About approval of the Regulations on the consular fee of Ukraine and the Instruction about procedure for collection of the amounts of the consular fee for making of consular actions, accounting of the amounts of consular receipts and carrying out reconciliations of the actual consular receipts in foreign diplomatic organizations of Ukraine

According to article 57 of the Consular charter of Ukraine approved by the Presidential decree of Ukraine of April 02, 1994 No. 127, I order:

1. Approve enclosed:

Regulations on the consular fee of Ukraine;

The instruction about procedure for collection of the amounts of the consular fee for making of consular actions, accounting of the amounts of consular receipts and carrying out reconciliations of the actual consular receipts in foreign diplomatic organizations of Ukraine.

2. Recognize invalid the order of the Ministry of Foreign Affairs of Ukraine of January 05, 2011 as No. 3 "About approval of the Regulations on the consular fee of Ukraine", the order of the Ministry of Foreign Affairs registered in the Ministry of Justice of Ukraine on January 31, 2011 for No. 131/18869, Ukraine of July 27, 2011 No. 199 "About introduction of amendments to the order of the Ministry of Foreign Affairs of Ukraine of January 05, 2011 No. 3", the order of the Ministry of Foreign Affairs of Ukraine registered in the Ministry of Justice of Ukraine on August 18, 2011 at No. 984/19722, of February 4, 2013 No. 39 "About introduction of amendments to the order of the Ministry of Foreign Affairs of Ukraine of January 05, 2011 No. 3", registered in the Ministry of Justice of Ukraine on February 26, 2013 for No. 316/22848.

3. To department of consular service to provide submission of this order on state registration in the Ministry of Justice of Ukraine according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

4. To management of the general secretariat to bring this order to the attention of the deputy minister concerning the European integration, deputy ministers, the state secretary, heads of structural divisions of the device the MFA, representations the MFA in the territory of Ukraine and foreign diplomatic organizations of Ukraine.

5. To impose control of execution of this order on the State secretary A.I.Zayts.

6. This order becomes effective from the first following after month of its official publication.

Regulations on the consular fee of Ukraine

1. The consular fee is levied for making of the consular actions made abroad and in the territory of Ukraine according to the Consular charter of Ukraine approved by the Presidential decree of Ukraine of April 02, 1994 No. 127.

2. The consular fee make Department of consular service MFA (further - DKS), representations the MFA in the territory of Ukraine (further - Representations), diplomatic representations and consular establishments of Ukraine abroad (further - ZDU).

3. Rates of the consular fee levied for execution of visas to entry into Ukraine and transit through its territory are established by the Rules of execution of visas to entry into Ukraine and transit through its territory approved by the resolution of the Cabinet of Ministers of Ukraine of March 1, 2017 No. 118.

If the foreign state levies for execution of visas to citizens of Ukraine the consular fee which exceeds the size of the tariff charge of the consular fee established by the Rules of execution of visas to entry into Ukraine and transit through its territory approved by the resolution of the Cabinet of Ministers of Ukraine of March 1, 2017 No. 118, ZDU for execution of visas to citizens of such state make the consular fee taking into account the principle of reciprocity in coordination with the MFA.

4. Rates of the consular fee in national currency levied for making of consular actions in the territory of Ukraine by Department of consular service of the Ministry of Foreign Affairs of Ukraine and representative offices of the Ministry of Foreign Affairs of Ukraine in the territory of Ukraine except for of the rates of the consular fee specified in Item 3 this provision are given in appendix 1 to this Provision.

The consular fee can be levied from nonresidents of Ukraine also in any freely convertible currency which concerns to the I group of classification of currencies of the National Bank of Ukraine, on the official rate of the National Bank of Ukraine of national currency of Ukraine to the corresponding foreign currency on the date of the address of making of consular action if other is not stipulated by the legislation.

Terms of making of consular actions in DKS and Representations in regular and urgent procedure are determined the MFA if other is not stipulated by the legislation.

5. Rates of the consular fee in US dollars which is levied for making of consular actions by foreign diplomatic organizations of Ukraine except for of the rates of the consular fee specified in Item 3 this provision and also rates of the consular fee which is levied for making of consular actions by foreign diplomatic organizations of Ukraine which are located in the states in the territory of which euro is legal tender currency (further - the states of the eurozone) are given in appendix 2 to this Provision.

Recalculation in euro the tariff charge of the consular fee determined in US dollars is made on the average official rate of hryvnia to US dollar and euro which establishes the National Bank of Ukraine, for the calendar year preceding year in which approval of rates of the consular fee is provided.

Rates of the consular fee which is levied for making of consular actions of ZDU in euro are determined in integers.

The MFA informs ZDU in the states of the eurozone average cross-rate of US dollar to euro for recalculation rates of the consular fee levied for execution of visas in ZDU established in US dollars.

Heads of the diplomatic representations of Ukraine located in the states of the eurozone approve rates of the consular fee levied for execution of visas in euro using the average cross-rate of US dollar finished the MFA to euro. The copy of the order goes to all consular establishments of Ukraine in the territory of the state of the location for application during making of consular actions.

6. The consular fee for making of consular actions copes ZDU in national currency of the state of the location, state of zone of the responsibility established by DKS (further - the states of zone of responsibility), or at the request of the applicant - in US dollars. In case of permanent essential change of the exchange rate of national currency of the state of the location (the country of zone of responsibility) to US dollar (over 5% within two months) in preliminary coordination about the MFA of ZDU can levy the consular fee only in US dollars.

7. Heads of diplomatic representations of Ukraine (except for the diplomatic representations of Ukraine located in the states of the Eurozone) approve rates of the consular fee, the consular actions levied for making in national currency of the state of the location (the country of zone of responsibility).

In the order on approval of rates of the consular fee which is levied for making of consular actions start date of application of new rates, terms of making of consular actions in regular and urgent procedures are also determined.

Samples of Rates of the consular fee levied for making of consular actions by foreign diplomatic organizations of Ukraine in US dollars and national currency of the state of the location are given in appendix 3 to this Provision.

Recalculation in national currency of the state of the location (the country of zone of responsibility) of the tariff charge of the consular fee determined in US dollars, including the tariff charge levied for execution of visas on the terms of reciprocity is carried out by ZDU on the national currency rate to the US dollar established by the Central (national) Bank of the state of the location (the country of zone of responsibility) in day of approval of rates of the consular fee.

In case of essential difference (more than 7%) between the exchange rate of national currency to the US dollar established by the Central (national) Bank of the state of the location, and the exchange rate of national currency to the US dollar established by commercial bank in which the current bank account of foreign diplomatic organization for transfer of the means received for making of consular actions is opened (further - commercial bank), for the purpose of ensuring completeness of collection of the consular fee use of the exchange rate of national currency to US dollar established by commercial bank is allowed, when implementing recalculation in national currency of the tariff charge of the consular fee determined in US dollars.

Rates of the consular fee which is levied for making of consular actions of ZDU in national currency of the state of the location (the country of zone of responsibility) are determined in integers.
