According to article 11 of the Law of Ukraine "About privatization of the state-owned and municipal property" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for representation of management by authorized bodies to state bodies of privatization of offers on inclusion of objects of the right of state-owned property in the list of objects, privatizeable it (is applied).

2. Declare invalid the resolution of the Cabinet of Ministers of Ukraine of May 17, 2012 No. 384 "Some questions of inclusion of objects of the right of state-owned property in the list of objects, privatizeable" (The Official Bulletin of Ukraine, 2012, No. 37, the Art. 1380).

Procedure for representation of management by authorized bodies to state bodies of privatization of offers on inclusion of objects of the right of state-owned property in the list of objects, privatizeable

1. This Procedure establishes the procedure of representation by authorized bodies of management of state-owned property or corporate laws which control they exercise (further - authorized bodies), to state bodies of privatization of offers on inclusion of objects of the right of state-owned property in the list of objects, privatizeable.

2. Offers on inclusion of objects of the right of state-owned property in the list of objects, privatizeable (further - subjects to privatization), shall represent authorized bodies of management quarterly to the first with which quarter, to state bodies of privatization in form according to appendix together with conclusions concerning the predicted amount of receipt of funds from privatization of the offered lists of subjects to privatization and the forecast of social and economic consequences of privatization begins.

3. Are applied to the specified offers:

1) concerning single property complexes of the state companies, their structural divisions (further - the companies):

the copy of the charter (provision) of the company certified by authorized body of management together with changes in it (in case of availability);

copies of balances of the company for the last accounting year and/or on the last reporting date;

copies of reports on financial results of the company for the last accounting year and on the last reporting date (in case of availability);

the copy of the relevant resolution of economic court on opening of proceeedings about bankruptcy of the company (in case of availability);

the copy of the decision of authorized body of management on the termination of the company as a result of reorganization or liquidation (in case of availability);

the offer on transformation of the company to joint-stock company in the course of privatization (in case of feasibility);

the list of real estate which is part of single property complex of the company, with indication of the areas;

documents of title and/or other real estate documents and the parcels of land of the company (in case of availability);

the list of property, not privatizeable as a part of the company of subjects to civil protection, housing stock;

2) concerning blocks of shares (shares):

the copy of the charter of economic society certified by authorized body of management together with changes in it (in case of availability);

copies of balances of economic society for the last accounting year and/or on the last reporting date;

copies of reports on financial results of economic society for the last accounting year and on the last reporting date (in case of availability);

the copy of the relevant resolution of economic court on opening of production in the case of bankruptcy of economic society (in case of availability);

the account statement in securities of the depositor which is issued by depository institution and confirms availability of the rights to securities of the subject of management of the state share in the authorized capital of economic society;

3) concerning separate property, subjects to welfare appointment, objects of construction in progress, the preserved objects:

documents of title and/or other real estate documents and the parcels of land (in case of availability);

offers concerning the term of preserving profile of activities or possibility of reshaping (for subjects to welfare appointment);

4) for all types of property (except objects of construction in progress, the preserved objects):

the list of the signed lease agreements concerning object (parts of object) which is offered for inclusion in the list in which are specified: details of lease agreements, effective period of lease agreements, names of lessees, the areas of leased property, the monthly rent (in case of availability).

4. The predicted project cost of privatization is determined not below book value (object asset cost). If subject to privatization are shares (share), the predicted cost is determined not below nominal value of the block of shares (shares).

5. The fund of state-owned property gives annually till March 1 and till July 1 to Ministry of Economics, the Ministry of Finance and National Bank the preliminary and specified forecast indicators of receipt of funds from privatization separately on current, following and two next years by the subjects to big and small privatization of state-owned property included in lists, considering the predicted amounts of receipt of funds from their privatization.

6. No. 1312 is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 22.11.2022
