ORDER OF THE GOVERNMENT OF THE RUSSIAN FEDERATION

About standard rates of admissible emissions of radioactive materials and standard rates of admissible dumpings of radioactive materials, and also about issue of permissions to emissions of radioactive materials, permissions to dumpings of radioactive materials

According to Item 9 of article 22 of the Federal law "About Environmental Protection" Government of the Russian Federation decides:

1. Approve the enclosed Rules of development and establishment of standard rates of admissible emissions of radioactive materials, standard rates of admissible dumpings of radioactive materials, and also issues of permissions to emissions of radioactive materials, permissions to dumpings of radioactive materials.

2. Add the list of services which are federal executive bodies, State Atomic Energy Corporation "Rosatom" of the state services, necessary and obligatory for provision, and are provided by the organizations participating in provision of the state services No. 352 approved by the order of the Government of the Russian Federation of May 6, 2011 "About approval of the list of services which are federal executive bodies, State Atomic Energy Corporation "Rosatom" of the state services, necessary and obligatory for provision, and are provided by the organizations participating in provision of the state services, and determination of the amount of payment for their rendering" (The Russian Federation Code, 2011, No. 20, Art. 2829; 2012, No. 14, Art. 1655; No. 36, Art. 4922; 2013, No. 52, Art. 7207; 2014, No. 21, Art. 2712; 2015, No. 50, Art. 7165, 7189; 2016, No. 31, Art. 5031; No. 37, Art. 5495; 2017, No. 8, Art. 1257; No. 28, Art. 4138; No. 32, Art. 5090; No. 40, Art. 5843; No. 42, Art. 6154; 2018, No. 16, Art. 2371), Item 45 of the following content:

"45. Project appraisal of standard rates of admissible emissions of radioactive materials in atmospheric air and (or) the draft of standard rates of admissible dumpings of radioactive materials into water objects regarding their development according to Item 26 of Rules of development and establishment of standard rates of admissible emissions of radioactive materials, standard rates of admissible dumpings of radioactive materials, and also issues of permissions to emissions of radioactive materials, permissions to dumpings of the radioactive materials approved by the order of the Government of the Russian Federation of June 26, 2018 No. 731 "About standard rates of admissible emissions of radioactive materials and standard rates of admissible dumpings of radioactive materials and also about issue of permissions to emissions of radioactive materials, permissions to dumpings of radioactive materials" <*>.".

3. Item 2 of the order of the Government of the Russian Federation of February 15, 2011 No. 78 "About introduction of amendments to some acts of the Government of the Russian Federation concerning implementation of separate powers by the Ministry of Natural Resources and Environmental Protection of the Russian Federation, Federal Nature Management Supervision Service and Federal Service for Environmental, Technological and Nuclear Supervision" (The Russian Federation Code, 2011, No. 9, the Art. 1246) to declare invalid.

4. Permissions to emissions of radioactive materials in atmospheric air and permissions to dumpings of radioactive materials into the water objects issued in accordance with the established procedure by Federal Service for Environmental, Technological and Nuclear Supervision about day of entry into force of this resolution are effective before the expiration of the terms specified in them.

5. This resolution becomes effective since January 1, 2019.

Rules of development and establishment of standard rates of admissible emissions of radioactive materials, standard rates of admissible dumpings of radioactive materials, and also issues of permissions to emissions of radioactive materials, permissions to dumpings of radioactive materials

1. These rules determine procedure for development and establishment of standard rates of admissible emissions of radioactive materials in atmospheric air (further - standard rates of emissions), standard rates of admissible dumpings of radioactive materials into water objects (further - standard rates of dumpings), and also issues of permissions to emissions of radioactive materials in atmospheric air (further - permission to emissions), permissions to dumpings of radioactive materials into water objects (further - permission to dumpings).

2. Development of standard rates of emissions and (or) standard rates of dumpings is performed by the legal entity and (or) the individual entrepreneur operating stationary sources of emissions of radioactive materials in atmospheric air and (or) stationary sources of dumpings of radioactive materials into water objects (further respectively - stationary sources of emissions, stationary sources of dumpings, the job seeker of permission).

3. In case of development of standard rates of emissions and (or) standard rates of dumpings the techniques and (or) methods of development of standard rates of emissions and standard rates of dumpings approved by Federal Service for Environmental, Technological and Nuclear Supervision are applied (further - authorized body).

4. Standard rates of emissions and (or) norms of dumpings are determined concerning radioactive isotopes in element form and in the form of the connections included in the list of pollutants to which measures of state regulation in the field of environmental protection, No. 1316-r approved by the order of the Government of the Russian Federation of July 8, 2015 are applied.

5. Development of standard rates of emissions and (or) standard rates of dumpings is performed:

a) concerning the new and (or) reconstructed objects of economic and other activity put into operation - on the basis of the project documentation on objects with stationary sources of emissions and (or) stationary sources of dumpings;

b) concerning the operating objects of economic and other activity - on the basis of the emissions of radioactive materials in atmospheric air this to inventory count and (or) dumpings of radioactive materials into water objects.

6. Standard rates of emissions and (or) standard rates of dumpings are established by permission to emissions and (or) permission to dumpings in the presence of their approval in accordance with the established procedure of Federal Service for the Oversight of Consumer Protection and Welfare confirming development of standard rates of emissions and (or) standard rates of dumpings according to health regulations.

7. Standard rates of emissions and (or) standard rates of dumpings are established by the permissions to emissions and (or) permissions to dumpings issued by authorized body for the subjects to use of atomic energy included in the list of subjects to use of atomic energy concerning which the regime of constant state surveillance approved by the order of the Government of the Russian Federation of April 23, 2012 No. 610-r is introduced.
