1. Approve the enclosed Rules of financing of research, scientific and technical and (or) developmental works as subsoil users during hydrocarbon production and uranium.

2. To provide to department of subsurface use of the Department of Energy of the Republic of Kazakhstan in the procedure for the Republic of Kazakhstan established by the legislation:

1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this joint order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this joint order the direction it the copy on official publication in periodic printing editions;

4) placement of this joint order on Internet resource of the Department of Energy of the Republic of Kazakhstan after state registration;

5) within ten working days after state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2), 3) and 4) of this Item.

3. To impose control of execution of this joint order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This joint order becomes effective since June 29, 2018 and is subject to official publication.

Rules of financing of research, scientific and technical and (or) developmental works as subsoil users during hydrocarbon production and uranium

Chapter 1. General provisions

1. These rules of financing of research, scientific and technical and (or) developmental works as subsoil users during hydrocarbon production and uranium (further – Rules) are developed according to the subitem 2) of Item 1 of Article 129 and the subitem 2) of Item 1 of article 178 of the Code of the Republic of Kazakhstan "About subsoil and subsurface use" (further - the Code) and determine procedure for financing of research, scientific and technical and (or) developmental works as subsoil users during hydrocarbon production and uranium.

2. In these rules the following concepts are used:

1) result of scientific and (or) scientific and technical activities - the new knowledge or decisions received by proper scientific methods and means during the course of performance of scientific and (or) scientific and technical activities and fixed on any information carrier implementation of scientific developments and technologies in production, and also models, prototypes, samples of new products, materials and substances;

2) subjects of scientific and (or) scientific and technical activities - the physical persons and legal entities performing scientific and (or) scientific and technical activities;

3) research work - the work connected with scientific search, carrying out researches, experiments for the purpose of expansion available and receipts of new knowledge, checks of scientific hypotheses, establishments of patterns of development of the nature and society, scientific generalization, scientific reasons for projects;

4) scientific research - the applied, basic, strategic scientific research performed by subjects of scientific and (or) scientific and technical activities within research, developmental and technological works, proper scientific methods and means for the purpose of achievement of results of scientific and (or) scientific and technical activities;

5) scientific activities - the activities directed to studying of surrounding reality for the purpose of detection of the properties, features and patterns inherent in the studied objects, the phenomena (processes) and use of the gained knowledge in practice;

6) scientific and technical activities - the activities directed to obtaining and use of new knowledge in all fields of science, the equipment and production for the solution of technological, design, economic and socio-political and other tasks, ensuring functioning of science, technology and production as single system, including development of the specifications and technical documentation necessary for carrying out these researches;

7) developmental works - complex of the works performed during creation or upgrade of products, development of design and technological documentation on prototypes, production and testing of prototypes and useful models;

8) the state accounting of implementable scientific, scientific and technical projects and programs, and reports on scientific and (or) scientific and technical activities – the accounting performed by authorized body in the field of science for the purpose of forming of national resource of scientific and technical information and monitoring of dynamics of scientific and technical capacity of the Republic of Kazakhstan according to the legislation of the Republic of Kazakhstan in the field of science;

9) National welfare fund (further – Fund) – the national managing holding determined according to the Law of the Republic of Kazakhstan "About national welfare fund".

3. Financing of scientific research is performed by the subsoil user annually during the production period, since second year.
