1. Approve the enclosed instruction for creation of project documents for geological studying of subsoil.

2. To provide to committee of geology and subsurface use of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2) and 3) this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective since June 29, 2018 and is subject to official publication.

Instruction for creation of project documents for geological studying of subsoil

Chapter 1. General provisions

1. This Instruction for creation of project documents for geological studying of subsoil (further – the Instruction) is developed according to Item 3 of article 88 of the Code of the Republic of Kazakhstan of December 27, 2017 "About subsoil and subsurface use" (further – the Code) and is intended for subsoil users, the performing transactions on geological studying of subsoil.

2. Project documents for carrying out transactions on geological studying of subsoil are:

1) plan of geological studying;

2) the project of search and estimative works on underground waters.

3. The plan of geological studying is developed for carrying out geological film-making and (or) geophysical works.

The project of search and estimative works on underground waters is developed for carrying out search and assessment of fields and sites of underground waters.

4. Project documents on geological studying of subsoil are developed and affirm the subsoil user.

5. The structure, types, methods and methods of works on geological studying, amounts and terms of their carrying out are determined in project documents by the subsoil user independently according to this Instruction.

6. In case of change of types, methods and (or) methods of planned activities on geological studying of subsoil, and also their amounts the subsoil user makes corresponding changes to project documents and represents them to authorized body on studying of subsoil.

If according to the ecological legislation of the Republic of Kazakhstan these changes require conducting the state environmental assessment, the changed project documents on geological studying are submitted to authorized body on studying of subsoil after receipt of the positive conclusion of the state environmental assessment.

Chapter 2. Scheduling of geological studying

7. In respect of geological studying the structure, types, methods and methods of geological film-making and (or) geophysical works, approximate amounts, the territories and terms of carrying out such works during the three-year period are described.

8. The plan of geological studying consists of the project documentation and the estimate. The name of the project is appropriated to geological task, and reflects the name of object of exploration works.

9. On each object of subsurface use on which the geological task is issued the single project documentation providing all necessary types of the geological film-making and (or) geophysical works and the works accompanying them entering projectible complex of researches is developed.

10. The plan of geological studying consists of the following Sections:

1) geological task;

2) introduction;

3) physiographic characteristic of the area of works;

4) the overview, the analysis and assessment of earlier conducted researches;

5) geological characteristic of the area of works;

6) structure, types, methods and methods of works on geological studying;

7) the expected results of works;

8) labor protection and safe engineering;

9) environmental protection;

10) the list of the used sources;

11) estimate part.

11. The Section "Geological Task" reflects the purpose of carrying out geological studying of subsoil and contains:

1) purpose of works, borders of the territory of the site and key estimative parameters;

2) geological tasks, sequence and main methods of their decision;

3) the expected results and terms of performance of works (with indication of forms of reporting documentation and instances to which they are represented).

12. The geological task affirms person which is drawing up the license for geological studying of subsoil.

13. The Section "Introduction" contains:

1) the information about person which is drawing up the license for geological studying of subsoil, including the name, legal address of physical person or legal entity;

2) purpose of carrying out geological studying;

3) reasons for the current and perspective demand of geological studying;

4) terms of the beginning and completion of works.

14. In the Section "Physiographic Characteristic of the Area of Works" the geographical (administrative) location of the area of works (the area within which geological tasks shall be solved) is specified. Nature of relief, absolute marks and relative excesses, climatic features, density of population and the characteristic of settlements, development of transport infrastructure, communications and other data influencing the organization and cost of works are briefly lit.
