AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF UZBEKISTAN AND GOVERNMENT OF THE KYRGYZ REPUBLIC

About delegation of responsibility for servicing of air traffic between the Government of the Republic of Uzbekistan and the Government of the Kyrgyz Republic

The government of the Republic of Uzbekistan and the Government of the Kyrgyz Republic which further are referred to as with the Parties

aiming to promote mutually beneficial relations in the field of servicing of air traffic,

recognizing bodies of servicing of air traffic of the Parties, and wishing to sign this agreement about mutual delegation each other of responsibility for servicing of air traffic in the delegated air spaces,

recognizing that delegation of responsibility on servicing of air traffic does not restrain complete and exclusive sovereignty of each of the Parties over airspace over the territory of the state, exclusive right of each of the Parties to ensure safety and protection of airspace of the state,

for the purpose of determination of legal and organizational order of delegation of responsibility for servicing of air traffic, simplification of accomplishment of flights, and also providing the due service level of air traffic and efficiency of use of opportunities of the Parties in provision of services on servicing of air traffic, and

being guided by provisions of the Chicago convention,

agreed as follows:

Article 1 of Determination

For the purposes of this agreement if other is not stipulated, the terms below listed have the following values:

"The emergency notification"; "Service of the emergency notification" - the Services provided for the notification of the relevant organizations on the aircrafts needing the help of search and rescue services, and rendering necessary assistance to such organizations;

"The state aircrafts" - the aircrafts used by military, Customs and law-enforcement Services of the state;

"The delegated airspace" - the part of airspace which is over the territory and under jurisdiction of the state of one Party, responsibility for servicing of air traffic in which it is delegated to other Party according to this agreement;

"The delegating Party" - the Party which delegates responsibility for Department of Internal Affairs in the delegated airspace to other Party;

"ICAO" - International Civil Aviation Organization;

"Servicing of Air Traffic (SAT)" - the general term meaning the flight and information servicing, the emergency notification, advisory and dispatching servicing of air traffic provided by bodies of Department of Internal Affairs of the Parties in appropriate cases;

"Body of Department of Internal Affairs" - the authority appointed by the relevant Party on which responsibility for Department of Internal Affairs in airspace of the state of this Party is conferred;

"Host party" - the Party which performs and bears responsibility for Department of Internal Affairs in the delegated airspace;

"Agreement" - this agreement, including appendices and amendments and amendments to it;

"Territory" - the overland territories and territorial waters adjoining to them which are under sovereignty, sovereignty, protectorate or the mandate of the state;

"The Chicago Convention" - The convention on international civil aviation open for signing on December 7, 1944 in the city of Chicago, including the Annexes adopted according to article 90 of the Convention and also any changes to the Convention or Appendices brought according to articles 90 and 94 of the Convention in that degree in which these Appendices and changes became effective or are ratified by the states of the Parties.

Article 2 the Delegated air spaces

The Kyrgyz Republic delegates to body of Department of Internal Affairs of the Republic of Uzbekistan responsibility for Department of Internal Affairs within the following airspace:

(1) the Delegated airspace No. 1 - limited in the vertical plane from echelon of flight 150 (4550 m) to echelon of flight 510 (15550 m) and the horizontal plane geographical points with coordinates:

42 degrees of 1,7 of minute of northern latitude and 70 degrees of 56,1 of minute of east longitude in the area of frontiers of the Republic of Uzbekistan and the Kyrgyz Republic;

41 degrees of 18,6 of minute of northern latitude and 71 degrees of 28,6 of minute of east longitude;

41 degrees of 35,1 of minute of northern latitude and 71 degrees of 4,0 of minute of east longitude;

42 degrees of 0,0 of minute of northern latitude and 70 degrees of 56,0 of minute of east longitude;

42 degrees of 1,7 of minute of northern latitude and 70 degrees of 56,1 of minute of east longitude;

(2) the Delegated airspace No. 2 - limited in the vertical plane from the land surface to echelon of flight 510 (15550 m) and the horizontal plane geographical points with coordinates:

40 degrees of 32,4 of minute of northern latitude and 72 degrees of 32,6 of minute of east longitude in the area of frontiers of the Republic of Uzbekistan and the Kyrgyz Republic;

40 degrees of 27,8 of minute of northern latitude and 72 degrees of 26,1 of minute of east longitude;

40 degrees of 31,0 of minute of northern latitude and 72 degrees of 32,0 of minute of east longitude;

40 degrees of 32,4 of minute of northern latitude and 72 degrees of 32,6 of minute of east longitude;

(3) the Delegated airspace No. 3 - limited in the vertical plane from the land surface to echelon of flight 510 (15550 m) and the horizontal plane geographical points with coordinates:

40 degrees of 25,3 of minute of northern latitude and 72 degrees of 21,5 of minute of east longitude in the area of frontiers of the Republic of Uzbekistan and the Kyrgyz Republic;

40 degrees of 11,4 of minute of northern latitude and 71 degrees of 49,5 of minute of east longitude;

40 degrees of 12,0 of minute of northern latitude and 71 degrees of 57,0 of minute of east longitude;

40 degrees of 25,3 of minute of northern latitude and 72 degrees of 21,5 of minute of east longitude;

(4) the Delegated airspace No. 4 - limited in the vertical plane from the land surface to echelon of flight 510 (15550 m) and the horizontal plane geographical points with coordinates:

40 degrees of 10,9 of minute of northern latitude and 71 degrees of 42,1 of minute of east longitude in the area of frontier of the Kyrgyz Republic;

40 degrees of 5,9 of minute of northern latitude and 70 degrees of 46,7 of minute of east longitude;

40 degrees of 6,7 of minute of northern latitude and 71 degrees of 1,1 of minute of east longitude in the area of frontiers of the Republic of Uzbekistan and the Kyrgyz Republic;

40 degrees of 8,0 of minute of northern latitude and 71 degrees of 5,6 of minute of east longitude;

40 degrees of 10,9 of minute of northern latitude and 71 degrees of 42,1 of minute of east longitude;

(5) the Delegated airspace No. 5 - limited in the vertical plane from echelon of flight 200 (6100 m) to echelon of flight 510 (15550 m) and the horizontal plane geographical points with coordinates:

39 degrees of 57,4 of minute of northern latitude and 70 degrees of 35,9 of minute of east longitude in the area of frontiers of the Kyrgyz Republic and the Republic of Tajikistan;

39 degrees of 33,9 of minute of northern latitude and 70 degrees of 11,6 of minute of east longitude;
