coordinates activities of state bodies and organizations.

Article 3. Functions of the Security Council

Functions of the Security Council are:

1) coordination of activities of state bodies and organizations for implementation of actions in the field of ensuring national security and the international line items of the country, defense capability of the state, legality and law and order;

2) coordination of activities of law enforcement and special state bodies for the purpose of ensuring national security and implementation of decisions of the Security Council;

3) monitoring and assessment of condition of execution of strategic documents of the state in the most important directions of development of the country;

4) the complex analysis and assessment of state programs, bills, important foreign policy and other state and significant initiatives, and also development of the situation in the country, world and regional tendencies, forecasting of internal and external threats of national security, development of offers and determination of measures for their prevention and neutralization;

5) hearing of the annual report of the Government of the Republic of Kazakhstan on results and the main activities in the field of ensuring national security, defense capability, law and order;

6) hearing of the first heads of state bodies concerning realization of state policy in the field of ensuring national security and defense capability of the country;

7) the organization of control of execution of the laws of the Republic of Kazakhstan in the field of ensuring national security, defense capability and law and order, including behind effective use of the funds allocated for these purposes;

8) discussion of the candidates recommended for appointment to positions of the first heads of the central and local executive bodies of areas, the cities of republican value and the capital, and also state bodies directly subordinate and accountable to the President of the Republic of Kazakhstan;

9) other functions according to the legislation of the Republic of Kazakhstan.

Chapter 2. Organization of activities of the Security Council

Article 4. Powers of the President of the Security Council

President of the Security Council:

1) performs management of activities of the Security Council;

2) convenes meetings and the operational meetings of the Security Council;

3) gives instructions to members of council of Safety;

4) is approved by Regulations on the Security Council;

5) No. 106-VII ZRK is excluded according to the Law of the Republic of Kazakhstan of 07.02.2022

6) issues the acts, including normative legal nature relating to activities of the Security Council;

7) performs other powers, stipulated by the legislation the Republic of Kazakhstan.

Article 5. Powers of members of council of Safety

Members of council of Safety:

1) participate in meetings and the operational meetings of the Security Council, in discussion and vote in case of adoption of decisions by the Security Council concerning the agenda;

2) within the competence provide accomplishment of decisions of the Security Council, coordinate and control accomplishment of relevant decisions of the Security Council and the operational meetings of the Security Council;

3) is performed by other powers according to Regulations on the Security Council, decisions of the Security Council and orders of the President of the Security Council.

Article 6. Forms of activities and decision of the Security Council

1. The Security Council performs the activities in the form of meetings and the operational meetings, and also in other forms determined by Regulations on the Security Council.

2. Meetings of the Security Council are held under the chairmanship of the President of the Security Council or one of members of council of Safety under authorization of the Chairman. Frequency of holding meetings of the Security Council is determined by the President of the Security Council.

3. Meetings of the Security Council are competent in the presence of at least two thirds of his members. Delegation by members of council of Safety of the powers to other persons is not allowed.

4. Decisions of the Security Council are made by a simple majority vote from total quantity of the present members of council of Safety. In case of equality of votes the voice of the chairman is decisive.

5. Decisions of the Security Council become effective after approval by the President of the Security Council, if necessary they are implemented by acts of the President of the Republic of Kazakhstan.

6. Decisions of the Security Council and the President of the Security Council are obligatory and are subject to strict execution by state bodies, organizations and officials of the Republic of Kazakhstan.
