About cooperation in the field of telecommunication and mail service

The government of the Republic of Tajikistan and the Government of the Republic of Armenia, hereinafter referred to as by "Parties",

being guided by aspiration to development of the existing bonds between the people of the Republic of Tajikistan and the Republic of Armenia based on equality in mutually beneficial cooperation

in view of the fact that the bilateral relations in the field of telecommunication and mail service shall be under construction in strict accordance with provisions of acts of Universal Postal Union and recommendations of International union of telecommunication, and also other international treaties which participants are the states of the Parties

considering that interaction and cooperation in the field of communication shall develop on the basis of mutual assistance,

wishing to establish the close legal, economic and technological relations for ensuring smooth functioning of means of communication between the states of the Parties,

agreed as follows:

Article 1

The parties perform cooperation in the field of telecommunication and mail service according to this agreement, the national legal system of the states and the conventional principles and rules of international law, with use of infrastructures of the state operators and companies of electric and mail service.

Article 2

The parties will notify previously each other on all changes in the field of telecommunication and mail service, and also on procedure for mutual calculations for communication services.

Article 3

The parties on mutually advantageous conditions guarantee implementation of free transit through the territories of the states of all types of service of telecommunication, mailings and special communication.

Transit is performed according to the preliminary arrangement and the approved relevant organs of the states of the Parties to route, the schedule and rates.

Article 4

The procedure for exchange of money postal orders between the Republic of Armenia and the Republic of Tajikistan and implementation of mutual payments with cash is determined according to the legislation of the states of the Parties and international treaties which participants are the Republic of Tajikistan and the Republic of Armenia.

Article 5

The calculations and payments following from accomplishment of this agreement will be carried out according to the agreements existing between the states of the Parties.

All settlement on provision of services of communication will be performed on a centralized basis through the relevant services and authorized banks according to the national legal system of the states of the Parties.

Article 6

The parties will not apply to each other the discriminatory measures interfering or complicating activities of administrations of communication of the Parties in the third states and in relevant international organizations.

Article 7

The parties will render each other assistance in the organization of distribution of periodicals of other Party for subscription and at retail in the territory of the state in the amounts approved by contracts and agreements between the states of the Parties or their relevant departments and the organizations.

Article 8

The parties in case of need within the competences will consult concerning use of radio frequencies according to the existing rules and the legislation of the states, international treaties which participants are the states of the Parties, recommendations of International union of telecommunication. Such coordination is performed by exchange of correspondence or signing of free standing agreements.

Article 9

All telecommunications agencies of the Parties participating in provision of services bear equal responsibility to consumers for timely and high-quality servicing. The claim treatment procedure for low-quality work of the international mail service and the international telecommunication channels is determined by acts of Universal Postal Union and recommendations of International union of telecommunication.

Article 10

For exchange of office information and in-house documents between operators, telegraph operators, technicians, post employees of telecommunications agencies the Russian and English languages are used as working languages. Addresses of the mailings and telegrams sent by the states of the Parties are drawn up in the Russian or English languages or Latin letters and the Arab figures.

Texts of telegrams can be accepted and be transferred by Latin letters.

Article 11

In engineering procedures of transfer of interstate messages and information of the Party apply on telecommunications agencies single accounting and reporting time - Moscow (across Greenwich).

Article 12

The parties promote interaction of the systems of operating-technical management according to the operating engineering procedures.

The parties provide priority transmission of messages on means of communication during emergency situations and elimination of their effects.

The parties give mutual aid in case of elimination of effects of accident pomezhgosudarstvenny communication lines.
