About approval of the Procedure for preparation and entering into executive bodies or local government bodies of petitions concerning observance of requirements of the land legislation

According to the subitem "an" of part one of Article 15, to Article part two 144, to Articles 187 and 188 of the Land code of Ukraine, the subitem "b" of part one of Article 6, article 10 of the Law of Ukraine "About the state control of use and protection of lands", to the subitem 9 of item 4 and Item 8 of the Regulations on the Ministry of Agricultural Policy and Food of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of November 25, 2015 No. 1119, I order:

1. Approve the Procedure for preparation and entering into executive bodies or local government bodies of petitions concerning observance of requirements of the land legislation which is applied.

2. Declare invalid the order of the Ministry of Agricultural Policy and Food of Ukraine of August 27, 2014 No. 317 "About approval of the Procedure for preparation and entering into executive bodies or local government bodies of petitions concerning observance of requirements of the land legislation", registered in the Ministry of Justice of Ukraine on September 15, 2014 at No. 1126/25903.

3. To provide to department of agrarian policy and agricultural industry in the procedure established by the legislation submission of this order on state registration in the Ministry of Justice of Ukraine.

4. This order becomes effective from the date of its official publication.

5. To impose control of execution of this order on the First Deputy Minister of Agricultural Policy and Food of Ukraine N. Martynyuk.

Procedure for preparation and entering into executive bodies or local government bodies of petitions concerning observance of requirements of the land legislation

I. General provisions

1. This Procedure establishes the procedure of preparation and entering into executive bodies or local government bodies of petitions concerning observance of requirements of the land legislation.

2. The petition - the written appeal to executive body or local government body about need of taking measures to ensuring compliance with the land legislation.

3. On behalf of Public service of Ukraine concerning geodesy, cartography and the inventory and its territorial authorities (further - specially authorized bodies) have the right to introduce the petition in executive bodies or local government bodies the Chief state inspector of Ukraine in the field of the state control of use and protection of lands and observance of requirements of the legislation of Ukraine on protection of lands and their deputies, the chief state inspectors in the field of the state control of use and protection of lands and observance of requirements of the legislation of Ukraine on protection of lands in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol and their deputies.

On behalf of the State ecological inspection of Ukraine the Chief state inspector of Ukraine on protection of the surrounding environment, the chief state inspectors of Ukraine on protection of the surrounding environment, the state inspectors of Ukraine on protection of the surrounding environment have the right to introduce the petition in executive bodies or local government bodies (further - specially authorized bodies).

4. Requirements of this Procedure extend on:

the state inspectors in the field of the state control of use and protection of lands and observance of requirements of the legislation of Ukraine on protection of lands of specially authorized bodies (further - the state inspectors) - regarding observance of established procedure of preparation and introduction by them (deliveries, the directions) petitions, ensuring their accounting and control over the implementation of the requirements specified in petitions;

the state inspectors of Ukraine on protection of the surrounding environment regarding introduction of petitions for the right to use termination by the parcels of land according to the procedure of part two of Article 144 of the Land code of Ukraine;

executive bodies, local government bodies - regarding consideration and fulfillment of requirements of the petitions introduced by specially authorized bodies, reductions of own decisions in compliance with requirements of the current legislation, acceptance according to the law of measures for the termination of violations of the land legislation.

II. Bases for introduction of the petition

1. The petition concerning observance of requirements of the land legislation (further - the petition) which form is given in appendix 1 to this Procedure, is introduced in executive bodies or local government bodies in case of identification of violations of requirements of the land legislation.

2. Petitions are introduced on the questions determined by the Item of part one of article 6 of the Law of Ukraine "About the state control of use and protection of lands".

III. Registration and introduction of petitions

1. The petition is drawn up on the form of the relevant specially authorized body in duplicate.
