1. Approve:

1) Rules of approval of temporary decreasing coefficients to rates (the prices, rates of charges) for services in water supply in bulk distribution lines and (or) channels according to appendix 1 to this order;

2) the Method of calculation of level of temporary decreasing coefficient to rates (the prices, rates of charges) for services in water supply in bulk distribution lines and (or) channels according to appendix 2 to this order.

2. Recognize invalid:

1) the order of the Chairman of the Agency of the Republic of Kazakhstan on regulation of natural monopolies of March 23, 2005 No. 93-OD "About approval of Rules of approval of temporary decreasing coefficients to rates (the prices, rates of charges) for water transportation services on bulk distribution lines and (or) channels" (it is registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan for No. 3536);

2) the order of the Chairman of the Agency of the Republic of Kazakhstan on regulation of natural monopolies of April 28, 2010 No. 127-OD "About modification and amendments in the order of the Chairman of the Agency of the Republic of Kazakhstan on regulation of natural monopolies of March 23, 2005 No. 93-OD "About approval of Rules of approval of temporary decreasing coefficients to rates (the prices, rates of charges) for water transportation services on bulk distribution lines and (or) channels" (it is registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan for No. 6264, No. 215-216 is published in the Kazakhstanskaya Pravda newspaper of August 14, 2010 (26276-26277).

3. To committee on regulation of natural monopolies, protection of the competition and the rights of consumers of the Ministry of national economy of the Republic of Kazakhstan to provide in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in printing and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of national economy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item of the order.

4. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules of approval of temporary decreasing coefficients to rates (the prices, rates of charge) for services in water supply in bulk distribution lines and (or) channels (further - Rules), are developed according to the subitem 5) of Item 1 of article 14-1 of the Law of the Republic of Kazakhstan of July 9, 1998 "About natural monopolies" (further - the Law) and determine approval procedure of temporary decreasing coefficients to rates (the prices, rates of charges) for services in water supply in bulk distribution lines and (or) channels.

2. In Rules the following concepts are applied:

1) competent authority - Committee on water resources of the Ministry of Agriculture of the Republic of Kazakhstan;

2) overdue accounts payable - the amount of financial liabilities unexecuted at the scheduled time, money debts of the consumer before the water organization;

3) the repayment schedule - the debt repayment schedule of the consumer before the water organization certified by signatures of the consumer and head of the water organization;

4) the request - the written address (in any form) the water organization or the consumer in department of authorized body or its territorial subdivision on approval of temporary decreasing coefficients to rate (the price, rate of charge) for services in water supply in bulk distribution lines and (or) channels of the water organization with indication of its planned level;

5) the applicant - the water organization, the consumer;

6) industry state body - the state body of the Republic of Kazakhstan performing management of industry (sphere) of public administration in which the consumer, except for authorized and competent bodies performs activities;

7) the water organization - the subject of natural monopoly rendering services in water supply in bulk distribution lines and (or) channels;

8) the consumer - the physical person or legal entity using or intending to use regulated services (goods, works) of the subject of natural monopoly;

9) department of authorized body - department of the state body performing management in spheres of natural monopolies;
