About approval of the Regulations on the Advisory committee on transport and infrastructure

According to Items 7 and 44of the Regulations on the Eurasian economic commission (appendix №1 to the Agreement on the Eurasian Economic Union of May 29, 2014) the Board of the Eurasian economic commission decided:

1. Approve the enclosed Regulations on the Advisory committee on transport and infrastructure.

2. Declare invalid Item 2 of the Decision of Board of the Euroasian economic commission of June 7, 2012 №70 "About the Advisory committee on transport and infrastructure".

3. Ask the governments of state members of the Eurasian Economic Union to submit in the Eurasian economic commission within 15-day term from the date of the introduction of this Decision owing to the candidate for inclusion in structure of Advisory committee for transport and infrastructure.

4. This Decision becomes effective after 30 calendar days from the date of its official publication.

Regulations on the Advisory committee on transport and infrastructure

I. General provisions

1. The advisory committee on transport and infrastructure (further – Committee) is created under Board of the Euroasian economic commission (further – the Commission) according to Items 7 and 44of the Regulations on the Euroasian economic commission (appendix № 1 to the Agreement on the Eurasian Economic Union of May 29, 2014) for the purpose of preparation of offers and recommendations for the Commission on questions of transport and infrastructure.

2. The committee in the activities is guided by the Agreement on the Eurasian Economic Union of May 29, 2014, other international treaties and acts constituting the right of the Eurasian Economic Union (further – the Union), the Regulations of work of the Euroasian economic commission approved by the Decision of the Supreme Euroasian economic council of December 23, 2014 №98, and also this Provision.

II. Functions of Committee

3. The committee within the competence performs the following functions:

a) considers questions on which the Board of the Commission shall hold before decision making by the Commission consultations within Committee;

b) performs preparation of offers and recommendations for the Commission on the following questions:

forming and realization of the coordinated (approved) transport policy of state members of the Union (further – state members), including within accomplishment of actions plans ("road maps") on its realization;

execution monitoring by state members of international treaties and acts in the field of the transport and infrastructure constituting the right of the Union;

rapprochement of transport systems of state members, forming of single transport space of the Union and creation of the total market of transport services;

enhancement and harmonization of the legislation of state members in the field of transport and infrastructure, and also enhancement of the right of the Union according with the Main directions and stages of realization of the coordinated (approved) transport policy of state members of the Eurasian Economic Union approved by the Decision of the Highest Eurasian Economic Union of December 26, 2016 №19;

removal of obstacles (barriers, restrictions, withdrawals) influencing functioning of the domestic market of the Union in the field of transport and infrastructure;

the research works planned to development in the field of transport;

project development of international treaties within the Union and acts of bodies of the Union in the field of transport and infrastructure;

c) prepares offers for other consultative bodies and departments of the Commission in case of consideration of the questions affecting the sphere of transport by them;

d) performs other functions within the competence.

III. Structure of Committee

4. Under Committee the following subcommittees are created:

subcommittee on road transport and road economy;

subcommittee on water transport;

subcommittee on civil aviation;

subcommittee on rail transport;

subcommittee on infrastructure and logistics.

For ensuring the functions specified in Item 3 this provision, Committee other subcommittees can be created.

5. Subcommittees are created on permanent basis, as a rule, on industry sign, and are working bodies of Committee.

6. By committee working groups for the solution of questions in the directions it activities can be created.

7. The operating procedure of subcommittees and working groups is determined by Committee.

8. The structure of Committee is created of deputy managers of authorized bodies of state members within which competence questions of regulation of the sphere of transport and infrastructure are, and also of authorized representatives of public authorities of state members (on the urovnena is lower than the department director (head of department)).

According to the offer of state members of Committee representatives of business communities, scientific and public organizations, other independent experts can be included.

9. The structure of Committee affirms the order of Board of the Commission.

10. Structures of subcommittees and the working groups on the offer of state members join authorized representatives of public authorities of state members, and also if necessary representatives of business communities, scientific and public organizations, other independent experts.

11. Offers on candidates for inclusion in structure of Committee, its subcommittees and working groups are represented to the Commission by the public authorities of state members authorized on interaction with the Commission.

12. By the invitation of the chairman of Committee or on the proposal of members of the committee the authorized representatives of public authorities, representatives of business communities, public and scientific organizations, other independent experts who are not members of the committee and also officials and the staff of the Commission can also participate in committee meetings.

In working groups independent experts, officials and the staff of the Commission can be involved.

13. Presides over committee meetings and the member of Board of the Commission within whose competence questions of transport and infrastructure are (further – the chairman of Committee) performs the common directorship of its work.

14. Chairman of Committee:

a) directs activities of Committee and will organize work on accomplishment of the tasks assigned to Committee;

b) approves and approves the agenda of committee meeting, determines date, time and the place of its carrying out;
