being guided also based on the principles containing in the Contract on bases of the interstate relations, friendship and cooperation between the Republic of Uzbekistan and the Russian Federation of May 30, 1992, the Contract on the strategic partnership between the Republic of Uzbekistan and the Russian Federation of June 16, 2004 signed within the Commonwealth of Independent States the Agreement on cooperation in the field of labor migration and social protection of migrant workers of April 15, 1994, the Agreement between the Government of the Republic of Uzbekistan and the Government of the Russian Federation on labor activity and protection of the rights of the migrant workers who are citizens of the Republic of Uzbekistan in the Russian Federation and the migrant workers who are citizens of the Russian Federation in the Republic of Uzbekistan of July 4, 2007
proceeding from need of streamlining and further enhancement of legal regulation of processes of movement of labor power,
wishing to provide protection of the rights and legitimate interests of the migrant workers performing temporary labor activity in the territory of the Russian Federation
recognizing priority of organized set and involvement of citizens of the Republic of Uzbekistan for implementation of temporary labor activity in the Russian Federation before other work arrangements of migrant workers from the Republic of Uzbekistan in the territory of the Russian Federation,
agreed as follows:
This agreement determines procedure and conditions of interaction of the Parties on implementation of organized set and involvement of citizens of the Republic of Uzbekistan for implementation of temporary labor activity in the Russian Federation.
The terms applied in this agreement have the following values:
"temporary labor activity" - the work of the migrant worker in the territory of the Russian Federation based on the signed employment contract performed according to the procedure and on the conditions determined by the legislation of the Russian Federation, and also this agreement;
"the agreement on organized set and attraction" - the agreement signed between the sending organization and the employer about conditions of temporary labor activity within organized set and involvement of migrant workers;
"information and analytical system" - information and analytical system the All-Russian base of vacancies the "Work in Russia" containing information on the Russian employers feeling the need for workers, availability of free workplaces and vacant positions, kind of work, the salary, operating mode, qualification requirements, requirements to education, professional knowledge, skills, work experience, provision of additional social guarantees by the employer to the foreign worker;
"the candidate for employment" - the person who is the citizen of the Republic of Uzbekistan, constantly living in the territory of the Republic of Uzbekistan, aged from 18 years to the age granting the right to national pension on the age determined by the legislation of the Republic of Uzbekistan, addressed to the sending organization for the purpose of employment in the territory of the Russian Federation;
"competent authorities" - public authorities of the states of the Parties which competence includes the solution of the questions connected with implementation of this agreement;
"organized set and attraction" - complex of actions for organized involvement of citizens of the Republic of Uzbekistan for implementation of temporary labor activity;
"the sending organization" - the legal entity of the Republic of Uzbekistan having the power established by the legislation of the Republic of Uzbekistan to perform organized set and attraction;
"employer" - the Russian legal entity, and also the physical person including registered as the individual entrepreneur in accordance with the legislation of the Russian Federation;
"permission" - the document issued by territorial authority of the Ministry of Internal Affairs of the Russian Federation in accordance with the legislation of the Russian Federation and provisions of this agreement, confirming the right of the migrant worker to perform temporary labor activity in the territory of the Russian Federation;
"employment contract" - the agreement signed between the employer and the migrant worker according to the procedure, established by the legislation of the Russian Federation;
"migrant worker" - the person who is the citizen of the Republic of Uzbekistan, constantly living in the territory of the Republic of Uzbekistan, reached 18-year age, underwent selection both legally staying in the territory of the Russian Federation and performing in the territory of the Russian Federation temporary labor activity in the presence of permission.
The competent authorities responsible for implementation of this agreement, are:

Ministry of Internal Affairs of the Russian Federation;
Ministry of Labour and Social Protection of the Russian Federation;
Federal Service for Labour and Employment;
Ministry of Foreign Affairs of the Russian Federation;
Ministry of Education and Science of the Russian Federation;
Ministry of Health of the Russian Federation;
from the Republic of Uzbekistan:
Ministry of Labour of the Republic of Uzbekistan;
The agency concerning external labor migration under the Ministry of Labour of the Republic of Uzbekistan;
Ministry of Health of the Republic of Uzbekistan;
Ministry of Foreign Affairs of the Republic of Uzbekistan;
Ministry of Internal Affairs of the Republic of Uzbekistan.
The parties without delay inform each other on changes of competent authorities through diplomatic channels.
For the purpose of implementation of this agreement competent authorities of the states of the Parties interact among themselves directly and can sign interdepartmental agreements for ensuring more effective implementation of provisions of this agreement.
