About approval of Rules of maintaining the single inventory of the state fund of subsoil and Rules of provision of information on the state stock accounting of minerals to state bodies
According to Items 6 and 7 of article 72 of the Code of the Republic of Kazakhstan of December 27, 2017 "About subsoil and subsurface use" I ORDER:
1. Approve:
1) Rules of maintaining the single inventory of the state fund of subsoil, according to appendix 1 to this order;
2) Rules of provision of information on the state stock accounting of minerals to state bodies, according to appendix 2 to this order.
2. Recognize invalid some orders of the Minister of investments and development of the Republic of Kazakhstan, according to appendix 3 to this order.
3. To provide to committee of geology and subsurface use of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;
3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;
4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2) and 3) this Item.
4. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.
5. This order becomes effective since June 29, 2018 and is subject to official publication.

Appendix 1
to the Order of the Minister of investments and development of the Republic of Kazakhstan of May 25, 2018 No. 393
1. These rules of maintaining the single inventory of the state fund of subsoil (further - Rules) are developed according to Item 7 of article 72 of the Code of the Republic of Kazakhstan "About subsoil and subsurface use" (further - the Code) and determine procedure for maintaining the single inventory of the state fund of subsoil (further - the single inventory).
2. Maintaining the single inventory is performed by authorized body on studying of subsoil for the purpose of accounting and condition of mineral resources of the Republic of Kazakhstan.
3. The single inventory, according to Item 1 of article 72 of the Code, contains:
1) data on the state accounting of minerals, their manifestations and on objects of space of subsoil;
2) data on the subsoil plots provided in use for geological studying of subsoil, investigations and (or) hydrocarbon production, solid minerals, popular minerals, use of space of subsoil, and also prospecting;
3) data on the liquidated facilities for production of hydrocarbons and solid minerals, popular minerals, prospecting, burials of hazardous substances, radioactive waste and dumping of sewage into subsoil;
4) data on the state accounting of the operating subjects to placement of technogenic mineral educations.
4. The state accounting of minerals, according to Item 2 of article 72 of the Code, contains data on mineral deposits, quantity and quality of the main and together with them the lying minerals containing in them components, mining, hydrogeological, ecological and other characteristics of the field having industrial value, their placement, degree of study, extent of industrial development, production, losses and security of the industry with minerals and also about changes in assessment of resources and inventories of minerals for accounting year as a result of their production or revaluation of resources and (or) inventories of minerals.
On each show of minerals geological and economic data on forecast (perspective) resources of minerals, hydrogeological and other characteristics of their manifestation are fixed.
Data on objects of space of subsoil include data on coordinates of arrangement and characteristics of cavity of subsoil, on possibility of placement in them production, economic and industrial facilities and substances, implementation in them engineering procedures.
5. On each subsoil plot, according to Item 3 of article 72 of the Code, the identification characteristics allowing to determine the subsoil plot in space borders, its sizes and location, the information about the subsoil user, documents based on which the right of subsurface use, data on pledge of the right of subsurface use, the reporting, geological information is granted are fixed.
6. Plans of placement of the liquidated production facilities, acts of liquidation and data on mitigation of consequences of production belong to data on the liquidated facilities for production of hydrocarbons, solid minerals, popular minerals, according to item 4 of article 72 of the Code.
7. Forming of data of the single inventory, according to Item 5 of article 72 of the Code, is provided for the account:
1) carrying out the state geological studying;
2) monitoring of subsoil;
3) the reporting, represented by subsoil users;
4) refusal of part or all site on investigation, mining and use of space of subsoil;
5) acts of mitigation of consequences of transactions on investigation, production of solid minerals and use of space of subsoil;
6) revocations of licenses on exploration and production of minerals and (or) the license for spaces of subsoil.
8. For accounting of characteristic geological, mining, hydrogeological, ecological parameters by subsoil users, irrespective of patterns of ownership and sources of financing passports in forms according to appendices 1, of 2, of 3, of 4, of 5, of 7, of 8, of 9, of 10, 11 to these rules on the following types of objects are constituted:
1) the fields with resources and inventories of minerals included in the state accounting about changes in assessment of resources and inventories of minerals;
2) fields which resources and inventories of minerals are struck off the state register about changes in assessment of resources and inventories of minerals;
3) geologically and spatially the isolated sites of large-scale deposits;
4) shows of solid minerals for which availability at least of one body (deposit) of minerals is established;
5) the fields of all types of underground waters and also expressed as mnogodebitny springs, fields of therapeutic muds;
6) perspective sites of search works on which the subsurface use rights to geological studying of subsoil and to investigation were provided;
7) oil, gas-manifestations;
8) technogenic mineral educations;
9) objects of space of subsoil.
9. Passports of objects are constituted no later than one month from the moment of approach of one of the following cases in time:
1) detection as a result of exploration works of fields of shows of minerals;
2) approval or reapproval of inventories of minerals in state commission on inventories of the Republic of Kazakhstan (further - GKZ);
3) approval or reapproval of inventories of minerals in the central commission on inventories of the Republic of Kazakhstan;
4) approval or reapproval of inventories of minerals in state commission on examination of subsoil of the Republic of Kazakhstan;
5) creation of the report of kompententny person on the Kazakhstan code of the public reporting on results of exploration works, mineral resources and mineral inventories (further - KAZRC);
6) completion of prospecting works on the license to use of space of subsoil;
7) annually, in cases of warehousing of waste in case of development of fields, mineral processing and metallurgical conversion of mineral raw materials.
10. Passports are constituted in triplicate. Two copies of the passport go to territorial subdivision of authorized body on studying of subsoil (further - territorial subdivision), the third copy is stored by the subsoil user.
When warehousing technogenic mineral educations (further - TMO), the subsoil user constitutes the passport in four copies, it is represented annually for the previous calendar year no later than the April 30 passing for accounting year: two copies in territorial subdivision, the third copy in authorized body in the field of environmental protection, the fourth copy are stored by the subsoil user.
When warehousing TMO from the overburden and/or containing breeds put from the popular minerals assumed to use for the purpose of realization, the passport is constituted in form according to appendix by 11-1 subsoil user in triplicate: two copies in territorial subdivision, the third copy are stored by the subsoil user.
11. The territorial subdivision after verification of the passport sends one copy to the national operator on collection, storage, processing and provision of geological information.
12. When warehousing TMO on the site according to the license of space of subsoil, passports are given both on TMO and on space of subsoil.
13. In case of identification as a result of exploration works on the subsoil plot of shows of underground waters by subsoil users, irrespective of patterns of ownership and sources of financing of works, accounting cards in forms according to appendices 12, of 13, 14 to these rules are constituted.
14. In case of identification as a result of exploration works on the subsoil plot of auras of dispersion of geochemical elements, geophysical anomalies, geophysical structures, accounting leaves in form according to appendix 15 to these rules and the list of geophysical (geochemical) anomalies (structures) recommended for check in form according to appendix 16 to these rules are constituted.
15. Accounting leaves and (or) accounting cards are constituted by the subsoil user in triplicate, from them: two go to territorial subdivision, the third copy is stored by the subsoil user.
16. The territorial subdivision after check, sends one copy of accounting leaf and (or) accounting card to the national operator on collection, storage, processing and provision of geological information.
17. The national operator on collection, storage, processing and provision of geological information introduces the arrived passports, accounting leaves and accounting cards in the single inventory and provides:
1) collection, accounting, systematization and storage of materials;
2) entering into the automated system of data processing of the single inventory.
18. Inclusion of data of the state accounting on changes in assessment of resources and inventories on minerals in the single inventory is made by the national operator on collection, storage, processing and provision of geological information annually till September 1 of the year following after accounting year.
About changes in assessment of resources and inventories join in the state accounting:
1) the resources and (or) inventories of all types of minerals reconnoitered in subsoil of the Republic of Kazakhstan;
2) data of production and losses of minerals in subsoil in case of operation of fields;
3) the inventories of minerals which are earlier included in the state balance.
19. On solid minerals the state stock accounting of GKZ estimated on classifications and the KAZRC standard is conducted separately.
20. The basis for inclusion in the state stock accounting of hydrocarbons or the site of underground waters is the positive conclusion of state examination of subsoil.
21. Write-off of the resources got, and also lost in the course of production and (or) inventories of minerals is made by their complete removal from accounting based on forms of the geological reporting which is based on materials of primary accounting.
22. Not confirmation of resources and (or) balance sheet inventories of minerals in the course of further exploration works, or operation, within twenty five percent from inventories of industrial categories, is drawn up by the subsoil user independently, and in case of non-confirmation of resources and (or) inventories with minus sign, exceeding twenty five percent from inventories of industrial categories, amending the state stock accounting is allowed in the presence of the conclusion of state examination about profitability of development of explored reserves of minerals or the report of the competent person prepared according to KAZRC.
Write-off of inventories of the minerals which lost industrial value, inexpedient to working off for the technical and economic or mining reasons, exceeding normative errors not of confirmation during the subsequent exploration works and working off, is performed based on state examination of subsoil or the report of the competent person prepared according to KAZRC.
In case of liquidation or preservation of the field write-off or transfer of the remained inventories in off-balance inventories or resources which use is at the moment economically inexpedient or technically and is technologically impossible, but which can be transferred further to balance sheet (profitable) inventories (mineral inventories), is performed based on state examination of subsoil or the report of the competent person prepared according to KAZRC.
23. The state TMO transferred to private property according to Item 24 of article 278 of the Code are subject to write-off from the state stock accounting of minerals.
24. Annual state stock accounting of the field as a result of their production, losses in case of production, and also in case of revaluation of resources and (or) inventories of minerals, geological and economic data on perspective mineralization for accounting year is based on the reporting under the extracted minerals, and also the provided data on forms according to appendices 11-1, 17, of 18, of 19, of 20, of 21, of 22, of 23, of 24, of 25, of 26, of 27, of 28, to these rules no later than April thirtieth every year in time.
25. The state account is kept by each type of mineral in terms of measurements, according to appendix 29 to these rules.
26. In appendices 1, of 2, of 3, of 5, of 6, of 7, of 8, of 9, of 10, of 11, 12 it is specified geographical coordinates of angular points of contours and the center of objects. In appendix 4 it is specified geographical coordinates of the center of ore occurence.
