About application of transplantation of anatomic materials of the person

Section I General provisions

Article 1. Determination of terms

1. In this Law the terms below are used in such value:

anatomic materials - bodies (their part), fabrics, anatomic educations, cells of the person or animal, fetalny materials of the person;

autotransplantation - change to the person of own anatomic material;

bioimplants - the medical products, products of medical appointment made of anatomic materials of the person;

close relatives and family members - the husband, the wife, the father to have, the stepfather, the stepmother, the son, the daughter, the stepson, the stepdaughter, the brother, the sister, the cousin, the cousin, the native aunt, the native uncle, the native nephew, the native niece, the grandfather, the grandmother, the great-grandfather, the great-grandmother, the grandson, the granddaughter, the great-grandson, the great-granddaughter, the adoptive father or adopted, the guardian or the custodian, person which is under guardianship or custody and also faces which jointly live are connected by general life and have the mutual rights and obligations, including persons who jointly live, but are not in scrap;

crew of withdrawal of anatomic materials of the person - group of health and other workers of healthcare institution, bureau of forensic medical examination or other subjects of managing which according to the legislation have the right to perform such activities which are created according to the order of the head for withdrawal, storage, preparation for transportation and/or transportation of anatomic materials of the person for their subsequent transplantation and/or production of bioimplants;

withdrawal of anatomic materials - surgery, other medical intervention as a result of which anatomic materials of the person for transplantation and/or production of bioimplants turn out;

haematopoietic stem cells - anatomic materials of the person in the form of cages which contain in blood and marrow of the person and are used for transplantation;

The state information system of transplantation of haematopoietic stem cells - the electronic automated information and telecommunication system intended for collection, registration, accumulating, storage, processing, adaptation, change, updating, use, distribution (distribution, transfer), depersonalizations and destructions of information on the physical person and other information determined by the law, stipulated by the legislation, and also for information support of decision making concerning the transplantation of anatomic materials of the person in the form of haematopoietic stem cells which is stored in the information resources registered and located in Ukraine;

the activities connected with transplantation - the medical services in withdrawal of anatomic materials at living donors, to withdrawal of anatomic materials at donor corpse performed by healthcare institutions, bureau of forensic medical examination or other subjects of managing which according to the legislation have the right to perform such activities, and/or services in storage and transportation of the anatomic materials of the person intended for transplantation, to withdrawal of anatomic materials at donor corpse for production of bioimplants, storage and transportation of such materials, transplant coordination, and also activities for ensuring functioning of information systems and registers in the sphere of transplantation;

the donor of anatomic materials of the person - the living donor or donor corpse from which in the procedure established by this Law anatomic materials for transplantation and/or production of bioimplants are withdrawn;

donorship of anatomic materials - provision by the donor of anatomic materials to other person in case of life (lifetime donorship) or withdrawal of anatomic materials of the person at donor corpse (posthumous donorship) for transplantation and/or production of bioimplants;

donor corpse - the dead at whom in the procedure established by this Law consent to withdrawal from his body of anatomic materials for transplantation and/or production of bioimplants is received;

Single state information system of organ and tissue transplantation - the electronic automated information and telecommunication system intended for collection, registration, accumulating, storage, processing, adaptation, change, updating, use, distribution (distribution, realization, transfer), depersonalization and destruction of information on the physical person and other information determined by the law, stipulated by the legislation, and also for implementation of the automated objective and impartial distribution of anatomic materials of the person, determination of couples the donor recipient, stored on the information resources registered and located in Ukraine;

the living donor - full age capable physical person which voluntarily agreed to withdrawal at it anatomic materials for transplantation, and in the case determined by this Law person age up to 18 years, consent to withdrawal at which haematopoietic stem cells is provided to them personally and (or) his parents or other legal representatives;

implantation - the ad hoc method of treatment consisting in change to the person of bioimplants, ksenoimplantat and artificially made substitutes of bodies;

immunological compatibility - genetically caused compatibility of anatomic materials of various persons which is determined by carrying out laboratory researches according to industry standards in health sector;

consultation of doctors - meeting of doctors of one or several specialties which is convened for determination of need of the patient for treatment by method of transplantation, availability or absence to it medical indications and possibility of application of such method of treatment, and also for determination of the state of health of the living donor, possibility of withdrawal at the living donor of anatomic material for its further transplantation;

ksenoimplantata - the medical products made of anatomic materials of animals are also used for implantation;

the leaf (list) of expectation - the list of the recipients staying on the registry in healthcare institution for the purpose of application of transplantation by it which form and procedure for maintaining affirm the central executive body which provides forming and implements and realizes state policy in health sector;

body - the separate, viable part of body of the person formed by different fabrics which keeps the structure the vaskulyarizirovana also has capability to perform physiological functions with the considerable level of autonomy;

cross donorship - exchange of compatible donors living immunological between recipients;

the died (dead) - person whose condition is determined as irreversible death according to the law;

the potential donor - the dead concerning whom there are medical prerequisites (absence of diseases or conditions which make impossible withdrawal of anatomic materials of the person) for extraction of anatomic materials, but are not received transplant coordinator in the procedure for the data established by this Law about possibilities (consent) of withdrawal of anatomic materials from his body for transplantation and/or production of bioimplants;
